H.F. 61 Section 1. Section 727.2, subsection 1, Code 2015, is 1 amended to read as follows: 2 1. The term “fireworks” includes any explosive composition, 3 or combination of explosive substances, or article prepared 4 for the purpose of producing a visible or audible effect 5 by combustion, explosion, deflagration, or detonation, and 6 includes blank cartridges, firecrackers, torpedoes, skyrockets, 7 roman candles, or other fireworks of like construction and 8 fireworks containing any explosive or flammable compound, or 9 other device containing any explosive substance. The term 10 “fireworks” does not include goldstar-producing sparklers on 11 wires which contain no magnesium or chlorate or perchlorate, 12 flitter sparklers in paper tubes that do not exceed one-eighth 13 of an inch in diameter, toy snakes which contain no mercury, 14 or caps used in cap pistols , or party poppers, string poppers, 15 or snappers, each consisting of not more than twenty-five 16 hundredths grains of explosive mixture . 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill excludes party poppers, string poppers, and 21 snappers from the definition of fireworks whose sale or use is 22 generally prohibited. 23 -1- LSB 1105YH (2) 86 aw/nh 1/ 1
