Request
to
limit
public

access
to
certain
personal
information
——
internet
sites.

1.
Notwithstanding
chapter
22,
an
individual
may
file
a
3
written
request
with
a
local
official
on
a
form
prescribed
by
4
the
department
of
public
safety,
in
consultation
with
the
Iowa
5
county
recorders
association
and
the
Iowa
state
association
6
of
assessors,
to
prohibit
the
general
public
from
accessing,
7
on
an
internet
site
maintained
by
the
local
official,
the
8
individual’s
name,
residential
address,
and
telephone
number,
9
as
identified
by
the
individual,
that
are
contained
in
10
instruments,
books,
records,
indexes,
and
other
information
11
under
the
authority
of
the
local
official.

2.
Within
fifteen
days
of
receiving
the
request,
the
13
local
official
shall
ensure
that
the
individual’s
information
14
identified
by
the
individual
under
subsection
1
does
not
appear
15
in
search
results
on
an
internet
site
maintained
by
the
local
16
official.

3.
For
purposes
of
this
section,
“local
official”
means
a
18
county
auditor,
county
treasurer,
county
recorder,
or
local
19
assessor.

Sec.
2.
IMPLEMENTATION
OF
ACT.
Section
25B.2,
subsection
21
3,
shall
not
apply
to
this
Act.

Sec.
3.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
23
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
25
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
26
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
an
individual
may
file
a
written
28
request
with
one
or
more
local
officials
to
prohibit
the
29
general
public
from
accessing
on
an
internet
site
maintained
by
30
the
local
official
the
individual’s
name,
residential
address,
31
and
telephone
number,
as
identified
by
the
individual,
that
are
32
contained
in
instruments,
books,
records,
indexes,
and
other
33
information
under
the
authority
of
the
local
official.

The
bill
requires
the
local
official
to,
within
15
days
of

a
request,
ensure
that
the
individual’s
information

does
not
appear
in
search
results
on
an
internet
site

maintained
by
the
local
official.

The
bill
may
include
a
state
mandate
as
defined
in
Code
4
section
25B.3.
The
bill
makes
inapplicable
Code
section
25B.2,
5
subsection
3,
which
would
relieve
a
political
subdivision
from
6
complying
with
a
state
mandate
if
funding
for
the
cost
of
7
the
state
mandate
is
not
provided
or
specified.
Therefore,
8
political
subdivisions
are
required
to
comply
with
any
state
9
mandate
included
in
the
bill.
10
The
bill
takes
effect
upon
enactment.
