H.F. 424 Section 1. Section 321.276, subsection 5, Code 2015, is 1 amended by striking the subsection. 2 EXPLANATION 3 The inclusion of this explanation does not constitute agreement with 4 the explanation’s substance by the members of the general assembly. 5 Current law provides that a peace officer shall not stop 6 or detain a person solely for a suspected violation of Code 7 section 321.276, which prohibits text-messaging while driving. 8 Code section 321.276 is enforceable by a peace officer only as 9 a secondary action when the driver of a motor vehicle has been 10 stopped or detained for a suspected violation of another law. 11 This bill strikes these provisions and makes a violation of 12 Code section 321.276 a primary offense.
