Section
1.
Section
123.53,
subsection
5,
Code
2015,
is

amended
to
read
as
follows:

5.
After
any
transfer
provided
for
in
subsection
3
is

made,
the
department
of
commerce
shall
transfer
into
a
special
4
revenue
account
in
the
general
fund
of
the
state,
a
sum
of
5
money
at
least
equal
to
seven
nine
percent
of
the
gross
amount
6
of
sales
made
by
the
division
from
the
beer
and
liquor
control
7
fund
on
a
monthly
basis
but
not
less
than
nine
million
dollars
8
annually.
Of
the
amounts
transferred,
two
million
dollars,
9
plus
an
additional
amount
determined
by
the
general
assembly,
10
shall
be
appropriated
to
the
Iowa
department
of
public
health
11
for
use
by
the
staff
who
administer
the
comprehensive
substance
12
abuse
program
under
chapter
125
for
substance
abuse
treatment
13
and
prevention
programs.
Any
amounts
received
in
excess
of
the
14
amounts
appropriated
to
the
Iowa
department
of
public
health
15
for
use
by
the
staff
who
administer
the
comprehensive
substance
16
abuse
program
under
chapter
125
shall
be
considered
part
of
the
17
general
fund
balance.

EXPLANATION
19
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
20
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Code
section
123.53(5),
concerning
transfers
from
the
beer
22
and
liquor
control
fund
to
a
special
fund
for
substance
abuse
23
treatment
and
prevention
programs,
is
amended.
This
bill
24
increases,
from
7
percent
to
9
percent,
the
percentage
of
the
25
gross
amount
of
sales
made
by
the
alcoholic
beverages
division
26
that
is
transferred
from
the
beer
and
liquor
control
fund
to
27
the
special
fund.
