H.F. 34 Section 1. Section 321.194, subsection 1, paragraph 1 a, subparagraph (1), Code 2015, is amended by striking the 2 subparagraph and inserting in lieu thereof the following: 3 (1) During the hours of 5:00 a.m. to 10:00 p.m. over the 4 most direct and accessible route between any of the following: 5 (a) The licensee’s residence and schools of enrollment. 6 (b) The licensee’s residence and the closest school bus stop 7 or stop for a public transportation service. 8 (c) The licensee’s schools of enrollment, for the purpose 9 of attending duly scheduled courses of instruction and 10 extracurricular activities within the school district. 11 (d) The licensee’s residence or schools of enrollment 12 and any other location, for the purpose of participating in 13 an extracurricular activity recognized by an organization 14 registered with the department of education for the purposes of 15 extracurricular interscholastic competition or conducted under 16 a sharing agreement with the licensee’s school of enrollment. 17 Sec. 2. Section 321.194, subsection 1, paragraph a, 18 subparagraph (2), Code 2015, is amended by striking the 19 subparagraph. 20 Sec. 3. Section 321.194, subsection 1, paragraph a, 21 subparagraphs (3) and (4), Code 2015, are amended to read as 22 follows: 23 (3) (2) To a service station for the purpose of refueling, 24 so long as the service station is the station closest to the 25 route the licensee is traveling on under subparagraph (1) or 26 (2) . 27 (4) (3) At any time when the licensee is accompanied in 28 accordance with section 321.180B, subsection 1 . 29 EXPLANATION 30 The inclusion of this explanation does not constitute agreement with 31 the explanation’s substance by the members of the general assembly. 32 This bill relates to the use of special minors’ driver’s 33 licenses to travel to extracurricular activities not held at a 34 school. 35 -1- LSB 1382YH (5) 86 ns/nh 1/ 2
H.F. 34 Current law provides that during the hours of 5:00 a.m. to 1 10:00 p.m., a licensee may travel from the licensee’s residence 2 or school of enrollment to another school for the purpose of 3 participating in extracurricular activities conducted under a 4 sharing agreement with the licensee’s school of enrollment. 5 The bill reorganizes the structure of the Code provision 6 restricting the hours of operation and allowed routes for such 7 licensees to enhance readability. 8 The bill expands the provision to allow a licensee to travel 9 to any location at which an extracurricular activity is being 10 held for the purpose of participating in the activity. The 11 bill also expands the provision to include all extracurricular 12 activities recognized by organizations registered with the 13 department of education for the purposes of extracurricular 14 interscholastic competition. Those organizations currently 15 include the Iowa high school athletic association, the Iowa 16 girls’ high school athletic union, the Iowa high school music 17 association, the Iowa high school speech association, and the 18 unified Iowa high school activities federation. 19 -2- LSB 1382YH (5) 86 ns/nh 2/ 2
