H.F. 33 Section 1. Section 321.215, Code 2015, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 5. Notwithstanding any other provision 3 of this chapter to the contrary, the department may issue a 4 temporary restricted license to a person declared to be a 5 habitual offender under section 321.555 who has also violated 6 section 321.218 if the person meets the requirements for 7 eligibility for a temporary restricted license under section 8 321.560 and this section. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill allows a person declared to be a habitual offender 13 who has also been convicted of operating a vehicle with a 14 suspended driver’s license to be eligible for a temporary 15 restricted license (TRL) if the person meets the requirements 16 for eligibility for a TRL under Code section 321.560, which 17 deals with TRLs for habitual offenders, and under Code section 18 321.215, which deals with TRLs generally, including TRLs 19 involving convictions for operating a vehicle with a suspended 20 driver’s license. 21 -1- LSB 1126YH (3) 86 ns/nh 1/ 1
