H.F. 318 Section 1. Section 509B.2, subsection 1, Code 2015, is 1 amended to read as follows: 2 1. As used in this chapter , “termination of employment or 3 membership” includes but is not limited to termination because 4 of permanent or temporary layoff or approved leave of absence , 5 including an absence or reduction in hours due to the injury or 6 illness of the employee or member . A provision in this chapter 7 which relates to termination of insurance under a group policy 8 of an employee or member and the employee’s or member’s covered 9 dependents includes termination of insurance with respect to 10 the surviving or former spouse or children of an employee or 11 member whose insurance would terminate because of dissolution 12 or annulment of the marriage of the employee or member, or 13 would terminate because of death of the employee or member. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 Code chapter 509B provides that an employee or member has 18 the right to continue their group accident or health insurance 19 which would otherwise terminate because of termination of 20 the employment or membership. The bill specifies that a 21 “termination of employment or membership” which triggers this 22 right includes an absence or reduction in hours due to the 23 injury or illness of the employee or member. 24 -1- LSB 2496YH (2) 86 av/nh 1/ 1
