Section
1.
Section
321.1,
Code
2015,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
06A.
“Automated
traffic
law
enforcement
3
system”
means
a
device
with
one
or
more
sensors
working
in
4
conjunction
with
one
of
the
following:
5
a.
An
official
traffic-control
signal,
to
produce
recorded
6
images
of
motor
vehicles
entering
an
intersection
against
a
red
7
signal
light.
8
b.
A
speed
measuring
device,
to
produce
recorded
images
of
9
motor
vehicles
traveling
at
a
prohibited
rate
of
speed.
10
c.
A
railroad
grade
crossing
signal
light,
as
described
in
11
section
321.342,
to
produce
images
of
vehicles
violating
the
12
signal
light.
13
d.
Any
official
traffic-control
device,
if
failure
to
comply
14
with
the
official
traffic-control
device
constitutes
a
moving
15
violation
under
this
chapter.

1.
a.
If
the
department
or
a
local
authority
uses
a
fixed
19
automated
traffic
law
enforcement
system
to
monitor
a
street,
20
road,
or
highway
in
this
state,
the
department
or
the
local
21
authority
shall
post
a
permanent
sign
at
least
five
hundred
22
feet,
but
no
more
than
one
thousand
feet,
in
advance
of
the
23
location
where
the
system
is
in
use
to
advise
drivers
that
the
24
system
is
in
place.
25
b.
If
the
department
or
a
local
authority
uses
a
mobile
26
automated
traffic
law
enforcement
system
to
monitor
a
street,
27
road,
or
highway
in
this
state,
the
department
or
the
local
28
authority
shall
post
a
temporary
sign
at
least
five
hundred
29
feet,
but
no
more
than
one
thousand
feet,
in
advance
of
the
30
location
where
the
system
is
in
use
to
advise
drivers
that
the
31
system
is
in
place.

The
signage
required
by
this
section
shall
be
as

prescribed
by
the
manual
on
uniform
traffic-control
devices

adopted
by
the
department
pursuant
to
section
321.252.

IMPLEMENTATION
OF
ACT.
Section
25B.2,
subsection
1
3,
shall
not
apply
to
this
Act.

EXPLANATION
3
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
4
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Current
administrative
rules
require
signage
in
advance
6
of
the
location
of
automated
traffic
law
enforcement
systems
7
located
on
roads
under
the
jurisdiction
of
the
department
of
8
transportation
(DOT).
This
bill
codifies
these
provisions
and
9
requires
the
DOT
and
local
authorities
to
use
such
signage
on
10
all
streets,
roads,
and
highways
in
the
state.
11
The
bill
defines
“automated
traffic
law
enforcement
system”
12
as
a
device
with
one
or
more
sensors
working
in
conjunction
13
with
an
official
traffic-control
signal,
a
speed
measuring
14
device,
a
railroad
grade
crossing
signal
light,
or
any
other
15
official
traffic-control
device.

The
bill
requires
the
DOT
and
local
authorities
to
post
signs
17
indicating
the
presence
of
an
automated
traffic
law
enforcement
18
system
at
least
500
feet,
but
no
more
than
1,000
feet,
in
19
advance
of
the
location
of
the
system
to
advise
drivers
that
20
the
system
is
in
place.
In
addition,
the
bill
provides
that
21
fixed
systems
require
permanent
signage,
and
mobile
systems
22
require
temporary
signage.
The
signage
required
shall
be
as
23
prescribed
by
the
manual
on
uniform
traffic-control
devices
24
adopted
by
the
DOT.
25
The
bill
may
include
a
state
mandate
as
defined
in
Code
26
section
25B.3.
The
bill
makes
inapplicable
Code
section
25B.2,
27
subsection
3,
which
would
relieve
a
political
subdivision
from
28
complying
with
a
state
mandate
if
funding
for
the
cost
of
29
the
state
mandate
is
not
provided
or
specified.
Therefore,
30
political
subdivisions
are
required
to
comply
with
any
state
31
mandate
included
in
the
bill.
