general
assembly
declares
that
energy
management
is
of

primary
importance
in
the
design
of
publicly
owned
facilities.

Commencing
January
1,
1980
On
or
after
the
effective
date
of

this
division
of
this
Act
,
a
public
agency
responsible
for
the
29
construction
or
renovation
of
a
facility
or
the
construction
of
30
an
addition
shall,
in
a
design
begun
after
that
date,
include
31
as
a
design
criterion
the
requirement
that
a
life
cycle
cost
32
analysis
be
conducted
for
the
facility.
The
objectives
of
the
33
life
cycle
cost
analysis
are
to
optimize
energy
efficiency
at
34
an
acceptable
life
cycle
cost.
The

analysis

design
and
shall
meet

the
requirements
of
this
chapter
if
the
design
meets
the

operational
requirements
of
the
agency
and
provides

optimum

public
agency
shall
retain
a
copy
of
the

cycle
cost
analysis
and
a
statement
justifying
a
design

decision
both
of
which
shall
be
available
for
public
inspection

reasonable

copy
of
the

cost
analysis
for
review
by
the
commissioner
who
shall

consult
with
the
authority.
If
the
public
agency
is
also
a

state
agency
under
section
7D.34
,
comments
by
the
authority
10
or
the
commissioner,
including
any
recommendation
for
changes
11
in
the
analysis,
shall,
within
thirty
days
of
receipt
of
the
12
analysis,
be
forwarded
in
writing
to
the
public
agency.
If
13
either
the
authority
or
the
commissioner
disagrees
with
any
14
aspects
of
the
life
cycle
cost
analysis,
the
public
agency
15
affected
shall
timely
respond
in
writing
to
the
commissioner
16
and
the
authority.
The
response
shall
indicate
whether
the
17
agency
intends
to
implement
the
recommendations
and,
if
the
18
agency
does
not
intend
to
implement
them,
the
public
agency
19
shall
present
its
reasons.
The
reasons
may
include
but
are
20
not
limited
to
a
description
of
the
purpose
of
the
facility
or
21
renovation,
preservation
of
historical
architectural
features,
22
architectural
and
site
considerations,
and
health
and
safety
23
concerns.

2.
Within
thirty
days
of
receipt
of
the
response
of
the
25
public
agency
affected,
the
authority,
the
commissioner,
or
26
both,
shall
notify
in
writing
the
public
agency
affected
of
27
the
authority’s,
the
commissioner’s,
or
both’s
agreement
28
or
disagreement
with
the
response.
In
the
event
of
a
29
disagreement,
the
authority,
the
commissioner,
or
both,
shall

at
the
same
time
transmit
the
notification
of
disagreement

the

exempt
facilities

a
case

case-by-case
basis.

Factors
to
be
considered
when
developing
the
exemption
criteria

shall
include,
but
not
be
limited
to,
a
description
of
the
20
purpose
of
the
facility
or
renovation,
the
preservation
21
of
historical
architectural
features,
site
considerations,
22
and
health
and
safety
concerns.
The
commissioner
and
the
23
director
shall
grant
or
deny
a
request
for
exemption
from
the
24
requirements
of
this
section
within
thirty
days
of
receipt
of
25
the
request.

EFFECTIVE
UPON
ENACTMENT.
This
division
of
this

Act,
being
deemed

immediate
importance,
takes

payment
requested

under
this
program.
Such
criteria
may
provide
for
the

acceptance
of
a
signature
in
a
form
other
than
the
handwriting

of
a
person.

charge
application

chapter

satisfied.
The
authority
shall
adopt
rules
governing

required
under
this
subsection.

funded

by
private
funding
sources.

review

the

applicable,

authority

verify
that

requirements

agreement,

chapter

adopted
pursuant

to
this
chapter
have
been
satisfied
and
shall
verify
the

qualified
rehabilitation
expenditures.
After

consultation
with
the
department
of
revenue,
the
department
may

issue
a
tax
credit
certificate
to
the
eligible
taxpayer
stating

the
amount
of
tax
credit
under
section
404A.2
the
eligible

taxpayer
may
claim.
The
department

authority

by
modifying

cycle
cost

analysis
provisions
relating
to
public
facilities,
making

technical
changes
pertaining
to
the
high
quality
jobs
program,
17
modifying
economic
development
authority
assistance
provisions
18
under
the
business
outreach
program,
modifying
provisions
19
concerning
enterprise
zones,
and
transferring
certain
duties
20
to
the
authority
under
the
historic
preservation
and
cultural
21
entertainment
district
tax
credit
program.
22
Division
I
of
the
bill
modifies
provisions
relating
to
the
23
life
cycle
analysis
required
of
certain
public
facilities.
24
The
division
adds
a
definition
of
“addition”
and
modifies
the
25
definitions
of
“facility”
and
“renovation”
and
requires
a
26
public
agency
responsible
for
the
construction
or
renovation
27
of
a
facility
or
the
construction
of
an
addition
to
a
facility
28
to
include
the
performance
of
a
life
cycle
cost
analysis
as

a
design
criterion
on
or
after
the
effective
date
of
the

division.
The
division
requires
a
public
agency

investment”
under
the
high
quality

jobs
program.

Division
III
of
the
bill
relates
to
the
authority’s
business

outreach
program,
which
provides
technical
and
financial
8
assistance
to
businesses
applying
for
federal
small
business
9
innovation
research
and
small
business
technology
transfer
10
program
grants
and
contracts.

Under
current
law,
the
authority
is
allowed
to
provide
12
financial
assistance
of
up
to
$25,000
to
any
single
business

and
is
allowed
to
provide
such
financial
assistance
as
matching

funds
to
allow
a
business
to
qualify
for
either
federal
15
program.
The
division
provides
that
the
authority
may
provide
16
financial
assistance
of
up
to
$100,000
to
a
business
for
any
17
individual
federal
award
under
those
programs
and
that
the
18
financial
assistance
may
be
used
for
any
purpose
to
allow
a
19
business
to
meet
federal
program
requirements.

Division
IV
of
the
bill
relates
to
enterprise
zones.

The
division
allows
a
city
or
county
and
the
authority
22
for
compliance
reasons
to
amend
agreements
made
under
the
23
enterprise
zone
program
as
long
as
the
amendments
do
not
24
increase
the
amount
of
incentives
awarded
and
the
economic
25
development
authority
board
approves.

Division
V
of
the
bill
relates
to
the
historic
preservation

and
cultural

entertainment
district
tax
credit
by

transferring

oversight

credit,
along
with

penalties,

holder

activity.
The
division
