H.F. 241 Section 1. Section 299.1A, subsection 1, Code 2015, is 1 amended to read as follows: 2 1. Except as provided in subsections 2 and 3 , a child 3 who has reached the age of six and is under sixteen eighteen 4 years of age by September 15 is of compulsory attendance age. 5 However, if a child enrolled in a school district or accredited 6 nonpublic school reaches the age of sixteen eighteen on or 7 after September 15, the child remains of compulsory age until 8 the end of the regular school calendar. 9 Sec. 2. Section 321.213B, Code 2015, is amended to read as 10 follows: 11 321.213B Suspension for failure to attend. 12 1. The department shall establish procedures by rule for 13 suspending the license of a juvenile who has been issued a 14 driver’s license and is not in compliance with the requirements 15 of section 299.1B or issuing the juvenile a restricted license 16 under section 321.178 . 17 2. Upon receipt of proof of high school graduation from 18 a person whose intermediate or full driver’s license was 19 suspended or revoked pursuant to section 299.1B, the department 20 may reinstate the person’s license. Notwithstanding section 21 321.191, subsection 8, reinstatement of a driver’s license 22 pursuant to this subsection shall be without fee. 23 Sec. 3. STATE MANDATE FUNDING SPECIFIED. In accordance 24 with section 25B.2, subsection 3, the state cost of requiring 25 compliance with any state mandate included in this Act shall 26 be paid by a school district from state school foundation aid 27 received by the school district under section 257.16. This 28 specification of the payment of the state cost shall be deemed 29 to meet all of the state funding-related requirements of 30 section 25B.2, subsection 3, and no additional state funding 31 shall be necessary for the full implementation of this Act 32 by and enforcement of this Act against all affected school 33 districts. 34 EXPLANATION 35 -1- LSB 2292HH (4) 86 kh/rj 1/ 2
H.F. 241 The inclusion of this explanation does not constitute agreement with 1 the explanation’s substance by the members of the general assembly. 2 This bill relates to compulsory education standards and 3 penalties. 4 The bill raises the compulsory school attendance age from 16 5 to 18. 6 The department of transportation is authorized to reinstate 7 a license, without fee, upon receipt of proof of high school 8 graduation from a person whose intermediate or full driver’s 9 license was suspended or revoked because the person was truant, 10 notwithstanding a current Code provision that permits the 11 department to charge a fee of $20 for reinstatement of a 12 license. 13 The bill may include a state mandate as defined in Code 14 section 25B.3. The bill requires that the state cost of 15 any state mandate included in the bill be paid by a school 16 district from state school foundation aid received by the 17 school district under Code section 257.16. The specification 18 is deemed to constitute state compliance with any state mandate 19 funding-related requirements of Code section 25B.2. The 20 inclusion of this specification is intended to reinstate the 21 requirement of political subdivisions to comply with any state 22 mandates included in the bill. 23 -2- LSB 2292HH (4) 86 kh/rj 2/ 2
