H.F. 2363 Section 1. Section 21.5, Code 2016, is amended by adding the 1 following new subsection: 2 NEW SUBSECTION . 3A. A governmental body shall not exclude 3 a member of the governmental body from attending a closed 4 session, unless the member’s attendance at the closed session 5 creates a conflict of interest for the member due to the 6 specific reason announced as justification for holding the 7 closed session. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 Under Code chapter 21, a governmental body may hold a meeting 12 of the governmental body in closed session under certain 13 circumstances. 14 The bill provides that a governmental body shall not exclude 15 a member of the governmental body from attending a closed 16 session unless the member’s attendance at the closed session 17 creates a conflict of interest for the member due to the 18 specific reason announced as justification for holding the 19 closed session. 20 -1- LSB 5915HV (2) 86 rh/ec 1/ 1
