1.
A
person
who
operates
a
motor
vehicle
while
the
person’s
4
driver’s
license
or
operating
privilege
has
been
denied,
5
canceled,
suspended,
revoked,
or
barred
and
who
commits
a
6
moving
violation
during
such
operation
that
results
in
serious
7
injury,
as
defined
in
section
702.18,
to
another
person
is
8
guilty
of
a
serious
misdemeanor.

A
person
who
operates
a
motor
vehicle
while
the
person’s

driver’s
license
or
operating
privilege
has
been
denied,

canceled,
suspended,
revoked,
or
barred
and
who
commits
a

moving
violation
during
such
operation
that
results
in
the

death
of
another
person
is
guilty
of
an
aggravated
misdemeanor.

For
the
purposes
of
this
section,
“moving
violation”

means
as
defined
in
761
IAC
615.1,
and
does
not
include
any
16
violation
not
considered
a
moving
violation
under
this
chapter.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
19
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
a
person
who
operates
a
motor
vehicle
21
while
the
person’s
driver’s
license
or
operating
privilege
22
has
been
denied,
canceled,
suspended,
revoked,
or
barred
and
23
who
commits
a
moving
violation
during
such
operation
that
24
results
in
serious
injury
to
another
person
is
guilty
of
a
25
serious
misdemeanor.
If
the
moving
violation
results
in
the
26
death
of
another
person,
the
person
is
guilty
of
an
aggravated
27
misdemeanor.
Under
Code
section
903.1,
a
serious
misdemeanor
28
is
punishable
by
a
fine
of
at
least
$315
but
not
to
exceed
29
$1,875
and
imprisonment
not
to
exceed
one
year.
An
aggravated
30
misdemeanor
is
punishable
by
a
fine
of
at
least
$625
but
not
to
31
exceed
$6,250
and
imprisonment
not
to
exceed
two
years.

The
bill
defines
“moving
violation”
as
the
term
is
33
defined
in
the
Iowa
administrative
code
by
the
department
of
34
transportation.
Under
the
bill,
“moving
violation”
does
not

including
text
messaging

driving

Code
