1.
A
person
shall
not
knowingly
acquire,
provide,
3
receive,
or
use
a
fetal
body
part,
regardless
of
whether
4
the
acquisition,
provision,
receipt,
or
use
is
for
valuable
5
consideration.

2.
Subsection
1
shall
not
apply
to
any
of
the
following:
7
a.
Diagnostic
or
remedial
tests,
procedures,
or
observations
8
which
have
the
sole
purpose
of
determining
the
life
or
health
9
of
the
fetus
in
order
to
provide
that
information
to
the
10
pregnant
woman
or
to
preserve
the
life
or
health
of
the
fetus
11
or
pregnant
woman.
12
b.
The
arranging,
by
a
physician
who
induces
or
performs
13
an
abortion,
for
the
final
disposition
of
fetal
body
parts
14
resulting
from
the
abortion.
15
c.
The
actions
of
a
person
that
are
exclusively
in
the
16
furtherance
of
the
final
disposition
of
a
fetal
body
part.

3.
A
person
who
violates
this
section
is
guilty
of
a
class
18
“C”
felony.

4.
For
the
purposes
of
this
section:
20
a.
“Abortion”
means
as
defined
in
section
146.1.
21
b.
“Fetal
body
part”
means
a
cell,
tissue,
organ,
or
other
22
part
of
a
fetus
that
is
terminated
by
an
abortion.
23
c.
“Final
disposition”
means
the
disposition
of
fetal
24
body
parts
by
burial,
interment,
entombment,
cremation,
or
25
incineration.

EXPLANATION
27
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
28
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
a
person
from
knowingly
acquiring,
30
providing,
receiving,
or
using
a
fetal
body
part,
regardless
31
of
whether
the
acquisition,
provision,
receipt,
or
use
is
32
for
valuable
consideration.
However,
the
prohibition
does
33
not
apply
to
diagnostic
or
remedial
tests,
procedures,
or
34
observations
which
have
the
sole
purpose
of
determining

the
life
or
health
of
the
fetus
in
order
to
provide
that
1
information
to
the
pregnant
woman
or
to
preserve
the
life
or

health
of
the
fetus

pregnant
woman;
to
the
arranging
by
a

physician,
who
induces
or
performs
an
abortion,
for
the
final
4
disposition
of
fetal
body
parts
resulting
from
the
abortion;
or
5
the
actions
of
a
person
that
are
exclusively
in
the
furtherance
6
of
the
final
disposition
of
a
fetal
body
part.

A
person
who
violates
the
bill
is
guilty
of
a
class
“C”
8
felony.
A
class
“C”
felony
is
punishable
by
confinement
for
no
9
more
than
10
years
and
a
fine
of
at
least
$1,000
but
not
more
10
than
$10,000.
