H.F. 2285 Section 1. RACING AND GAMING COMMISSION —— STUDY. 1 1. The state racing and gaming commission shall conduct a 2 study concerning the impact of the exemption for the gaming 3 floor of a premises licensed pursuant to chapter 99F from 4 Iowa’s smokefree air Act, chapter 142D, on the health and 5 safety of employees employed at a gambling structure, excursion 6 gambling boat, or racetrack enclosure. 7 2. In conducting the study, the commission shall do all of 8 the following: 9 a. Survey employees who have been employed at a gambling 10 structure, excursion gambling boat, or racetrack enclosure over 11 the last twenty-five years and since the enactment of Iowa’s 12 smokefree air Act to determine, for each applicable period of 13 time, the percentage of employees surveyed who have contracted 14 respiratory illness or retired or changed jobs due to a medical 15 condition developed while employed, and to determine the 16 average yearly health care costs for employees surveyed. 17 b. Compare data received pursuant to paragraph “a” to data 18 or surveys of employees in this state who have been employed 19 at businesses that are not exempt from Iowa’s smokefree air 20 Act over the last twenty-five years and since the enactment 21 of Iowa’s smokefree air Act to determine, for each applicable 22 period of time, the information described in paragraph “a” for 23 such employees. 24 c. Examine the effectiveness of ventilation systems 25 utilized by gambling game licensees and health and safety 26 consequences to employees as a result of exposure to smoke. 27 3. The commission shall submit a written report on its 28 findings to the general assembly by December 1, 2016. 29 EXPLANATION 30 The inclusion of this explanation does not constitute agreement with 31 the explanation’s substance by the members of the general assembly. 32 This bill requires the racing and gaming commission to 33 conduct a study on the impact of the exemption for the gaming 34 floor of a premises licensed pursuant to Code chapter 99F from 35 -1- LSB 5939YH (4) 86 ec/nh 1/ 2
