H.F. 2283 Section 1. Section 321G.13, subsection 2, Code 2016, is 1 amended to read as follows: 2 2. a. A Except as provided in paragraphs “b” and “c” , a 3 person shall not operate or ride a snowmobile with a firearm in 4 the person’s possession unless it is unloaded and enclosed in a 5 carrying case. 6 b. However, a A nonambulatory person may carry an uncased 7 and unloaded firearm while operating or riding a snowmobile. 8 c. (1) A person may operate or ride on a snowmobile with 9 a loaded firearm, whether concealed or not, if the person has 10 in the person’s possession and displays to a peace officer on 11 demand a valid permit to carry weapons which has been issued 12 to the person, and the person’s conduct is within the limits 13 of that permit. 14 (2) A person may operate or ride on a snowmobile with a 15 loaded firearm, whether concealed or not, without a permit to 16 carry weapons, if the person operates or rides on land owned or 17 possessed by the person, and the person’s conduct is otherwise 18 lawful. 19 Sec. 2. Section 321I.14, subsection 2, Code 2016, is amended 20 to read as follows: 21 2. a. A Except as otherwise provided in this paragraph, a 22 person shall not operate or ride an all-terrain vehicle with a 23 firearm in the person’s possession unless it is unloaded and 24 enclosed in a carrying case. 25 (1) However, a A nonambulatory person may carry an uncased 26 and unloaded firearm while operating or riding an all-terrain 27 vehicle. 28 (2) A person may operate or ride on an all-terrain vehicle 29 with a loaded firearm, whether concealed or not, if the person 30 has in the person’s possession and displays to a peace officer 31 on demand a valid permit to carry weapons which has been issued 32 to the person, and the person’s conduct is within the limits 33 of that permit. 34 (3) A person may operate or ride on an all-terrain vehicle 35 -1- LSB 5067HV (4) 86 jm/nh 1/ 3
H.F. 2283 with a loaded firearm, whether concealed or not, without a 1 permit to carry weapons, if the person operates or rides on 2 land owned or possessed by the person, and the person’s conduct 3 is otherwise lawful. 4 b. A person shall not discharge a firearm from an 5 all-terrain vehicle when hunting or attempting to hunt game 6 as defined in section 481A.1 or protected nongame species as 7 described in section 481A.42. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to carrying a firearm while operating or 12 riding a snowmobile or an all-terrain vehicle. 13 The bill amends Code sections 321G.13(2) and 321I.14(2) 14 to allow a person to operate or ride on a snowmobile or an 15 all-terrain vehicle with a loaded firearm, whether concealed or 16 not, if the person has in the person’s possession and displays 17 to a peace officer on demand a valid permit to carry weapons 18 which has been issued to the person, and the person’s conduct 19 is within the limits of that permit. 20 The bill allows a person to operate or ride a snowmobile or 21 all-terrain vehicle with a loaded firearm, whether concealed or 22 not, without a permit to carry weapons, if the person operates 23 or rides on land owned or possessed by the person, and the 24 person’s conduct is otherwise lawful. 25 The bill also prohibits a person from discharging a firearm 26 from an all-terrain vehicle when hunting or attempting to hunt 27 game as defined in Code section 481A.1 or protected nongame 28 species as described in Code section 481A.42. Current Code 29 section 481A.120 already prohibits a person from hunting from 30 a snowmobile. 31 Current law provides that a person shall not operate or ride 32 on a snowmobile or an all-terrain vehicle with a firearm in the 33 person’s possession unless it is unloaded and enclosed in a 34 carrying case. H.F. 2283 uncased and unloaded firearm while operating or riding on a 1 snowmobile or an all-terrain vehicle. 2 A person who violates Code section 321G.13(2) or 321I.14(2) 3 commits a simple misdemeanor punishable as a scheduled fine in 4 the amount of $100 pursuant to Code section 805.8B(2)(b)(3) or 5 (2A)(b)(3), as applicable. 6 -3- LSB 5067HV (4) 86 jm/nh 3/ 3
