H.F. 2276 Section 1. NEW SECTION . 70A.41 State limitation or 1 restriction of enforcement of federal immigration law prohibited. 2 1. The state and any state agency, officer, or employee 3 shall not adopt or enforce any rule, policy, or procedure that 4 limits or restricts the enforcement of any federal immigration 5 law to less than the full extent permitted by federal law. 6 2. The state and any state agency, officer, or employee 7 shall not do any of the following related to information 8 regarding the citizenship or immigration status, whether lawful 9 or unlawful, of any individual: 10 a. Prohibit law enforcement officials or agencies from 11 gathering such information. 12 b. Direct law enforcement officials or agencies not to 13 gather such information. 14 c. Prohibit the communication of such information to federal 15 law enforcement agencies. 16 Sec. 2. Section 331.304, Code 2016, is amended by adding the 17 following new subsection: 18 NEW SUBSECTION . 11. a. A county shall not adopt or enforce 19 any ordinance, policy, or procedure that limits or restricts 20 the enforcement of any federal immigration law to less than the 21 full extent permitted by federal law. 22 b. A county shall not do any of the following related to 23 information regarding the citizenship or immigration status, 24 whether lawful or unlawful, of any individual: 25 (1) Prohibit law enforcement officials or agencies from 26 gathering such information. 27 (2) Direct law enforcement officials or agencies not to 28 gather such information. 29 (3) Prohibit the communication of such information to 30 federal law enforcement agencies. 31 Sec. 3. Section 364.3, Code 2016, is amended by adding the 32 following new subsection: 33 NEW SUBSECTION . 11. a. A city shall not do any of the following related to 3 information regarding the citizenship or immigration status, 4 whether lawful or unlawful, of any individual: 5 (1) Prohibit law enforcement officials or agencies from 6 gathering such information. 7 (2) Direct law enforcement officials or agencies not to 8 gather such information. 9 (3) Prohibit the communication of such information to 10 federal law enforcement agencies. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill prohibits the state of Iowa and any state agency, 15 officer, or employee or a county or city from adopting or 16 enforcing any rule, ordinance, policy, or procedure that limits 17 or restricts the enforcement of any federal immigration law to 18 less than the full extent permitted by federal law. 19 The bill also prohibits the state of Iowa and any state 20 agency, officer, or employee or a county or city from certain 21 activities relating to information regarding the citizenship 22 or immigration status, whether lawful or unlawful, of 23 any individual. The state of Iowa and any state agency, 24 officer, or employee or a county or city shall not prohibit 25 law enforcement officials or agencies from gathering such 26 information, direct law enforcement officials or agencies not 27 to gather such information, or prohibit the communication of 28 such information to federal law enforcement agencies. 29 -2- LSB 5449HV (1) 86 je/sc 2/ 2
