H.F. 2252 Section 1. Section 256.7, subsection 32, paragraph c, 1 unnumbered paragraph 1, Code 2016, is amended to read as 2 follows: 3 Adopt rules that limit the statewide enrollment of 4 pupils in educational instruction and course content that 5 are delivered primarily over the internet to not more than 6 eighteen one-hundredths of one percent of the statewide 7 enrollment of all pupils, and that limit the number of pupils 8 participating in open enrollment for purposes of receiving 9 educational instruction and course content that are delivered 10 primarily over the internet to no more than one percent of 11 a sending district’s enrollment. Until June 30, 2018, such 12 Such limitations shall not apply if the limitations would 13 prevent siblings from enrolling in the same school district or 14 if a sending district determines that the educational needs 15 of a physically or emotionally fragile student would be best 16 served by educational instruction and course content that are 17 delivered primarily over the internet. Students who meet 18 the requirements of section 282.18 may participate in open 19 enrollment under this paragraph “c” for purposes of enrolling 20 only in the CAM community school district or the Clayton Ridge 21 community school district. 22 Sec. 2. Section 256.7, subsection 32, paragraph c, Code 23 2016, is amended by adding the following new subparagraph: 24 NEW SUBPARAGRAPH . (6) This paragraph “c” is repealed June 25 30, 2018. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 Current law requires the state board of education to adopt 30 rules for online learning, including rules prohibiting the 31 open enrollment of students whose educational instruction and 32 course content are delivered primarily over the internet. An 33 exception to that prohibition requires the board to adopt rules 34 allowing such enrollment, with limitations on how many students 35 -1- LSB 5039YH (2) 86 je/sc 1/ 2
H.F. 2252 may be enrolled statewide and per school district. Until June 1 30, 2018, such limitations do not apply to certain students. 2 The exception also limits such open enrollment to the CAM 3 community school district or the Clayton Ridge community school 4 district. 5 This bill repeals the exception to the prohibition on June 6 30, 2018. At that time, open enrollment of students whose 7 educational instruction and course content are delivered 8 primarily over the internet would be entirely prohibited. 9 The bill also strikes language providing that until June 10 30, 2018, limitations on how many students may be enrolled 11 statewide and per school district are not applicable to 12 certain students.
