H.F. 2218 Section 1. Section 478.1, Code 2016, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 6. For the purposes of this chapter, 3 the term “public” when used in connection with “public use” 4 or “public interest” shall be interpreted to be limited to 5 consumers located in this state. 6 Sec. 2. Section 478.3, subsection 3, Code 2016, is amended 7 by striking the subsection. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill modifies how the term “public” is interpreted with 12 respect to specified references contained in Code chapter 478 13 relating to electric transmission lines. 14 The bill provides that “public”, when used in connection 15 with “public use” or “public interest”, shall be interpreted 16 to be limited to consumers located in Iowa. The bill strikes a 17 current provision, applicable to Code section 478.3 concerning 18 the contents of a petition for franchise, that provides that 19 “public” shall not be interpreted to be limited to consumers 20 located in this state. 21 -1- LSB 5903YH (2) 86 rn/sc 1/ 1
