H.F. 2213 Section 1. Section 257.8, subsections 1 and 2, Code 2016, 1 are amended to read as follows: 2 1. State percent of growth. The state percent of growth for 3 the budget year beginning July 1, 2013, is two percent. The 4 state percent of growth for the budget year beginning July 1, 5 2014, is four percent. The state percent of growth for the 6 budget year beginning July 1, 2015, is one and twenty-five 7 hundredths percent. The state percent of growth for each 8 subsequent budget year shall be established by statute which 9 shall be enacted within thirty days of the submission in the 10 year preceding the base year of the governor’s budget under 11 section 8.21 as provided in this subsection . The statute 12 establishing the state percent of growth for a budget year 13 beginning July 1 of an odd-numbered calendar year shall be 14 enacted within thirty days of the submission of the governor’s 15 budget under section 8.21 in that odd-numbered calendar year. 16 The statute establishing the state percent of growth for a 17 budget year beginning July 1 of an even-numbered calendar 18 year shall be enacted during the regular legislative session 19 preceding the base year. The establishment of the state 20 percent of growth for a budget year shall be the only subject 21 matter of the bill which enacts the state percent of growth for 22 a budget year. 23 2. Categorical state percent of growth. The categorical 24 state percent of growth for the budget year beginning July 25 1, 2013, is two percent. The categorical state percent of 26 growth for the budget year beginning July 1, 2014, is four 27 percent. The categorical state percent of growth for the 28 budget year beginning July 1, 2015, is one and twenty-five 29 hundredths percent. The categorical state percent of growth 30 for each budget year shall be established by statute which 31 shall be enacted within thirty days of the submission in the 32 year preceding the base year of the governor’s budget under 33 section 8.21 as provided in this subsection . H.F. 2213 budget year beginning July 1 of an odd-numbered calendar year 1 shall be enacted within thirty days of the submission of the 2 governor’s budget under section 8.21 in that odd-numbered 3 calendar year. The statute establishing the categorical state 4 percent of growth for a budget year beginning July 1 of an 5 even-numbered calendar year shall be enacted during the regular 6 legislative session preceding the base year. The establishment 7 of the categorical state percent of growth for a budget year 8 shall be the only subject matter of the bill which enacts the 9 categorical state percent of growth for a budget year. The 10 categorical state percent of growth may include state percents 11 of growth for the teacher salary supplement, the professional 12 development supplement, the early intervention supplement, and 13 the teacher leadership supplement. 14 Sec. 2. Section 257.40, Code 2016, is amended to read as 15 follows: 16 257.40 Approval of programs for at-risk pupils, alternative 17 programs and schools, and returning dropouts and dropout 18 prevention. 19 The board of directors of a school district requesting 20 to use a modified supplemental amount for costs in excess of 21 the funding received under section 257.11, subsection 4 , for 22 programs for at-risk students, secondary students who attend 23 alternative programs and alternative schools, or returning 24 dropouts and dropout prevention shall submit requests for a 25 modified supplemental amount, including budget costs, to the 26 department not later than December 15 of the year February 10 27 preceding the budget year during which the program will be 28 offered. The department shall review the request and shall 29 prior to January 15 March 10 either grant approval for the 30 request or return the request for approval with comments of the 31 department included. An unapproved request for a program may 32 be resubmitted with modifications to the department not later 33 than February 1 March 25 . Not later than February 15 April 10 , 34 the department shall notify the department of management and 35 -2- LSB 5551YH (2) 86 md/sc 2/ 4
H.F. 2213 the school budget review committee of the names of the school 1 districts for which programs using a modified supplemental 2 amount for funding have been approved and the approved budget 3 of each program listed separately for each school district 4 having an approved request. 5 Sec. 3. APPLICABILITY. This Act applies to the 6 establishment of the state percent of growth and the 7 categorical state percent of growth for school budget years 8 beginning on or after July 1, 2017. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill modifies the requirements for enacting the state 13 percent of growth and the categorical state percent of growth 14 under Code section 257.8. 15 Current law requires the state percent of growth and the 16 categorical state percent of growth to be established by 17 statute within 30 days of the submission of the governor’s 18 budget in the year preceding the base year. 19 The bill requires the statute establishing the state percent 20 of growth and the categorical state percent of growth for 21 a budget year beginning July 1 of an odd-numbered calendar 22 year to be enacted within 30 days of the submission of the 23 governor’s budget in that odd-numbered calendar year. The 24 bill requires the statute establishing the state percent of 25 growth and the categorical state percent of growth for a budget 26 year beginning July 1 of an even-numbered calendar year to be 27 enacted during the regular legislative session preceding the 28 base year. 29 The bill amends Code section 257.40, relating to funding for 30 dropout prevention, at-risk students, and alternative programs 31 and schools, to address changes in the timing of establishment 32 of the state percent of growth. 33 The bill applies to the establishment of the state percent of 34 growth and the categorical state percent of growth for school 35 -3- LSB 5551YH (2) 86 md/sc 3/ 4
