1.
Section
321.438,
subsection
2,
Code
2016,
is

amended
to
read
as
follows:

2.
A
person
shall
not
operate
on
the
highway
a
motor
3
vehicle
equipped
with
a
front
windshield,
a
side
window
to
4
the
immediate
right
or
left
of
the
driver,
or
a
side-wing
5
forward
of
and
to
the
left
or
right
of
the
driver
which
is
6
excessively
dark
or
reflective
so
that
it
is
difficult
for
a
7
person
outside
the
motor
vehicle
to
see
into
the
motor
vehicle
8
through
the
windshield,
window,
or
sidewing.
The
department
9
shall
adopt
rules
establishing
a
minimum
measurable
standard
10
of
transparency
which
shall
apply
to
violations
of
this
11
subsection
.
This
subsection
shall
not
apply
if
the
person
12
possesses
in
the
motor
vehicle
a
signed
document
from
the
13
person’s
physician
licensed
under
chapter
148
or
optometrist
14
licensed
under
chapter
154,
written
on
the
physician’s
or
15
optometrist’s
stationary,
stating
that
the
dark
or
reflective
16
windshield,
window,
or
sidewing
is
necessary
for
the
person’s
17
health.

EXPLANATION
19
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
20
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
a
person
is
prohibited
from
operating
a
22
motor
vehicle
equipped
with
an
excessively
dark
or
reflective
23
windshield,
window,
or
sidewing.
A
violation
of
this
24
prohibition
is
punishable
by
a
scheduled
fine
of
$50.
This
25
bill
provides
that
the
prohibition
against
operating
a
motor
26
vehicle
with
an
excessively
dark
or
reflective
windshield,
27
window,
or
sidewing
does
not
apply
if
the
person
possesses
in
28
the
motor
vehicle
a
signed
document
from
the
person’s
physician
29
or
optometrist,
written
on
the
physician’s
or
optometrist’s
30
stationary,
stating
that
the
dark
or
reflective
windshield,
31
window,
or
sidewing
is
necessary
for
the
person’s
health.
