H.F. 2156 Section 1. Section 123.130, subsection 3, Code 2016, is 1 amended to read as follows: 2 3. All special class “A” and special class “AA” premises 3 shall be located within the state. A person who holds a 4 special class “A” or special class “AA” permit for the same 5 location at which the person holds a class “C” liquor control 6 license or class “B” beer permit may manufacture and sell beer 7 to be consumed on the premises, may sell beer to a class “A” 8 or class “AA” permittee for resale purposes, and may sell beer 9 to distributors outside of the state that are authorized by 10 the laws of that jurisdiction to sell beer at wholesale. In 11 addition, a person who holds a special class “A” or special 12 class “AA” permit for the same location at which the person 13 holds a class “C” liquor control license or class “B” beer 14 permit may manufacture and sell beer at retail in sealed 15 containers of not more than sixty-four ounces to be consumed 16 off the premises. Beer sold at retail as provided in this 17 subsection shall be subject to the barrel tax as provided in 18 section 123.136. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill allows a person who holds a special class “A” 23 or special class “AA” permit to manufacture beer and a class 24 “C” liquor control license or class “B” beer permit for the 25 same location to manufacture and sell beer at retail in sealed 26 containers of not more than 64 ounces to be consumed off the 27 premises.
