Section
1.
Section
321.1,
Code
2016,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
06A.
“Automated
traffic
law
enforcement
3
system”
means
a
device
that
is
used
for
the
enforcement
of
laws
4
regulating
vehicular
traffic
and
that
is
equipped
with
one
or
5
more
sensors
working
in
conjunction
with
one
of
the
following:
6
a.
An
official
traffic-control
signal,
to
produce
recorded
7
images
of
motor
vehicles
entering
an
intersection
against
a
red
8
signal
light.
9
b.
A
speed
measuring
device,
to
produce
recorded
images
of
10
motor
vehicles
traveling
at
a
prohibited
rate
of
speed.
11
c.
A
railroad
grade
crossing
signal
light,
as
described
12
in
section
321.342,
to
produce
recorded
images
of
vehicles
13
violating
the
signal
light.
14
d.
Any
official
traffic-control
device,
if
failure
to
comply
15
with
the
official
traffic-control
device
constitutes
a
moving
16
violation
under
this
chapter.

SECTION
.
321.492C
Automated
traffic
law
18
enforcement
systems.
19
1.
A
citation
issued
as
a
result
of
the
use
of
an
automated
20
traffic
law
enforcement
system
shall
not
be
valid
unless
the
21
automated
traffic
law
enforcement
system
has
been
certified
22
by
the
department
within
the
previous
one-year
period.
The
23
department
shall
adopt
rules
regarding
the
calibration,
24
certification,
and
operation
of
automated
traffic
law
25
enforcement
systems
and
their
components,
including
but
not
26
limited
to
rules
in
accordance
with
the
speed
enforcement
27
camera
systems
operational
guidelines
and
speed
measuring
28
device
performance
specifications
set
forth
by
the
national
29
highway
and
traffic
safety
administration.
An
automated
30
traffic
law
enforcement
system
shall
not
be
certified
under
31
this
subsection
by
its
manufacturer
or
operator,
unless
the
32
operator
is
the
department.

2.
All
fines
collected
from
the
issuance
of
citations
as
34
a
result
of
the
use
of
an
automated
traffic
law
enforcement

system
shall
be
deposited
with
the
clerk
of
the
district
court
1
in
the
county
where
the
automated
traffic
law
enforcement
2
system
is
located
for
distribution
under
section
602.8106.

3.
A
private
entity
that
maintains,
operates,
or
otherwise
4
administers
an
automated
traffic
law
enforcement
system
shall
5
not
receive
the
personal
information,
including
the
name,
6
address,
and
driver’s
license
number,
of
a
person
issued
a
7
citation
as
a
result
of
the
use
of
the
automated
traffic
law
8
enforcement
system.

EXPLANATION
10
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
annual
certification
of
automated
13
traffic
law
enforcement
(ATE)
systems
by
the
department
of
14
transportation
(DOT).
The
bill
provides
that
the
DOT
shall
15
adopt
rules
regarding
the
calibration,
certification,
and
16
operation
of
ATE
systems
and
their
components,
including
but
17
not
limited
to
rules
in
accordance
with
the
speed
enforcement
18
camera
systems
operational
guidelines
and
speed
measuring
19
device
performance
specifications
set
forth
by
the
national
20
highway
and
traffic
safety
administration.
The
bill
prohibits
21
the
certification
of
an
ATE
system
by
its
manufacturer
or
22
operator,
unless
the
operator
is
the
DOT.

The
bill
requires
all
fines
collected
from
the
use
of
an
ATE
24
system
to
be
deposited
with
the
clerk
of
the
district
court
in
25
the
county
where
the
ATE
system
is
located
for
distribution
26
under
Code
section
602.8106
(collection
of
fees
in
criminal
27
cases
and
disposition
of
fees
and
fines).

The
bill
prohibits
a
private
entity
that
maintains,
29
operates,
or
otherwise
administers
an
ATE
system
from
receiving
30
the
personal
information
of
a
person
issued
a
citation
as
a
31
result
of
the
use
of
the
ATE
system.
