H.F. 2056 Section 1. Section 607A.5, Code 2016, is amended to read as 1 follows: 2 607A.5 Automatic excuse from jury service. 3 1. A person shall be excused from jury service if the 4 person submits written documentation verifying, to the court’s 5 satisfaction, that the person is solely responsible for the 6 daily care of a person with a permanent disability living 7 in the person’s household and that the performance of juror 8 service would cause substantial risk of injury to the health of 9 the person with a disability, or that the person is the mother 10 of a breastfed child and is responsible for the daily care of 11 the child. However, if the person is regularly employed at a 12 location other than the person’s household, the person shall 13 not be excused under this section subsection . 14 2. A person shall be excused from jury service if the person 15 is at least seventy-three years of age and notifies the court 16 that the person is at least seventy-three years of age and 17 wishes to be exempted from jury service. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill creates an automatic exemption from jury service 22 for persons who are at least 73 years of age if the person 23 opts out of jury service. To opt out of jury service, the 24 person must notify the court that the person is at least 73 25 years of age and wishes to be exempted from jury service. Upon 26 doing so, the court is required to excuse the person from jury 27 service. 28 Pursuant to Code section 607A.7, a person who makes a false 29 claim in order to be relieved of jury service commits contempt. 30 -1- LSB 5475YH (2) 86 jh/sc 1/ 1
