Drug
testing
notice

An
employee
of
the
department
of
human
services
shall
not
3
provide
advance
notice
of
a
drug
test
to
an
individual
required
4
to
submit
to
a
drug
test
for
purposes
of
participating
in
a
5
program
administered
by
the
department.
Any
person
knowingly
6
violating
or
attempting
to
violate
this
section
shall
be
guilty
7
of
a
simple
misdemeanor.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
10
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
an
employee
of
the
department
of
human
12
services
from
providing
advance
notice
to
an
individual
13
required
to
submit
to
a
drug
test
for
purposes
of
participating
14
in
a
program
administered
by
the
department.
The
bill
provides
15
that
a
person
violating
this
new
Code
section
is
guilty
of
16
a
simple
misdemeanor.
A
simple
misdemeanor
is
punishable
by
17
confinement
for
no
more
than
30
days
or
a
fine
of
at
least
$65
18
but
not
more
than
$625
or
by
both.
