1.
NEW
SECTION
.
802.2C
Accessory
after
the
fact.
1
An
indictment
or
information
for
the
offense
of
accessory
2
after
the
fact
in
violation
of
section
703.3
that
involves
a
3
kidnapping
in
violation
of
section
710.2,
710.3,
or
710.4
shall
4
be
found
within
ten
years
after
commission
of
the
offense
of
5
accessory
after
the
fact.

2.
Section
802.3,
Code
2016,
is
amended
to
read
as
7
follows:

802.3
Felony
——
aggravated
or
serious
misdemeanor.
9
In
all
cases,
except
those
enumerated
in
section
802.1
,
10
802.2
,
802.2A
,
802.2B
,
802.2C,
or
802.10
,
an
indictment
or
11
information
for
a
felony
or
aggravated
or
serious
misdemeanor
12
shall
be
found
within
three
years
after
its
commission.

inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s

by
the
members
of
the
general
assembly.

This
bill
relates
to
the
limitation
of
action
(statute
of
17
limitations)
for
the
criminal
offense
of
accessory
after
the
18
fact
involving
kidnapping.
19
The
bill
provides
that
an
indictment
or
information
for
20
the
offense
of
accessory
after
the
fact
in
violation
of
Code
21
section
703.3
that
involves
a
kidnapping
in
violation
of
Code
22
section
710.2
(kidnapping
in
the
first
degree),
Code
section
23
710.3
(kidnapping
in
the
second
degree),
or
Code
section
710.4
24
(kidnapping
in
the
third
degree)
shall
be
found
within
10
25
years
after
the
commission
of
the
offense
of
accessory
after
26
the
fact.
Current
law
provides
that
such
violation
shall
be
27
found
within
three
years
after
the
commission
of
the
offense
of
28
accessory
after
the
fact.
29
A
person
who
commits
the
offense
of
accessory
after
the
fact
30
involving
kidnapping
in
the
first
degree,
second
degree,
or
31
third
degree
commits
an
aggravated
misdemeanor.
32
An
aggravated
misdemeanor
is
punishable
by
confinement
for
33
no
more
than
two
years
and
a
fine
of
at
least
$625
but
not
more
34
than
$6,250.
