H.F. 2026 Section 1. Section 692A.128, subsection 1, Code 2016, is 1 amended to read as follows: 2 1. A sex offender who is on probation, parole, work release, 3 special sentence, or any other type of conditional release may 4 file an application in district court seeking to modify the 5 registration requirements under this chapter . 6 Sec. 2. Section 692A.128, subsection 2, unnumbered 7 paragraph 1, Code 2016, is amended to read as follows: 8 An application shall not be granted unless all of the 9 following apply applicable conditions have been met : 10 Sec. 3. Section 692A.128, subsection 2, paragraph e, Code 11 2016, is amended to read as follows: 12 e. The If the sex offender is on probation, parole, work 13 release, special sentence, or any other type of conditional 14 release, the director of the judicial district department 15 of correctional services supervising the sex offender, or 16 the director’s designee, stipulates to the modification, 17 and a certified copy of the stipulation is attached to the 18 application. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill relates to the modification of the sex offender 23 registry requirements. 24 The bill specifies that any sex offender may file an 25 application to modify the registration requirements and strikes 26 a provision specifying that only a sex offender on probation, 27 parole, work release, special sentence, or any other type of 28 conditional release may file such an application. 29 The bill continues to require that the director of the 30 judicial district department of correctional services or the 31 director’s designee must stipulate to such a modification if 32 the sex offender is on probation, parole, work release, special 33 sentence, or any other type of conditional release. 34 -1- LSB 5169HH (2) 86 jm/rj 1/ 1
