H.F. 181 Section 1. Section 709.21, subsection 3, Code 2015, is 1 amended to read as follows: 2 3. A person who violates this section commits a serious an 3 aggravated misdemeanor. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 This bill increases the penalty for the crime of invasion of 8 privacy. 9 Under Code section 709.21, a person commits invasion of 10 privacy if the person knowingly views, photographs, or films 11 another person for the purpose of arousing or gratifying the 12 sexual desire of any person, and the other person does not have 13 knowledge about and does not consent or is unable to consent to 14 being viewed, photographed, or filmed, is in a state of full 15 or partial nudity, and has a reasonable expectation of privacy 16 while in a state of full or partial nudity. 17 Under current law, a person who commits invasion of privacy 18 commits a serious misdemeanor. Under Code section 903.1, a 19 person who commits a serious misdemeanor shall be fined between 20 $315 and $1,625 and may be imprisoned for a period to exceed 21 one year. 22 The bill amends current law to provide that a person who 23 commits invasion of privacy commits an aggravated misdemeanor. 24 Under Code section 903.1, a person who commits an aggravated 25 misdemeanor shall be fined between $625 and $6,250 and shall be 26 imprisoned for a period not to exceed two years. 27 -1- LSB 2007YH (2) 86 jh/nh 1/ 1
