H.F. 155 Section 1. Section 321.297, Code 2015, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 2A. a. A person operating a motor vehicle 3 in the far left lane of a divided, multilaned highway shall not 4 operate the vehicle at a speed of ten miles per hour or more 5 under the posted speed limit if the person knows or reasonably 6 should know that the operator of another motor vehicle in the 7 far left lane traveling in the same direction as the person is 8 attempting to overtake the person from the rear at a higher 9 rate of speed. 10 b. This subsection shall not apply if the person is 11 attempting to overtake the operator of another motor vehicle 12 traveling in the same direction as the person or if the person 13 is preparing to make a left turn. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill prohibits a person operating a motor vehicle 18 in the far left lane of a divided, multilaned highway from 19 driving at a speed of 10 miles per hour or more under the 20 posted speed limit if the person knows or reasonably should 21 know that another driver in the far left lane traveling in the 22 same direction as the person is attempting to overtake the 23 person from the rear at a higher rate of speed. The bill does 24 not apply to a person attempting to overtake another driver 25 traveling in the same direction as the person or to a person 26 preparing to make a left turn. 27 Current law provides a scheduled fine for a violation of this 28 section of $100. 29 -1- LSB 1781YH (3) 86 ns/nh 1/ 1
