H.F. 133 Section 1. NEW SECTION . 249A.38A Financial institutions —— 1 request for records —— penalty. 2 1. Upon written request signed by an authorized employee or 3 agent of the department, a financial institution shall provide, 4 without charge, the deposit and withdrawal records from the 5 preceding five years for an applicant for or recipient of 6 medical assistance to any authorized employee or agent of the 7 department or to the applicant or recipient. 8 2. The department shall develop and make available an easily 9 downloadable request form bearing an electronic signature of an 10 authorized employee or agent of the department to be used by an 11 applicant or recipient in requesting the records specified in 12 this section. 13 3. A financial institution that unreasonably refuses to 14 provide the records specified in this section within the time 15 limit provided in the request or that willfully provides false 16 information in the response to the request shall be assessed a 17 civil penalty of not more than fifty dollars. 18 4. For the purposes of this section, “financial institution” 19 means financial institution as defined in section 252I.1. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill requires that upon written request signed by 24 an authorized employee or agent of the department of human 25 services (DHS), a financial institution shall provide, without 26 charge, the deposit and withdrawal records from the preceding 27 five years for an applicant for or recipient of Medicaid to 28 any authorized employee or agent of DHS or to the applicant 29 or recipient. The bill directs DHS to develop and make 30 available an easily downloadable request form bearing an 31 electronic signature of an authorized employee or agent of 32 DHS to be used by an applicant or recipient in requesting the 33 records specified in the bill.
