S.F. _____ Section 1. NEW SECTION . 13C.4 Authorized solicitations —— 1 roadways. 2 1. A charitable organization shall be permitted to solicit 3 contributions on any place within a public road or street, as 4 defined by section 306.3, subject to the requirements of this 5 section. 6 2. To permit the solicitation of contributions on a public 7 road, a charitable organization shall file an application with 8 the applicable local authority no later than ten days prior to 9 the date the solicitation will first occur which application 10 shall provide as follows: 11 a. The date or dates and times of day when the solicitation 12 is to occur. 13 b. The location or locations on a public road where the 14 solicitation is to occur. 15 c. The manner and conditions under which the solicitation 16 is to occur. 17 d. Proof of a valid liability insurance policy of at least 18 one million dollars insuring the charitable organization 19 against bodily injury and property damage arising out of or in 20 connection with the solicitation. 21 e. Acknowledgment that only peace officers, fire fighters, 22 volunteer emergency medical services providers, and any other 23 persons employed, or who volunteer, to protect the public 24 safety shall conduct the solicitation. 25 3. The applicable local authority shall review an 26 application submitted pursuant to this section in an 27 expeditious manner and shall allow the solicitation if the 28 requirements of subsection 2 are met. 29 4. For purposes of this section, the “applicable local 30 authority” means the city council for a road located within 31 the corporate limits of the city and the county board of 32 supervisors for a road located outside the corporate limits of 33 a city. 34 EXPLANATION 35 -1- LSB 6142XC (2) 85 ec/sc 1/ 2
S.F. _____ The inclusion of this explanation does not constitute agreement with 1 the explanation’s substance by the members of the general assembly. 2 This bill allows a charitable organization to solicit 3 contributions on any place within a public road under certain 4 circumstances. 5 New Code section 13C.4 provides that a charitable 6 organization may submit an application to the local authorities 7 and be permitted to solicit on a road if certain conditions are 8 met. The application is required to be submitted at least 10 9 days prior to the solicitation and shall include the date or 10 dates of the solicitation as well as times of day, the location 11 or locations of the solicitation, proof of a valid liability 12 insurance policy of at least $1 million, and an acknowledgment 13 that only fire fighters, police officers, volunteer emergency 14 medical services providers, and any other persons employed to 15 protect the public safety shall conduct the solicitation. The 16 bill provides that the applicable local authority shall allow 17 the solicitation if the requirements of the new Code section 18 are met and is defined as the city council for a road located 19 within a city and the county board of supervisors for a road 20 located outside the corporate limits of a city. 21 -2- LSB 6142XC (2) 85 ec/sc 2/ 2
