FTEs 28.00 23 1. Funds appropriated in this section may be used to 24 supplement federal funds under federal regulations. To 25 receive funds appropriated in this section, a local area 26 agency on aging shall match the funds with moneys from other 27 sources according to rules adopted by the department. Funds 28 appropriated in this section may be used for elderly services 29 not specifically enumerated in this section only if approved 30 by an area agency on aging for provision of the service within 31 the area. 32 2. Of the funds appropriated in this section, $139,973 33 $279,946 is transferred to the economic development authority 34 for the Iowa commission on volunteer services to be used for 35 -1- LSB 5015XG (16) 85 pf/jp 1/ 83

The department on aging shall establish and enforce 2 procedures relating to expenditure of state and federal funds 3 by area agencies on aging that require compliance with both 4 state and federal laws, rules, and regulations, including but 5 not limited to all of the following: 6 (1) Requiring that expenditures are incurred only for goods 7 or services received or performed prior to the end of the 8 fiscal period designated for use of the funds. 9 (2) Prohibiting prepayment for goods or services not 10 received or performed prior to the end of the fiscal period 11 designated for use of the funds. 12 (3) Prohibiting the prepayment for goods or services 13 not defined specifically by good or service, time period, or 14 recipient. 15 (4) Prohibiting the establishment of accounts from which 16 future goods or services which are not defined specifically by 17 good or service, time period, or recipient, may be purchased. 18 b. The procedures shall provide that if any funds are 19 expended in a manner that is not in compliance with the 20 procedures and applicable federal and state laws, rules, and 21 regulations, and are subsequently subject to repayment, the 22 area agency on aging expending such funds in contravention of 23 such procedures, laws, rules and regulations, not the state, 24 shall be liable for such repayment. 25 4. Of the funds appropriated in this section, $125,000 26 $250,000 shall be used to fund services to meet the unmet needs 27 of older individuals as identified in the annual compilation 28 of unmet service units by the area agencies on aging through 29 Iowa’s aging and disability resource center network . 30 5. Of the funds appropriated in this section, $300,000 31 $600,000 shall be used to fund home and community-based 32 services through the area agencies on aging that enable older 33 individuals to avoid more costly utilization of residential or 34 institutional services and remain in their own homes. 35 -2- LSB 5015XG (16) 85 pf/jp 2/ 83

Of the funds appropriated in this subsection, $10,000 1 $20,000 shall be used for implementation of a guardianship and 2 conservatorship monitoring and assistance pilot project as 3 specified in this Act. 4 DIVISION II 5 OFFICE OF LONG-TERM CARE RESIDENT’S ADVOCATE 6 Sec. 2. 2013 Iowa Acts, chapter 138, section 132, is amended 7 to read as follows: 8 SEC. 132. (1) Of the funds appropriated in this subsection, 9 $2,574,181 $5,073,361 shall be used for the tobacco use 10 prevention and control initiative, including efforts at the 11 state and local levels, as provided in chapter 142A . The 12 commission on tobacco use prevention and control established 13 pursuant to section 142A.3 shall advise the director of 14 public health in prioritizing funding needs and the allocation 15 of moneys appropriated for the programs and activities of 16 the initiative under this subparagraph (1) and shall make 17 recommendations to the director in the development of budget 18 requests relating to the initiative. 19 (2) Of the funds allocated in this paragraph “a”, $37,500 20 shall be used to develop a social media structure to engage 21 youth and prevent youth initiation of tobacco use. Of the 22 amount allocated in this subparagraph (2), $12,500 $25,000 23 shall be used for a youth summit. 24 (3) Of the funds allocated in this paragraph “a”, $100,000 25 $200,000 shall be used to increase the efficacy of local 26 tobacco control efforts by community partnerships, including 27 through professional development, regional trainings and round 28 table planning efforts, and a training opportunity involving 29 all community partnerships. 30 (4) Of the funds allocated in this paragraph “a”, $600,000 31 $1,950,000 shall be used to promote smoking cessation and to 32 reduce the number of tobacco users in the state by offering 33 nicotine replacement therapy to uninsured and underinsured 34 Iowans. 35 -4- LSB 5015XG (16) 85 pf/jp 4/ 83
S.F. _____ H.F. _____ (5) (a) Of the funds allocated in this paragraph “a”, 1 $226,534 $453,067 is transferred to the alcoholic beverages 2 division of the department of commerce for enforcement of 3 tobacco laws, regulations, and ordinances and to engage in 4 tobacco control activities approved by the division of tobacco 5 use prevention and control as specified in the memorandum of 6 understanding entered into between the divisions. 7 (b) For the fiscal year beginning July 1, 2014, and ending 8 June 30, 2015, the terms of the memorandum of understanding, 9 entered into between the division of tobacco use prevention 10 and control of the department of public health and the 11 alcoholic beverages division of the department of commerce, 12 governing compliance checks conducted to ensure licensed retail 13 tobacco outlet conformity with tobacco laws, regulations, and 14 ordinances relating to persons under eighteen years of age, 15 shall restrict the number of such checks to one check per 16 retail outlet, and one additional check for any retail outlet 17 found to be in violation during the first check. 18 b. Of the funds appropriated in this subsection, 19 $11,007,665 $22,015,329 shall be used for problem gambling and 20 substance-related disorder prevention, treatment, and recovery 21 services, including a 24-hour helpline, public information 22 resources, professional training, and program evaluation. 23 (1) Of the funds allocated in this paragraph “b”, $9,451,858 24 $18,903,715 shall be used for substance-related disorder 25 prevention and treatment. 26 (a) Of the funds allocated in this subparagraph (1), 27 $449,650 $899,300 shall be used for the public purpose of a 28 grant program to provide substance-related disorder prevention 29 programming for children. 30 (i) Of the funds allocated in this subparagraph division 31 (a), $213,770 $427,539 shall be used for grant funding for 32 organizations that provide programming for children by 33 utilizing mentors. Programs approved for such grants shall be 34 certified or will be certified within six months of receiving 35 -5- LSB 5015XG (16) 85 pf/jp 5/ 83
S.F. _____ H.F. _____ the grant award by the Iowa commission on volunteer services as 1 utilizing the standards for effective practice for mentoring 2 programs. 3 (ii) Of the funds allocated in this subparagraph division 4 (a), $213,420 $426,839 shall be used for grant funding for 5 organizations that provide programming that includes youth 6 development and leadership. The programs shall also be 7 recognized as being programs that are scientifically based with 8 evidence of their effectiveness in reducing substance-related 9 disorders in children. 10 (iii) The department of public health shall utilize a 11 request for proposals process to implement the grant program. 12 (iv) All grant recipients shall participate in a program 13 evaluation as a requirement for receiving grant funds. 14 (v) Of the funds allocated in this subparagraph division 15 (a), up to $22,461 $44,922 may be used to administer 16 substance-related disorder prevention grants and for program 17 evaluations. 18 (b) Of the funds allocated in this subparagraph (1), 19 $136,302 $272,603 shall be used for culturally competent 20 substance-related disorder treatment pilot projects. 21 (i) The department shall utilize the amount allocated 22 in this subparagraph division (b) for at least three pilot 23 projects to provide culturally competent substance-related 24 disorder treatment in various areas of the state. Each pilot 25 project shall target a particular ethnic minority population. 26 The populations targeted shall include but are not limited to 27 African American, Asian, and Latino. 28 (ii) The pilot project requirements shall provide for 29 documentation or other means to ensure access to the cultural 30 competence approach used by a pilot project so that such 31 approach can be replicated and improved upon in successor 32 programs. 33 (2) Of the funds allocated in this paragraph “b”, up 34 to $1,555,807 $3,111,614 may be used for problem gambling 35 -6- LSB 5015XG (16) 85 pf/jp 6/ 83
S.F. _____ H.F. _____ prevention, treatment, and recovery services. 1 (a) Of the funds allocated in this subparagraph (2), 2 $1,286,881 $2,573,762 shall be used for problem gambling 3 prevention and treatment. 4 (b) Of the funds allocated in this subparagraph (2), up to 5 $218,926 $437,852 may be used for a 24-hour helpline, public 6 information resources, professional training, and program 7 evaluation. 8 (c) Of the funds allocated in this subparagraph (2), up 9 to $50,000 $100,000 may be used for the licensing of problem 10 gambling treatment programs. 11 (3) It is the intent of the general assembly that from the 12 moneys allocated in this paragraph “b”, persons with a dual 13 diagnosis of substance-related disorder and gambling addiction 14 shall be given priority in treatment services. 15 c. Notwithstanding any provision of law to the contrary, 16 to standardize the availability, delivery, cost of delivery, 17 and accountability of problem gambling and substance-related 18 disorder treatment services statewide, the department shall 19 continue implementation of a process to create a system 20 for delivery of treatment services in accordance with the 21 requirements specified in 2008 Iowa Acts, chapter 1187, section 22 3, subsection 4. To ensure the system provides a continuum 23 of treatment services that best meets the needs of Iowans, 24 the problem gambling and substance-related disorder treatment 25 services in any area may be provided either by a single agency 26 or by separate agencies submitting a joint proposal. 27 (1) The system for delivery of substance-related disorder 28 and problem gambling treatment shall include problem gambling 29 prevention. 30 (2) The system for delivery of substance-related disorder 31 and problem gambling treatment shall include substance-related 32 disorder prevention by July 1, 2015. 33 (3) Of the funds allocated in paragraph “b”, the department 34 may use up to $50,000 $100,000 for administrative costs to 35 -7- LSB 5015XG (16) 85 pf/jp 7/ 83
S.F. _____ H.F. _____ continue developing and implementing the process in accordance 1 with this paragraph “c”. 2 d. The requirement of section 123.53, subsection 5 , is met 3 by the appropriations and allocations made in this Act for 4 purposes of substance-related disorder treatment and addictive 5 disorders for the fiscal year beginning July 1, 2014. 6 e. The department of public health shall work with all 7 other departments that fund substance-related disorder 8 prevention and treatment services and all such departments 9 shall, to the extent necessary, collectively meet the state 10 maintenance of effort requirements for expenditures for 11 substance-related disorder services as required under the 12 federal substance-related disorder prevention and treatment 13 block grant. 14 2. HEALTHY CHILDREN AND FAMILIES 15 For promoting the optimum health status for children, 16 adolescents from birth through 21 years of age, and families , 17 and for not more than the following full-time equivalent 18 positions : 19 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,826,780 20 3,628,559 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Of the funds appropriated in this subsection, not 23 more than $367,421 $734,841 shall be used for the healthy 24 opportunities for parents to experience success (HOPES)-healthy 25 families Iowa (HFI) program established pursuant to section 26 135.106 . The funding shall be distributed to renew the grants 27 that were provided to the grantees that operated the program 28 during the fiscal year ending June 30, 2014. 29 b. In order to implement the legislative intent stated in 30 sections 135.106 and 256I.9 , that priority for home visitation 31 program funding be given to programs using evidence-based or 32 promising models for home visitation, it is the intent of the 33 general assembly to phase in the funding priority in accordance 34 with 2012 Iowa Acts, chapter 1133, section 2, subsection 2, 35 -8- LSB 5015XG (16) 85 pf/jp 8/ 83
S.F. _____ H.F. _____ paragraph 0b. 1 c. Of the funds appropriated in this subsection, $663,944 2 $1,327,887 shall be used to continue the department’s 3 initiative to provide for adequate developmental surveillance 4 and screening during a child’s first five years statewide. The 5 funds shall be used first to fully fund the current sites to 6 ensure that the sites are fully operational, with the remaining 7 funds to be used for expansion to additional sites. The full 8 implementation and expansion shall include enhancing the scope 9 of the program through collaboration with the child health 10 specialty clinics to promote healthy child development through 11 early identification and response to both biomedical and social 12 determinants of healthy development; by developing child 13 health metrics to inform practice, document long-term health 14 impacts and savings, and provide for continuous improvement 15 through training, education, and evaluation; and by providing 16 for practitioner consultation particularly for children with 17 behavioral conditions and needs. The department of public 18 health shall also collaborate with the Iowa Medicaid enterprise 19 and the child health specialty clinics to integrate the 20 activities of the first five initiative into the establishment 21 of patient-centered medical homes, community utilities, 22 accountable care organizations, and other integrated care 23 models developed to improve health quality and population 24 health while reducing health care costs. To the maximum extent 25 possible, funding allocated in this paragraph shall be utilized 26 as matching funds for medical assistance program reimbursement. 27 d. Of the funds appropriated in this subsection, $15,799 28 $31,597 shall be distributed to a statewide dental carrier to 29 provide funds to continue the donated dental services program 30 patterned after the projects developed by the lifeline network 31 to provide dental services to indigent elderly and disabled 32 individuals. 33 e. Of the funds appropriated in this subsection, $55,998 34 $111,995 shall be used for childhood obesity prevention. 35 -9- LSB 5015XG (16) 85 pf/jp 9/ 83
S.F. _____ H.F. _____ f. Of the funds appropriated in this subsection, $81,384 1 $137,768 shall be used to provide audiological services and 2 hearing aids for children. The department may enter into a 3 contract to administer this paragraph. 4 g. Of the funds appropriated in this subsection, $12,500 5 $25,000 is transferred to the university of Iowa college of 6 dentistry for provision of primary dental services to children. 7 State funds shall be matched on a dollar-for-dollar basis. 8 The university of Iowa college of dentistry shall coordinate 9 efforts with the department of public health, bureau of 10 oral and health delivery systems, to provide dental care to 11 underserved populations throughout the state. 12 h. Of the funds appropriated in this subsection, $25,000 13 $50,000 shall be used to address youth suicide prevention. 14 3. Of the funds appropriated in this subsection, $79,966 22 $159,932 shall be used for grants to individual patients 23 who have phenylketonuria (PKU) to assist with the costs of 24 necessary special foods. 25 b. Of the funds appropriated in this subsection, $445,822 26 $891,644 shall be used for the brain injury services program 27 pursuant to section 135.22B , including for continuation of the 28 contracts for resource facilitator services in accordance with 29 section 135.22B, subsection 9 , and to enhance brain injury 30 training and recruitment of service providers on a statewide 31 basis. Of the amount allocated in this paragraph, $47,500 32 shall be used to fund one full-time equivalent position to 33 serve as the state brain injury service program manager. 34 c. Of the funds appropriated in this subsection, $273,991 35 -10- LSB 5015XG (16) 85 pf/jp 10/ 83
S.F. _____ H.F. _____ $547,982 shall be used as additional funding to leverage 1 federal funding through the federal Ryan White Care Act, Tit. 2 II, AIDS drug assistance program supplemental drug treatment 3 grants. 4 d. Of the funds appropriated in this subsection, $49,912 5 $99,823 shall be used for the public purpose of continuing to 6 contract with an existing national-affiliated organization 7 to provide education, client-centered programs, and client 8 and family support for people living with epilepsy and their 9 families. 10 e. Of the funds appropriated in this subsection, $392,557 11 $785,114 shall be used for child health specialty clinics. 12 f. Of the funds appropriated in this subsection, 13 $200,000 $400,000 shall be used by the regional autism 14 assistance program established pursuant to section 256.35 , 15 and administered by the child health specialty clinic located 16 at the university of Iowa hospitals and clinics. The funds 17 shall be used to enhance interagency collaboration and 18 coordination of educational, medical, and other human services 19 for persons with autism, their families, and providers of 20 services, including delivering regionalized services of care 21 coordination, family navigation, and integration of services 22 through the statewide system of regional child health specialty 23 clinics and fulfilling other requirements as specified in 24 chapter 225D , creating the autism support program, as enacted 25 in this Act. The university of Iowa shall not receive funds 26 allocated under this paragraph for indirect costs associated 27 with the regional autism assistance program. 28 g. Of the funds appropriated in this subsection, $285,497 29 $444,543 shall be used for the comprehensive cancer control 30 program to reduce the burden of cancer in Iowa through 31 prevention, early detection, effective treatment, and ensuring 32 quality of life. Of the funds allocated in this lettered 33 paragraph, $75,000 $150,000 shall be used to support a melanoma 34 research symposium, a melanoma biorepository and registry, 35 -11- LSB 5015XG (16) 85 pf/jp 11/ 83
S.F. _____ H.F. _____ basic and translational melanoma research, and clinical trials. 1 h. Of the funds appropriated in this subsection, $63,225 2 $126,450 shall be used for cervical and colon cancer screening, 3 and $250,000 $500,000 shall be used to enhance the capacity of 4 the breast and cervical cancer screening program to include 5 provision of recommended prevention and early detection 6 measures to a broader range of low-income women. 7 i. Of the funds appropriated in this subsection, $263,348 8 $526,695 shall be used for the center for congenital and 9 inherited disorders. 10 j. Of the funds appropriated in this subsection, $64,706 11 $129,411 shall be used for the prescription drug donation 12 repository program created in chapter 135M . 13 k. Of the funds appropriated in this subsection, $107,632 14 $175,263 shall be used for the costs of the medical home system 15 advisory council established pursuant to section 135.159 16 including incorporation of the development and implementation 17 of the prevention and chronic care management state initiative. 18 4. Of the funds appropriated in this subsection, $49,707 26 $99,414 is allocated for continuation of the child vision 27 screening program implemented through the university of Iowa 28 hospitals and clinics in collaboration with early childhood 29 Iowa areas. The program shall submit a report to the 30 individuals identified in this Act for submission of reports 31 regarding the use of funds allocated under this paragraph 32 “a”. The report shall include the objectives and results for 33 the program year including the target population and how the 34 funds allocated assisted the program in meeting the objectives; 35 -12- LSB 5015XG (16) 85 pf/jp 12/ 83
S.F. _____ H.F. _____ the number, age, and location within the state of individuals 1 served; the type of services provided to the individuals 2 served; the distribution of funds based on service provided; 3 and the continuing needs of the program. 4 b. Of the funds appropriated in this subsection, $55,328 5 $110,656 is allocated for continuation of an initiative 6 implemented at the university of Iowa and $49,952 $99,904 7 is allocated for continuation of an initiative at the state 8 mental health institute at Cherokee to expand and improve the 9 workforce engaged in mental health treatment and services. 10 The initiatives shall receive input from the university of 11 Iowa, the department of human services, the department of 12 public health, and the mental health and disability services 13 commission to address the focus of the initiatives. 14 c. Of the funds appropriated in this subsection, $582,314 15 $1,164,628 shall be used for essential public health services 16 that promote healthy aging throughout the lifespan, contracted 17 through a formula for local boards of health, to enhance health 18 promotion and disease prevention services. 19 d. Of the funds appropriated in this section, $49,643 20 $99,286 shall be deposited in the governmental public health 21 system fund created in section 135A.8 to be used for the 22 purposes of the fund. 23 e. Of the funds appropriated in this subsection, $52,724 24 $105,448 shall be used to continue to address the shortage of 25 mental health professionals in the state. 26 f. Of the funds appropriated in this subsection, $25,000 27 $50,000 shall be used for a grant to a statewide association 28 of psychologists that is affiliated with the American 29 psychological association to be used for continuation of a 30 program to rotate intern psychologists in placements in urban 31 and rural mental health professional shortage areas, as defined 32 in section 135.180 . 33 g. Of the funds appropriated in this subsection, the 34 following amounts shall be allocated to the Iowa collaborative 35 -13- LSB 5015XG (16) 85 pf/jp 13/ 83

Of the funds appropriated in this subsection, the 15 department may use up to $29,088 $58,175 for up to one 16 full-time equivalent position to administer the volunteer 17 health care provider program pursuant to section 135.24 . 18 k. Of the funds appropriated in this subsection, $24,854 19 $49,707 shall be used for a matching dental education loan 20 repayment program to be allocated to a dental nonprofit health 21 service corporation to develop the criteria and implement the 22 loan repayment program. 23 l. Of the funds appropriated in this subsection, $52,912 24 $105,823 is transferred to the college student aid commission 25 for deposit in the rural Iowa primary care trust fund created 26 in section 261.113 to be used for the purposes of the fund. 27 m. Of the funds appropriated in this subsection, $75,000 28 $150,000 shall be used for the purposes of the Iowa donor 29 registry as specified in section 142C.18 . 30 n. The organization 2 shall submit a report to the individuals identified in this 3 Act for submission of reports regarding the use of funds 4 allocated under this paragraph “n”. The report shall include 5 the objectives and results for the program year including 6 the target population and how the funds allocated assisted 7 the program in meeting the objectives; the number, age, and 8 location within the state of individuals served; the type of 9 services provided to the individuals served; the distribution 10 of funds based on services provided; and the continuing needs 11 of the program. 12 o. Of the funds appropriated in this subsection, $12,500 13 $25,000 shall be used for the establishment continuation of a 14 wellness council under the direction of the director of public 15 health to increase support for wellness activities in the 16 state. 17 p. Of the funds appropriated in this section, $579,075 18 $1,158,150 is allocated to the Iowa collaborative safety net 19 provider network established pursuant to section 135.153 to 20 be used for the continued development and implementation of a 21 statewide regionally based network to provide an integrated 22 approach to health care delivery through care coordination 23 that supports primary care providers and links patients with 24 community resources necessary to empower patients in addressing 25 biomedical and social determinants of health to improve health 26 outcomes. The Iowa collaborative safety net provider network 27 shall work in conjunction with the department of human services 28 to align the integrated network with the health care delivery 29 system model developed under the state innovation models 30 initiative grant. The Iowa collaborative safety net provider 31 network shall submit a progress report to the individuals 32 designated in this Act for submission of reports by December 33 31, 2014, including progress in developing and implementing the 34 network, how the funds were distributed and used in developing 35 -17- LSB 5015XG (16) 85 pf/jp 17/ 83

Moneys credited to the family investment program (FIP) 2 account for the fiscal year beginning July 1, 2014, and 3 ending June 30, 2015, shall be used to provide assistance in 4 accordance with chapter 239B . 5 2. The department may use a portion of the moneys credited 6 to the FIP account under this section as necessary for 7 salaries, support, maintenance, and miscellaneous purposes. 8 3. Of the child support collections assigned under FIP, 9 an amount equal to the federal share of support collections 10 shall be credited to the child support recovery appropriation 11 made in this division of this Act. Of the remainder of the 12 assigned child support collections received by the child 13 support recovery unit, a portion shall be credited to the FIP 14 account, a portion may be used to increase recoveries, and a 15 portion may be used to sustain cash flow in the child support 16 payments account. If as a consequence of the appropriations 17 and allocations made in this section the resulting amounts 18 are insufficient to sustain cash assistance payments and meet 19 federal maintenance of effort requirements, the department 20 shall seek supplemental funding. If child support collections 21 assigned under FIP are greater than estimated or are otherwise 22 determined not to be required for maintenance of effort, the 23 state share of either amount may be transferred to or retained 24 in the child support payment account. 25 6. The department may adopt emergency rules for the family 26 investment, JOBS, food assistance, and medical assistance 27 programs if necessary to comply with federal requirements. 28 Sec. 9. 2013 Iowa Acts, chapter 138, section 138, is amended 29 to read as follows: 30 SEC. 138. Notwithstanding section 8.39 , for the fiscal year 12 beginning July 1, 2014, if necessary to meet federal 13 maintenance of effort requirements or to transfer federal 14 temporary assistance for needy families block grant funding 15 to be used for purposes of the federal social services block 16 grant or to meet cash flow needs resulting from delays in 17 receiving federal funding or to implement, in accordance with 18 this division of this Act, activities currently funded with 19 juvenile court services, county, or community moneys and state 20 moneys used in combination with such moneys, the department 21 of human services may transfer funds within or between any 22 of the appropriations made in this division of this Act and 23 appropriations in law for the federal social services block 24 grant to the department for the following purposes, provided 25 that the combined amount of state and federal temporary 26 assistance for needy families block grant funding for each 27 appropriation remains the same before and after the transfer: 28 a. For the family investment program. 29 b. For child care assistance. 30 c. For child and family services. 31 d. For field operations. 32 e. For general administration. 33 f. For distribution to counties or regions through the 34 mental health and disability regional services fund created in 35 -30- LSB 5015XG (16) 85 pf/jp 30/ 83
S.F. _____ H.F. _____ section 225C.7A for services to for persons with mental illness 1 or an intellectual disability in accordance with that section . 2 This subsection shall not be construed to prohibit the use 3 of existing state transfer authority for other purposes. The 4 department shall report any transfers made pursuant to this 5 subsection to the legislative services agency. 6 4. Of the funds appropriated in this section, $97,839 7 $195,678 shall be used for continuation of a grant to an 8 Iowa-based nonprofit organization with a history of providing 9 tax preparation assistance to low-income Iowans in order to 10 expand the usage of the earned income tax credit. The purpose 11 of the grant is to supply this assistance to underserved areas 12 of the state. 13 5. Of the funds appropriated in this section, $20,000 14 $40,000 shall be used for the continuation of an unfunded 15 pilot project, as defined in 441 IAC 100.1, relating to 16 parental obligations, in which the child support recovery 17 unit participates, to support the efforts of a nonprofit 18 organization committed to strengthening the community through 19 youth development, healthy living, and social responsibility in 20 a county with a population over 350,000. The funds allocated 21 in this subsection shall be used by the recipient organization 22 to develop a larger community effort, through public and 23 private partnerships, to support a broad-based fatherhood 24 initiative that promotes payment of child support obligations, 25 improved family relationships, and full-time employment. 26 6. The department may transfer funds appropriated in this 27 section to the appropriations made in this division of this Act 28 for general administration and field operations as necessary 29 to administer this section and the overall family investment 30 program. 31 Sec. 10. 2013 Iowa Acts, chapter 138, section 139, is 32 amended to read as follows: 33 SEC. 139. The department shall expend up to $12,165 $24,329 , 10 including federal financial participation, for the fiscal year 11 beginning July 1, 2014, for a child support public awareness 12 campaign. The department and the office of the attorney 13 general shall cooperate in continuation of the campaign. The 14 public awareness campaign shall emphasize, through a variety 15 of media activities, the importance of maximum involvement of 16 both parents in the lives of their children as well as the 17 importance of payment of child support obligations. 18 2. Federal access and visitation grant moneys shall be 19 issued directly to private not-for-profit agencies that provide 20 services designed to increase compliance with the child access 21 provisions of court orders, including but not limited to 22 neutral visitation sites and mediation services. 23 3. The appropriation made to the department for child 24 support recovery may be used throughout the fiscal year in the 25 manner necessary for purposes of cash flow management, and for 26 cash flow management purposes the department may temporarily 27 draw more than the amount appropriated, provided the amount 28 appropriated is not exceeded at the close of the fiscal year. 29 4. With the exception of the funding amount specified, the 30 requirements established under 2001 Iowa Acts, chapter 191, 31 section 3, subsection 5, paragraph “c”, subparagraph (3), shall 32 be applicable to parental obligation pilot projects for the 33 fiscal year beginning July 1, 2014, and ending June 30, 2015. 34 Notwithstanding 441 IAC 100.8, providing for termination of 35 -32- LSB 5015XG (16) 85 pf/jp 32/ 83
S.F. _____ H.F. _____ rules relating to the pilot projects, the rules shall remain 1 in effect until June 30, 2015. 2 Sec. 11. 2013 Iowa Acts, chapter 138, section 140, is 3 amended to read as follows: 4 SEC. 140. HEALTH CARE TRUST FUND —— MEDICAL ASSISTANCE —— 5 FY 2013-2014 2014-2015 . Any funds remaining in the health 6 care trust fund created in section 453A.35A for the fiscal 7 year beginning July 1, 2014, and ending June 30, 2015, are 8 appropriated to the department of human services to supplement 9 the medical assistance program appropriations made in this 10 division of this Act, for medical assistance reimbursement and 11 associated costs, including program administration and costs 12 associated with program implementation. 13 Sec. 12. 2013 Iowa Acts, chapter 138, section 141, is 14 amended to read as follows: 15 SEC. 141. MEDICAID FRAUD FUND —— MEDICAL ASSISTANCE —— 16 FY 2014-2015. Any funds remaining in the Medicaid fraud 17 fund created in section 249A.7 for the fiscal year beginning 18 July 1, 2014, and ending June 30, 2015, are appropriated to 19 the department of human services to supplement the medical 20 assistance appropriations made in this division of this Act, 21 for medical assistance reimbursement and associated costs, 22 including program administration and costs associated with 23 program implementation. 24 Sec. 13. 2013 Iowa Acts, chapter 138, section 142, is 25 amended to read as follows: 26 SEC. 142. MEDICAL ASSISTANCE. There is appropriated from 27 the general fund of the state to the department of human 28 services for the fiscal year beginning July 1, 2014, and ending 29 June 30, 2015, the following amount, or so much thereof as is 30 necessary, to be used for the purpose designated: 31 For medical assistance program reimbursement and associated 32 costs as specifically provided in the reimbursement 33 methodologies in effect on June 30, 2014, except as otherwise 34 expressly authorized by law, consistent with options under 35 -33- LSB 5015XG (16) 85 pf/jp 33/ 83

Iowans support reducing the number of abortions 6 performed in our state. For an abortion covered under the 7 program, except in the case of a medical emergency, as defined 8 in section 135L.1 , for any woman, the physician shall certify 9 both of the following: 10 (1) That the woman has been given the opportunity to view an 11 ultrasound image of the fetus as part of the standard of care 12 before an abortion is performed. 13 (2) That the woman has been provided information regarding 14 the options relative to a pregnancy, including continuing the 15 pregnancy to term and retaining parental rights following the 16 child’s birth, continuing the pregnancy to term and placing the 17 child for adoption, and terminating the pregnancy. 18 b. Funds appropriated under this section shall not be used 19 for abortions, unless otherwise authorized under this section. 20 c. The provisions of this section relating to abortions 21 shall also apply to the Iowa health and wellness plan created 22 pursuant to chapter 249N , as enacted in this Act. 23 2. The department shall utilize not more than $60,000 of 24 the funds appropriated in this section to continue the AIDS/HIV 25 health insurance premium payment program as established in 1992 26 Iowa Acts, Second Extraordinary Session, chapter 1001, section 27 409, subsection 6. Of the funds allocated in this subsection, 28 not more than $5,000 may be expended for administrative 29 purposes. 30 3. Of the funds appropriated in this Act to the department 31 of public health for addictive disorders, $950,000 for 32 the fiscal year beginning July 1, 2014, is transferred 33 to the department of human services for an integrated 34 substance-related disorder managed care system. S.F. _____ H.F. _____ shall not assume management of the substance-related disorder 1 system in place of the managed care contractor unless such 2 a change in approach is specifically authorized in law. 3 The departments of human services and public health shall 4 work together to maintain the level of mental health and 5 substance-related disorder treatment services provided by the 6 managed care contractor through the Iowa plan for behavioral 7 health. Each department shall take the steps necessary to 8 continue the federal waivers as necessary to maintain the level 9 of services. 10 4. a. The department shall aggressively pursue options for 11 providing medical assistance or other assistance to individuals 12 with special needs who become ineligible to continue receiving 13 services under the early and periodic screening, diagnostic, 14 and treatment program under the medical assistance program 15 due to becoming 21 years of age who have been approved for 16 additional assistance through the department’s exception to 17 policy provisions, but who have health care needs in excess 18 of the funding available through the exception to policy 19 provisions. 20 b. Of the funds appropriated in this section, $100,000 21 shall be used for participation in one or more pilot projects 22 operated by a private provider to allow the individual or 23 individuals to receive service in the community in accordance 24 with principles established in Olmstead v. L.C., 527 U.S. 581 25 (1999), for the purpose of providing medical assistance or 26 other assistance to individuals with special needs who become 27 ineligible to continue receiving services under the early and 28 periodic screening, diagnostic, and treatment program under 29 the medical assistance program due to becoming 21 years of 30 age who have been approved for additional assistance through 31 the department’s exception to policy provisions, but who have 32 health care needs in excess of the funding available through 33 the exception to the policy provisions. 34 5. Of the funds appropriated in this section, up to 35 -35- LSB 5015XG (16) 85 pf/jp 35/ 83
S.F. _____ H.F. _____ $3,050,082 may be transferred to the field operations or 1 general administration appropriations in this division of this 2 Act for operational costs associated with Part D of the federal 3 Medicare Prescription Drug Improvement and Modernization Act 4 of 2003, Pub. L. No. 108-173. 5 6. Of the funds appropriated in this section, up to $442,100 6 may be transferred to the appropriation in this division 7 of this Act for medical contracts to be used for clinical 8 assessment services and prior authorization of services. 9 7. A portion of the funds appropriated in this section 10 may be transferred to the appropriations in this division of 11 this Act for general administration, medical contracts, the 12 children’s health insurance program, or field operations to be 13 used for the state match cost to comply with the payment error 14 rate measurement (PERM) program for both the medical assistance 15 and children’s health insurance programs as developed by the 16 centers for Medicare and Medicaid services of the United States 17 department of health and human services to comply with the 18 federal Improper Payments Information Act of 2002, Pub. L. No. 19 107-300. 20 8. It is the intent of the general assembly that the 21 department continue to implement the recommendations of 22 the assuring better child health and development initiative 23 II (ABCDII) clinical panel to the Iowa early and periodic 24 screening, diagnostic, and treatment services healthy mental 25 development collaborative board regarding changes to billing 26 procedures, codes, and eligible service providers. 27 9. Of the funds appropriated in this section, a sufficient 28 amount is allocated to supplement the incomes of residents of 29 nursing facilities, intermediate care facilities for persons 30 with mental illness, and intermediate care facilities for 31 persons with an intellectual disability, with incomes of less 32 than $50 in the amount necessary for the residents to receive a 33 personal needs allowance of $50 per month pursuant to section 34 249A.30A . 35 -36- LSB 5015XG (16) 85 pf/jp 36/ 83

Of the funds appropriated in this section, 8 $7,969,074 $8,391,922 is allocated for the state match for 9 a disproportionate share hospital payment of $19,133,430 10 to hospitals that meet both of the conditions specified 11 in subparagraphs (1) and (2). In addition, the hospitals 12 that meet the conditions specified shall either certify 13 public expenditures or transfer to the medical assistance 14 program an amount equal to provide the nonfederal share for a 15 disproportionate share hospital payment of $7,500,000. The 16 hospitals that meet the conditions specified shall receive and 17 retain 100 percent of the total disproportionate share hospital 18 payment of $26,633,430. 19 (1) The hospital qualifies for disproportionate share and 20 graduate medical education payments. 21 (2) The hospital is an Iowa state-owned hospital with more 22 than 500 beds and eight or more distinct residency specialty 23 or subspecialty programs recognized by the American college of 24 graduate medical education. 25 b. Distribution of the disproportionate share payments 26 shall be made on a monthly basis. The total amount of 27 disproportionate share payments including graduate medical 28 education, enhanced disproportionate share, and Iowa 29 state-owned teaching hospital payments shall not exceed the 30 amount of the state’s allotment under Pub. L. No. 102-234. 31 In addition, the total amount of all disproportionate 32 share payments shall not exceed the hospital-specific 33 disproportionate share limits under Pub. L. No. 103-66. 34 12. The university of Iowa hospitals and clinics shall 35 -37- LSB 5015XG (16) 85 pf/jp 37/ 83
S.F. _____ H.F. _____ either certify public expenditures or transfer to the 1 appropriations made in this division of this Act for medical 2 assistance an amount equal to provide the nonfederal share 3 for increased medical assistance payments for inpatient and 4 outpatient hospital services of $9,900,000. The university of 5 Iowa hospitals and clinics shall receive and retain 100 percent 6 of the total increase in medical assistance payments. 7 13. One hundred percent of the nonfederal share of payments 8 to area education agencies that are medical assistance 9 providers for medical assistance-covered services provided to 10 medical assistance-covered children, shall be made from the 11 appropriation made in this section. 12 14. Any new or renewed contract entered into by the 13 department with a third party to administer behavioral health 14 services under the medical assistance program shall provide 15 that any interest earned on payments from the state during 16 the state fiscal year shall be remitted to the department 17 and treated as recoveries to offset the costs of the medical 18 assistance program. 19 15. The department shall continue to implement the 20 provisions in 2007 Iowa Acts, chapter 218, section 124 and 21 section 126, as amended by 2008 Iowa Acts, chapter 1188, 22 section 55, relating to eligibility for certain persons with 23 disabilities under the medical assistance program in accordance 24 with the federal Family Opportunity Act. 25 16. A portion of the funds appropriated in this section 26 may be transferred to the appropriation in this division of 27 this Act for medical contracts to be used for administrative 28 activities associated with the money follows the person 29 demonstration project. 30 17. Of the funds appropriated in this section, $349,011 31 shall be used for the administration of the health insurance 32 premium payment program, including salaries, support, 33 maintenance, and miscellaneous purposes. 34 18. a. The department shall continue to implement the cost 35 -38- LSB 5015XG (16) 85 pf/jp 38/ 83
S.F. _____ H.F. _____ containment strategies for the medical assistance program in 1 the fiscal year beginning July 1, 2014, that were recommended 2 by the governor for the fiscal year beginning July 1, 2013, as 3 specified in this Act and may adopt emergency rules for such 4 implementation. 5 b. The department may increase the amounts allocated for 6 salaries, support, maintenance, and miscellaneous purposes 7 associated with the medical assistance program, as necessary, 8 to implement the cost containment strategies. The department 9 shall report any such increase to the legislative services 10 agency and the department of management. 11 c. If the savings to the medical assistance program exceed 12 the cost for the fiscal year beginning July 1, 2014, the 13 department may transfer any savings generated for the fiscal 14 year due to medical assistance program cost containment efforts 15 to the appropriation made in this division of this Act for 16 medical contracts or general administration to defray the 17 increased contract costs associated with implementing such 18 efforts. 19 19. a. Of the funds appropriated in this section, $900,000 20 shall be used to continue implementation of the children’s 21 mental health home project proposed by the department of human 22 services and reported to the general assembly’s mental health 23 and disability services study committee in December 2011. Of 24 this amount, up to $50,000 may be transferred by the department 25 to the appropriation made in this division of this Act to the 26 department for the same fiscal year for general administration 27 to be used for associated administrative expenses and for not 28 more than one full-time equivalent position, in addition to 29 those authorized for the same fiscal year, to be assigned to 30 implementing the project. 31 b. Of the funds appropriated in this section, up to $400,000 32 may be transferred by the department to the appropriation made 33 to the department in this division of this Act for the same 34 fiscal year for general administration to continue to support 35 -39- LSB 5015XG (16) 85 pf/jp 39/ 83
S.F. _____ H.F. _____ the redesign of mental health and disability services and 1 the state balancing incentive payments program planning and 2 implementation activities. The funds may be used for contracts 3 or for personnel in addition to the amounts appropriated for 4 and the positions authorized for general administration for the 5 same fiscal year. 6 c. Of the funds appropriated in this section, up to 7 $3,000,000 may be transferred by the department to the 8 appropriations made to the department in this division of 9 this Act for the same fiscal year for general administration 10 or medical contracts to be used to continue to support the 11 development and implementation of standardized assessment tools 12 for persons with mental illness, an intellectual disability, a 13 developmental disability, or a brain injury. 14 d. For the fiscal year beginning July 1, 2014, and ending 15 June 30, 2015, the replacement generation tax revenues required 16 to be deposited in the property tax relief fund pursuant to 17 section 437A.8, subsection 4, paragraph “d” , and section 18 437A.15, subsection 3, paragraph “f” , shall instead be credited 19 to and supplement the appropriation made in this section and 20 used for the allocations made in this subsection. 21 20. The department shall continue to administer the state 22 balancing incentive payments program as specified in 2012 Iowa 23 Acts, chapter 1133, section 14. 24 21. Of the funds appropriated in this section, $250,000 25 shall be used for lodging expenses associated with care 26 provided at the university of Iowa hospitals and clinics for 27 patients with cancer whose travel distance is 30 miles or more 28 and whose income is at or below 200 percent of the federal 29 poverty level as defined by the most recently revised poverty 30 income guidelines published by the United States department of 31 health and human services. The department of human services 32 shall establish the maximum number of overnight stays and the 33 maximum rate reimbursed for overnight lodging, which may be 34 based on the state employee rate established by the department 35 -40- LSB 5015XG (16) 85 pf/jp 40/ 83

The funds allocated in this 1 subsection shall not be used as nonfederal share matching 2 funds. 3 Sec. 14. 2013 Iowa Acts, chapter 138, is amended by adding 4 the following new section: 5 NEW SECTION . SEC. 142A. MENTAL HEALTH AND DISABILITY 6 SERVICES REDESIGN —— MEDICAL ASSISTANCE AND OTHER DEPARTMENTAL 7 EXPENDITURES —— FY 2014-2015. 8 1. Habilitation. 25 b. Targeted case management. 26 c. Home and community-based services waiver services for 27 persons with intellectual disabilities and brain injury. 28 d. Community-based intermediate care facilities for persons 29 with an intellectual disability. 30 e. The state resource centers. 31 3. Of the funds appropriated in this section, up to $50,000 32 may be transferred by the department to the appropriation 33 made in this division of this Act to the department for the 34 same fiscal year for general administration to be used for 35 -41- LSB 5015XG (16) 85 pf/jp 41/ 83
S.F. _____ H.F. _____ associated administrative expenses and for not more than one 1 full-time equivalent position, in addition to those authorized 2 for the same fiscal year, to be assigned to implementing the 3 children’s mental health home project. 4 4. Of the funds appropriated in this section, up to $400,000 5 may be transferred by the department to the appropriation made 6 to the department in this division of this Act for the same 7 fiscal year for general administration to support redesign and 8 the state balancing incentive payments program planning and 9 implementation activities. The funds may be used for contracts 10 or for personnel in addition to the amounts appropriated for 11 and the positions authorized for general administration for the 12 fiscal year. 13 5. Of the funds appropriated in this section, up to 14 $3,050,000 may be transferred by the department to the 15 appropriations made to the department in this division of 16 this Act for the same fiscal year for general administration 17 or medical contracts to be used to support the development 18 and implementation of standardized assessment tools for 19 persons with mental illness, an intellectual disability, a 20 developmental disability, or a brain injury. 21 6. For the fiscal year beginning July 1, 2014, and ending 22 June 30, 2015, the replacement generation tax revenues required 23 to be deposited in the property tax relief fund pursuant to 24 section 437A.8, subsection 4, paragraph “d”, and section 25 437A.15, subsection 3, paragraph “f”, shall instead be credited 26 to and supplement the appropriation made in this section. 27 Sec. 15. 2013 Iowa Acts, chapter 138, section 143, is 28 amended to read as follows: 29 SEC. 143. Of the amount appropriated in this section, up to 15 $100,000 $200,000 may be transferred to the appropriation 16 for general administration in this division of this Act to 17 be used for additional full-time equivalent positions in the 18 development of key health initiatives such as cost containment, 19 development and oversight of managed care programs, and 20 development of health strategies targeted toward improved 21 quality and reduced costs in the Medicaid program. 22 4. Of the funds appropriated in this section, $500,000 23 $1,000,000 shall be used for planning and development, 24 in cooperation with the department of public health, of a 25 phased-in program to provide a dental home for children. 26 5. Of the funds appropriated in this section, $37,500 shall 27 be used for continued implementation of a uniform cost report. 28 6. Of the funds appropriated in this section, $1,000,000 29 $2,000,000 shall be used for the autism support program created 30 in chapter 225D , as enacted in this Act. 31 7. XVI of the federal 21 Social Security Act, section 1618, as codified in 42 U.S.C. 22 § 1382g, the department may take actions including but not 23 limited to increasing the personal needs allowance for 24 residential care facility residents and making programmatic 25 adjustments or upward adjustments of the residential care 26 facility or in-home health-related care reimbursement rates 27 prescribed in this division of this Act to ensure that federal 28 requirements are met. In addition, the department may make 29 other programmatic and rate adjustments necessary to remain 30 within the amount appropriated in this section while ensuring 31 compliance with federal requirements. Of the funds appropriated in this section, $216,227 2 $432,453 is allocated for the statewide program for child care 3 resource and referral services under section 237A.26 . A list 4 of the registered and licensed child care facilities operating 5 in the area served by a child care resource and referral 6 service shall be made available to the families receiving state 7 child care assistance in that area. 8 4. Of the funds appropriated in this section, $468,487 9 $936,974 is allocated for child care quality improvement 10 initiatives including but not limited to the voluntary quality 11 rating system in accordance with section 237A.30 . 12 5. Of the funds appropriated in this section, $67,589 shall 13 be used to conduct fingerprint-based national criminal history 14 record checks of home-based child care providers pursuant 15 to section 237A.5, subsection 2 , through the United States 16 department of justice, federal bureau of investigation. 17 6. Of the amount appropriated in this section, up to 18 $12,500 shall be used to continue to implement a searchable 19 internet-based application as part of the consumer information 20 made available under section 237A.25 . The application shall 21 provide a listing of the child care providers in this state 22 that have received a rating under the voluntary quality rating 23 system implemented pursuant to section 237A.30 and information 24 on whether a provider specializes in child care for infants, 25 school-age children, children with special needs, or other 26 populations or provides any other specialized services to 27 support family needs. 28 7. Of the funds appropriated in this section, $3,175,000 29 $6,350,000 shall be credited to the early childhood programs 30 grants account in the early childhood Iowa fund created 31 in section 256I.11 . The moneys shall be distributed for 32 funding of community-based early childhood programs targeted 33 to children from birth through five years of age developed 34 by early childhood Iowa areas in accordance with approved 35 -46- LSB 5015XG (16) 85 pf/jp 46/ 83
S.F. _____ H.F. _____ community plans as provided in section 256I.8 . 1 8. The department may use any of the funds appropriated 2 in this section as a match to obtain federal funds for use in 3 expanding child care assistance and related programs. For 4 the purpose of expenditures of state and federal child care 5 funding, funds shall be considered obligated at the time 6 expenditures are projected or are allocated to the department’s 7 service areas. Projections shall be based on current and 8 projected caseload growth, current and projected provider 9 rates, staffing requirements for eligibility determination 10 and management of program requirements including data systems 11 management, staffing requirements for administration of the 12 program, contractual and grant obligations and any transfers 13 to other state agencies, and obligations for decategorization 14 or innovation projects. 15 9. A portion of the state match for the federal child care 16 and development block grant shall be provided as necessary to 17 meet federal matching funds requirements through the state 18 general fund appropriation made for child development grants 19 and other programs for at-risk children in section 279.51 . 20 10. If a uniform reduction ordered by the governor under 21 section 8.31 or other operation of law, transfer, or federal 22 funding reduction reduces the appropriation made in this 23 section for the fiscal year, the percentage reduction in the 24 amount paid out to or on behalf of the families participating 25 in the state child care assistance program shall be equal to or 26 less than the percentage reduction made for any other purpose 27 payable from the appropriation made in this section and the 28 federal funding relating to it. The percentage reduction to 29 the other allocations made in this section shall be the same as 30 the uniform reduction ordered by the governor or the percentage 31 change of the federal funding reduction, as applicable. 32 If there is an unanticipated increase in federal funding 33 provided for state child care assistance, the entire amount 34 of the increase shall be used for state child care assistance 35 -47- LSB 5015XG (16) 85 pf/jp 47/ 83

If the appropriations made for purposes of the 1 state child care assistance program for the fiscal year are 2 determined to be insufficient, it is the intent of the general 3 assembly to appropriate sufficient funding for the fiscal year 4 in order to avoid establishment of waiting list requirements. 5 11. Notwithstanding section 8.33 , moneys advanced for 6 purposes of the programs developed by early childhood Iowa 7 areas, advanced for purposes of wraparound child care, or 8 received from the federal appropriations made for the purposes 9 of this section that remain unencumbered or unobligated at the 10 close of the fiscal year shall not revert to any fund but shall 11 remain available for expenditure for the purposes designated 12 until the close of the succeeding fiscal year. 13 Sec. 19. 2013 Iowa Acts, chapter 138, section 147, is 14 amended to read as follows: 15 SEC. 147. The department may transfer funds appropriated in this 19 section as necessary to pay the nonfederal costs of services 20 reimbursed under the medical assistance program, state child 21 care assistance program, or the family investment program which 22 are provided to children who would otherwise receive services 23 paid under the appropriation in this section. The department 24 may transfer funds appropriated in this section to the 25 appropriations made in this division of this Act for general 26 administration and for field operations for resources necessary 27 to implement and operate the services funded in this section. 28 4. a. Of the funds appropriated in this section, up 29 to $16,121,163 $32,318,243 is allocated as the statewide 30 expenditure target under section 232.143 for group foster care 31 maintenance and services. If the department projects that such 32 expenditures for the fiscal year will be less than the target 33 amount allocated in this lettered paragraph, the department may 34 reallocate the excess to provide additional funding for shelter 35 -50- LSB 5015XG (16) 85 pf/jp 50/ 83
S.F. _____ H.F. _____ care or the child welfare emergency services addressed with the 1 allocation for shelter care. 2 b. If at any time after September 30, 2014, annualization 3 of a service area’s current expenditures indicates a service 4 area is at risk of exceeding its group foster care expenditure 5 target under section 232.143 by more than 5 percent, the 6 department and juvenile court services shall examine all 7 group foster care placements in that service area in order to 8 identify those which might be appropriate for termination. 9 In addition, any aftercare services believed to be needed 10 for the children whose placements may be terminated shall be 11 identified. The department and juvenile court services shall 12 initiate action to set dispositional review hearings for the 13 placements identified. In such a dispositional review hearing, 14 the juvenile court shall determine whether needed aftercare 15 services are available and whether termination of the placement 16 is in the best interest of the child and the community. 17 5. In accordance with the provisions of section 232.188 , 18 the department shall continue the child welfare and juvenile 19 justice funding initiative during fiscal year 2014-2015. Of 20 the funds appropriated in this section, $858,877 $1,717,753 21 is allocated specifically for expenditure for fiscal year 22 2014-2015 through the decategorization service funding pools 23 and governance boards established pursuant to section 232.188 . 24 6. A portion of the funds appropriated in this section 25 may be used for emergency family assistance to provide other 26 resources required for a family participating in a family 27 preservation or reunification project or successor project to 28 stay together or to be reunified. 29 7. Notwithstanding As authorized by section 234.35 or 30 any other provision of law to the contrary , as amended by 31 this 2014 Act, state funding for shelter care and the child 32 welfare emergency services contracting implemented to provide 33 for or prevent the need for shelter care shall be limited to 34 $3,808,024 $7,717,822 . 35 -51- LSB 5015XG (16) 85 pf/jp 51/ 83

Federal funds received by the state during the fiscal 1 year beginning July 1, 2014, as the result of the expenditure 2 of state funds appropriated during a previous state fiscal 3 year for a service or activity funded under this section are 4 appropriated to the department to be used as additional funding 5 for services and purposes provided for under this section. 6 Notwithstanding section 8.33 , moneys received in accordance 7 with this subsection that remain unencumbered or unobligated at 8 the close of the fiscal year shall not revert to any fund but 9 shall remain available for the purposes designated until the 10 close of the succeeding fiscal year. 11 9. a. Of the funds appropriated in this section, up to 12 $1,645,000 $3,290,000 is allocated for the payment of the 13 expenses of court-ordered services provided to juveniles who 14 are under the supervision of juvenile court services, which 15 expenses are a charge upon the state pursuant to section 16 232.141, subsection 4 . Of the amount allocated in this 17 lettered paragraph, up to $778,144 $1,556,287 shall be made 18 available to provide school-based supervision of children 19 adjudicated under chapter 232 , of which not more than $7,500 20 $15,000 may be used for the purpose of training. A portion of 21 the cost of each school-based liaison officer shall be paid by 22 the school district or other funding source as approved by the 23 chief juvenile court officer. 24 b. Of the funds appropriated in this section, up to $374,493 25 $748,985 is allocated for the payment of the expenses of 26 court-ordered services provided to children who are under the 27 supervision of the department, which expenses are a charge upon 28 the state pursuant to section 232.141, subsection 4 . 29 c. Notwithstanding In accordance with section 232.141 or 30 any other provision of law to the contrary as amended by this 31 2014 Act , the amounts allocated in this subsection shall be 32 distributed to the judicial districts as determined by the 33 state court administrator and to the department’s service areas 34 as determined by the administrator of the department’s division 35 -52- LSB 5015XG (16) 85 pf/jp 52/ 83

The state court administrator 1 and the division administrator shall make the determination of 2 the distribution amounts on or before June 15, 2014. 3 d. Notwithstanding chapter 232 or any other provision of 4 law to the contrary In accordance with section 232.141, as 5 amended by this 2014 Act , a district or juvenile court shall 6 not order any service which is a charge upon the state pursuant 7 to section 232.141 if there are insufficient court-ordered 8 services funds available in the district court or departmental 9 service area distribution amounts to pay for the service. The 10 chief juvenile court officer and the departmental service area 11 manager shall encourage use of the funds allocated in this 12 subsection such that there are sufficient funds to pay for 13 all court-related services during the entire year. The chief 14 juvenile court officers and departmental service area managers 15 shall attempt to anticipate potential surpluses and shortfalls 16 in the distribution amounts and shall cooperatively request the 17 state court administrator or division administrator to transfer 18 funds between the judicial districts’ or departmental service 19 areas’ distribution amounts as prudent. 20 e. Notwithstanding any provision of law to the contrary In 21 accordance with section 232.141, as amended by this 2014 Act , 22 a district or juvenile court shall not order a county to pay 23 for any service provided to a juvenile pursuant to an order 24 entered under chapter 232 which is a charge upon the state 25 under section 232.141, subsection 4 . 26 f. Of the funds allocated in this subsection, not more 27 than $41,500 $83,000 may be used by the judicial branch for 28 administration of the requirements under this subsection. 29 g. Of the funds allocated in this subsection, $8,500 $17,000 30 shall be used by the department of human services to support 31 the interstate commission for juveniles in accordance with 32 the interstate compact for juveniles as provided in section 33 232.173 . 34 10. Of the funds appropriated in this section, $4,026,613 35 -53- LSB 5015XG (16) 85 pf/jp 53/ 83
S.F. _____ H.F. _____ $8,053,227 is allocated for juvenile delinquent graduated 1 sanctions services. Any state funds saved as a result of 2 efforts by juvenile court services to earn federal Tit. IV-E 3 match for juvenile court services administration may be used 4 for the juvenile delinquent graduated sanctions services. 5 11. Of the funds appropriated in this section, $804,143 6 $1,608,285 is transferred to the department of public health 7 to be used for the child protection center grant program in 8 accordance with section 135.118 . The grant amounts under the 9 program shall be equalized so that each center receives a 10 uniform amount of at least $122,500 $245,000 . 11 12. If the department receives federal approval to 12 implement a waiver under Tit. IV-E of the federal Social 13 Security Act to enable providers to serve children who remain 14 in the children’s families and communities, for purposes of 15 eligibility under the medical assistance program through 25 16 years of age, children who participate in the waiver shall be 17 considered to be placed in foster care. 18 13. Of the funds appropriated in this section, $12,500 12 $25,000 shall be used for the public purpose of continuing a 13 grant to a hospital-based provider headquartered in a county 14 with a population between 90,000 and 95,000 in the latest 15 certified federal census that provides multiple services 16 including but not limited to diagnostic, therapeutic, and 17 behavioral services to individuals with autism spectrum 18 disorder across the lifespan. The grant recipient shall 19 utilize the funds to continue the pilot project to determine 20 the necessary support services for children with autism 21 spectrum disorder and their families to be included in the 22 children’s disabilities services system. The grant recipient 23 shall submit findings and recommendations based upon the 24 results of the pilot project to the individuals specified in 25 this division of this Act for submission of reports by December 26 31, 2014. 27 24. Of the funds appropriated in this section, $163,974 28 $327,947 shall be used for continuation of the central Iowa 29 system of care program grant through June 30, 2015. 30 25. Of the funds appropriated in this section, $80,000 31 $160,000 shall be used for the public purpose of the 32 continuation of a system of care grant implemented in Cerro 33 Gordo and Linn counties. 34 26. The department may continue to bill for state resource 2 center services utilizing a scope of services approach used for 3 private providers of ICFID services, in a manner which does not 4 shift costs between the medical assistance program, counties, 5 or other sources of funding for the state resource centers. 6 3. The state resource centers may expand the time-limited 7 assessment and respite services during the fiscal year. 8 4. If the department’s administration and the department 9 of management concur with a finding by a state resource 10 center’s superintendent that projected revenues can reasonably 11 be expected to pay the salary and support costs for a new 12 employee position, or that such costs for adding a particular 13 number of new positions for the fiscal year would be less 14 than the overtime costs if new positions would not be added, 15 the superintendent may add the new position or positions. If 16 the vacant positions available to a resource center do not 17 include the position classification desired to be filled, the 18 state resource center’s superintendent may reclassify any 19 vacant position as necessary to fill the desired position. The 20 superintendents of the state resource centers may, by mutual 21 agreement, pool vacant positions and position classifications 22 during the course of the fiscal year in order to assist one 23 another in filling necessary positions. 24 5. (1) For the fiscal year beginning July 1, 2014, 15 the total state funding amount for the nursing facility budget 16 shall not exceed $268,712,511 $282,878,824 . 17 (2) The department, in cooperation with nursing facility 18 representatives, shall review projections for state funding 19 expenditures for reimbursement of nursing facilities on a 20 quarterly basis and the department shall determine if an 21 adjustment to the medical assistance reimbursement rate is 22 necessary in order to provide reimbursement within the state 23 funding amount for the fiscal year. Notwithstanding 2001 24 Iowa Acts, chapter 192, section 4, subsection 2, paragraph 25 “c”, and subsection 3, paragraph “a”, subparagraph (2), 26 if the state funding expenditures for the nursing facility 27 budget for the fiscal year are projected to exceed the amount 28 specified in subparagraph (1), the department shall adjust 29 the reimbursement for nursing facilities reimbursed under the 30 case-mix reimbursement system to maintain expenditures of the 31 nursing facility budget within the specified amount for the 32 fiscal year. 33 (3) For the fiscal year beginning July 1, 2014, special 34 population nursing facilities shall be reimbursed in accordance 35 -64- LSB 5015XG (16) 85 pf/jp 64/ 83

(1) For the fiscal year beginning July 1, 2014, 2 the department shall continue the pharmacy dispensing fee 3 reimbursement at $10.12 per prescription until a cost of 4 dispensing survey is completed . The actual dispensing fee 5 shall be determined by a cost of dispensing survey performed 6 by the department and required to be completed by all medical 7 assistance program participating pharmacies every two years 8 beginning in FY 2014-2015. 9 (2) The department shall utilize an average acquisition 10 cost reimbursement methodology for all drugs covered under the 11 medical assistance program in accordance with 2012 Iowa Acts, 12 chapter 1133, section 33. 13 c. (1) For the fiscal year beginning July 1, 2014, 14 reimbursement rates for outpatient hospital services shall 15 remain at the rates in effect on June 30, 2014. 16 (2) For the fiscal year beginning July 1, 2014, 17 reimbursement rates for inpatient hospital services shall 18 remain at the rates in effect on June 30, 2014. 19 (3) For the fiscal year beginning July 1, 2014, the graduate 20 medical education and disproportionate share hospital fund 21 shall remain at the amount in effect on June 30, 2014, except 22 that the portion of the fund attributable to graduate medical 23 education shall be reduced in an amount that reflects the 24 elimination of graduate medical education payments made to 25 out-of-state hospitals. 26 (4) In order to ensure the efficient use of limited state 27 funds in procuring health care services for low-income Iowans, 28 funds appropriated in this Act for hospital services shall 29 not be used for activities which would be excluded from a 30 determination of reasonable costs under the federal Medicare 31 program pursuant to 42 U.S.C. § 1395X(v)(1)(N). 32 d. For the fiscal year beginning July 1, 2014, reimbursement 33 rates for rural health clinics, hospices, and acute mental 34 hospitals shall be increased in accordance with increases under 35 -65- LSB 5015XG (16) 85 pf/jp 65/ 83

For the fiscal year beginning July 1, 2014, independent 3 laboratories and rehabilitation agencies shall be reimbursed 4 using the same methodology in effect on June 30, 2014. 5 f. (1) For the fiscal year beginning July 1, 2014, 6 reimbursement rates for home health agencies shall continue to 7 be based on the Medicare low utilization payment adjustment 8 (LUPA) methodology in effect on June 30, 2014, as adjusted to 9 not exceed the reimbursement for the fiscal year beginning July 10 1, 2013 with state geographic wage adjustments . Beginning July 11 1, 2015, the department shall update the rates every two years 12 to reflect the most recent Medicare LUPA rates. 13 (2) For the fiscal year beginning July 1, 2014, rates for 14 private duty nursing and personal care services under the early 15 and periodic screening, diagnostic, and treatment program 16 benefit shall be calculated based on the methodology in effect 17 on June 30, 2014. 18 g. For the fiscal year beginning July 1, 2014, federally 19 qualified health centers shall receive cost-based reimbursement 20 for 100 percent of the reasonable costs for the provision of 21 services to recipients of medical assistance. 22 h. For the fiscal year beginning July 1, 2014, the 23 reimbursement rates for dental services shall remain at the 24 rates in effect on June 30, 2014. 25 i. (1) For the fiscal year beginning July 1, 2014, 26 state-owned psychiatric medical institutions for children shall 27 receive cost-based reimbursement for 100 percent of the actual 28 and allowable costs for the provision of services to recipients 29 of medical assistance. 30 (2) For the nonstate-owned psychiatric medical institutions 31 for children, reimbursement rates shall be based on the 32 reimbursement methodology developed by the department as 33 required for federal compliance. 34 (3) As a condition of participation in the medical 35 -66- LSB 5015XG (16) 85 pf/jp 66/ 83

For the fiscal year beginning July 1, 2014, unless 6 otherwise specified in this Act, all noninstitutional medical 7 assistance provider reimbursement rates shall remain at the 8 rates in effect on June 30, 2014, except for area education 9 agencies, local education agencies, infant and toddler 10 services providers, home and community-based services providers 11 including consumer-directed attendant care providers under a 12 section 1915(c) or 1915(i) waiver, targeted case management 13 providers, and those providers whose rates are required to be 14 determined pursuant to section 249A.20 . 15 k. Notwithstanding any provision to the contrary, for the 16 fiscal year beginning July 1, 2014, the reimbursement rate for 17 anesthesiologists shall remain at the rate in effect on June 18 30, 2014. 19 l. For the fiscal year beginning July 1, 2014, the average 20 reimbursement rate for health care providers eligible for use 21 of the federal Medicare resource-based relative value scale 22 reimbursement methodology under section 249A.20 shall remain 23 at the rate in effect on June 30, 2014; however, this rate 24 shall not exceed the maximum level authorized by the federal 25 government. The department may adjust reimbursement rates 26 under this paragraph to more closely align with the Medicare 27 fee schedule. Any such adjustment shall be budget neutral. 28 m. For the fiscal year beginning July 1, 2014, the 29 reimbursement rate for residential care facilities shall not 30 be less than the minimum payment level as established by the 31 federal government to meet the federally mandated maintenance 32 of effort requirement. The flat reimbursement rate for 33 facilities electing not to file annual cost reports shall not 34 be less than the minimum payment level as established by the 35 -67- LSB 5015XG (16) 85 pf/jp 67/ 83
S.F. _____ H.F. _____ federal government to meet the federally mandated maintenance 1 of effort requirement. 2 n. For the fiscal year beginning July 1, 2014, the 3 reimbursement rates for inpatient mental health services 4 provided at hospitals shall remain at the rates in effect 5 on June 30, 2014, subject to Medicaid program upper payment 6 limit rules; community mental health centers and providers 7 of mental health services to county residents pursuant to a 8 waiver approved under section 225C.7, subsection 3 , shall be 9 reimbursed at 100 percent of the reasonable costs for the 10 provision of services to recipients of medical assistance; and 11 psychiatrists shall be reimbursed at the medical assistance 12 program fee for service rate. 13 o. For the fiscal year beginning July 1, 2014, the 14 reimbursement rate for providers of family planning services 15 that are eligible to receive a 90 percent federal match shall 16 remain at the rates in effect on June 30, 2014. 17 p. For the fiscal year beginning July 1, 2014, the upper 18 limits on reimbursement rates for providers of home and 19 community-based services waiver services shall be the limits in 20 effect on June 30, 2014. 21 q. For the fiscal year beginning July 1, 2014, the 22 reimbursement rate for emergency medical service providers 23 shall be the rate in effect on June 30, 2014. 24 2. For the fiscal year beginning July 1, 2014, the 25 reimbursement rate for providers reimbursed under the 26 in-home-related care program shall not be less than the minimum 27 payment level as established by the federal government to meet 28 the federally mandated maintenance of effort requirement. 29 3. Unless otherwise directed in this section, when the 30 department’s reimbursement methodology for any provider 31 reimbursed in accordance with this section includes an 32 inflation factor, this factor shall not exceed the amount 33 by which the consumer price index for all urban consumers 34 increased during the calendar year ending December 31, 2002. 35 -68- LSB 5015XG (16) 85 pf/jp 68/ 83

For the fiscal year beginning July 1, 2014, the 1 foster family basic daily maintenance rate and the maximum 2 adoption subsidy rate for children ages 0 through 5 years shall 3 be $16.78, the rate for children ages 6 through 11 years shall 4 be $17.45, the rate for children ages 12 through 15 years shall 5 be $19.10, and the rate for children and young adults ages 16 6 and older shall be $19.35. For youth ages 18 to 21 who have 7 exited foster care, the preparation for adult living program 8 maintenance rate shall be $602.70 per month. The maximum 9 payment for adoption subsidy nonrecurring expenses shall be 10 limited to $500 and the disallowance of additional amounts 11 for court costs and other related legal expenses implemented 12 pursuant to 2010 Iowa Acts, chapter 1031, section 408 shall be 13 continued. 14 5. For the fiscal year beginning July 1, 2014, the maximum 15 reimbursement rates under the supervised apartment living 16 program and for social services providers under contract 17 shall remain at the rates in effect on June 30, 2014 , or the 18 provider’s actual and allowable cost plus inflation for each 19 service, whichever is less. However, if . If a new service 20 or service provider is added after June 30, 2014, the initial 21 reimbursement rate for the service or provider shall be based 22 upon a weighted average of provider rates for similar services. 23 6. For the fiscal year beginning July 1, 2014, the 24 reimbursement rates for family-centered service providers, 25 family foster care service providers, group foster care service 26 providers, and the resource family recruitment and retention 27 contractor shall remain at the rates in effect on June 30, 28 2014. 29 7. The group foster care reimbursement rates paid for 30 placement of children out of state shall be calculated 31 according to the same rate-setting principles as those used for 32 in-state providers, unless the director of human services or 33 the director’s designee determines that appropriate care cannot 34 be provided within the state. The payment of the daily rate 35 -69- LSB 5015XG (16) 85 pf/jp 69/ 83
S.F. _____ H.F. _____ shall be based on the number of days in the calendar month in 1 which service is provided. 2 8. a. For the fiscal year beginning July 1, 2014, the 3 reimbursement rate paid for shelter care and the child welfare 4 emergency services implemented to provide or prevent the need 5 for shelter care shall be established by contract. 6 b. For the fiscal year beginning July 1, 2014, the combined 7 service and maintenance components of the reimbursement rate 8 paid for shelter care services shall be based on the financial 9 and statistical report submitted to the department. The 10 maximum reimbursement rate shall be $96.98 per day. The 11 department shall reimburse a shelter care provider at the 12 provider’s actual and allowable unit cost, plus inflation, not 13 to exceed the maximum reimbursement rate. 14 c. Notwithstanding section 232.141, subsection 8 , for 15 For the fiscal year beginning July 1, 2014, the amount of 16 the statewide average of the actual and allowable rates for 17 reimbursement of juvenile shelter care homes that is utilized 18 for the limitation on recovery of unpaid costs shall remain 19 at the amount in effect for this purpose in the fiscal year 20 beginning July 1, 2013 the limitation on juvenile shelter home 21 costs payable by the public for purposes of section 232.141, 22 subsection 8, as amended by this 2014 Act, is $143.63 . 23 9. For the fiscal year beginning July 1, 2013 2014 , the 24 department shall calculate reimbursement rates for intermediate 25 care facilities for persons with intellectual disabilities at 26 the 80th percentile. Beginning July 1, 2013 2014 , the rate 27 calculation methodology shall utilize the consumer price index 28 inflation factor applicable to the fiscal year beginning July 29 1, 2013. 30 10. For the fiscal year beginning July 1, 2014, for child 31 care providers reimbursed under the state child care assistance 32 program, the department shall set provider reimbursement rates 33 based on the rate reimbursement survey completed in December 34 2004. However, for the fiscal year beginning July 1, 2014, 35 -70- LSB 5015XG (16) 85 pf/jp 70/ 83
S.F. _____ H.F. _____ such reimbursement rates shall remain at the rates in effect 1 on June 30, 2014. The department shall set rates in a manner 2 so as to provide incentives for a nonregistered provider to 3 become registered by applying the increase only to registered 4 and licensed providers. 5 11. The department may adopt emergency rules to implement 6 this section. 7 Sec. 33. 2013 Iowa Acts, chapter 138, section 160, is 8 amended to read as follows: 9 SEC. 160. EMERGENCY RULES. 10 1. If specifically authorized by a provision of this 11 division of this Act for the fiscal year beginning July 1, 2013 12 2014 , the department of human services or the mental health 13 and disability services commission may adopt administrative 14 rules under section 17A.4, subsection 3 , and section 17A.5, 15 subsection 2 , paragraph “b”, to implement the provisions and 16 the rules shall become effective immediately upon filing or 17 on a later effective date specified in the rules, unless the 18 effective date is delayed by the administrative rules review 19 committee. Any rules adopted in accordance with this section 20 shall not take effect before the rules are reviewed by the 21 administrative rules review committee. The delay authority 22 provided to the administrative rules review committee under 23 section 17A.4, subsection 7 , and section 17A.8, subsection 9 , 24 shall be applicable to a delay imposed under this section, 25 notwithstanding a provision in those sections making them 26 inapplicable to section 17A.5, subsection 2 , paragraph “b”. 27 Any rules adopted in accordance with the provisions of this 28 section shall also be published as notice of intended action 29 as provided in section 17A.4 . 30 2. If during the fiscal year beginning July 1, 2013 31 2014 , the department of human services is adopting rules in 32 accordance with this section or as otherwise directed or 33 authorized by state law, and the rules will result in an 34 expenditure increase beyond the amount anticipated in the 35 -71- LSB 5015XG (16) 85 pf/jp 71/ 83
S.F. _____ H.F. _____ budget process or if the expenditure was not addressed in 1 the budget process for the fiscal year, the department shall 2 notify the persons designated by this division of this Act for 3 submission of reports, the chairpersons and ranking members 4 of the committees on appropriations, and the department of 5 management concerning the rules and the expenditure increase. 6 The notification shall be provided at least 30 calendar days 7 prior to the date notice of the rules is submitted to the 8 administrative rules coordinator and the administrative code 9 editor. 10 Sec. 34. 2013 Iowa Acts, chapter 138, section 161, is 11 amended to read as follows: 12 SEC. 161. REPORTS. Any reports or other information 13 required to be compiled and submitted under this Act during 14 the fiscal year beginning July 1, 2013 2014 , shall be 15 submitted to the chairpersons and ranking members of the joint 16 appropriations subcommittee on health and human services, the 17 legislative services agency, and the legislative caucus staffs 18 on or before the dates specified for submission of the reports 19 or information. 20 DIVISION VI 21 HEALTH CARE ACCOUNTS AND FUNDS 22 Sec. 35. 2013 Iowa Acts, chapter 138, section 162, is 23 amended to read as follows: 24 SEC. 162. Notwithstanding section 8.33 , if moneys 21 appropriated for purposes of the medical assistance program for 22 the fiscal year beginning July 1, 2014, and ending June 30, 23 2015, from the general fund of the state, the quality assurance 24 trust fund and the hospital health care access trust fund, are 25 in excess of actual expenditures for the medical assistance 26 program and remain unencumbered or unobligated at the close 27 of the fiscal year, the excess moneys shall not revert but 28 shall remain available for expenditure for the purposes of the 29 medical assistance program until the close of the succeeding 30 fiscal year. 31 DIVISION VII 32 MISCELLANEOUS 33 Sec. 38. Section 225C.38, subsection 1, paragraph c, Code 6 2014, is amended to read as follows: 7 c. Except as provided in section 225C.41 , a family support 8 subsidy for a fiscal year shall be in an amount determined by 9 the department. However, if at any time during the fiscal year 10 the funding amount available for the family support subsidy 11 program is reduced from the amount initially used to establish 12 the subsidy amount, the department shall revise the subsidy 13 amount as necessary to conform to the funding amount available. 14 The parent or legal guardian receiving a family support subsidy 15 may elect to receive a payment amount which is less than the 16 amount determined in accordance with this paragraph. 17 Sec. 40. Section 232.141, subsection 5, Code 2014, is 18 amended by adding the following new paragraph: 19 NEW PARAGRAPH . c. (1) The amount allocated for a fiscal 20 year for purposes of subsection 4 in the appropriation 21 enacted by the general assembly for that fiscal year shall be 22 distributed to the judicial districts as determined by the 23 state court administrator and to the department’s service areas 24 as determined by the administrator of the department’s division 25 of child and family services. The state court administrator 26 and the division administrator shall make the determination of 27 the distribution amounts on or before June 15 preceding the 28 beginning of the fiscal year. 29 (2) A district or juvenile court shall not order any service 30 which is a charge upon the state pursuant to subsection 4 if 31 there are insufficient court-ordered services funds available 32 in the district court or departmental service area distribution 33 amounts to pay for the service. The chief juvenile court 34 officer and the departmental service area manager shall 35 -74- LSB 5015XG (16) 85 pf/jp 74/ 83
S.F. _____ H.F. _____ encourage use of the distribution amounts and other available 1 moneys such that there are sufficient funds to pay for all 2 court-related services during the entire year. The chief 3 juvenile court officers and departmental service area managers 4 shall attempt to anticipate potential surpluses and shortfalls 5 in the distribution amounts and shall cooperatively request the 6 state court administrator or division administrator to transfer 7 funds between the judicial districts’ or departmental service 8 areas’ distribution amounts as prudent. 9 (3) Notwithstanding any provision of law to the contrary, 10 a district or juvenile court shall not order a county to pay 11 for any service provided to a juvenile pursuant to an order 12 entered under this chapter which is a charge upon the state in 13 accordance with subsection 4. 14 Sec. 41. Section 232.141, subsection 8, Code 2014, is 15 amended to read as follows: 16 8. This subsection applies only to placements in a juvenile 17 shelter care home which is publicly owned, operated as a county 18 or multicounty shelter care home, organized under a chapter 19 28E agreement, or operated by a private juvenile shelter care 20 home. If the actual and allowable costs of a child’s shelter 21 care placement exceed the amount maximum reimbursement rate 22 the department is authorized to pay in accordance with law 23 and administrative rule, the unpaid costs may be recovered 24 from the child’s county of legal settlement. However, the 25 maximum amount of the unpaid costs which may be recovered 26 under this subsection is limited to the difference between 27 the amount maximum reimbursement rate the department is 28 authorized to pay and the statewide average of the actual and 29 allowable rates in effect in May of the preceding fiscal year 30 for reimbursement of juvenile shelter care homes limitation 31 on juvenile shelter home costs payable by the public for the 32 fiscal year . The limitation shall be established for a fiscal 33 year in appropriations law enacted by the general assembly. In 34 no case shall the home be reimbursed for more than the home’s 35 -75- LSB 5015XG (16) 85 pf/jp 75/ 83
S.F. _____ H.F. _____ actual and allowable costs. The unpaid costs are payable 1 pursuant to filing of verified claims against the county of 2 legal settlement. A detailed statement of the facts upon 3 which a claim is based shall accompany the claim. Any dispute 4 between counties arising from filings of claims pursuant to 5 this subsection shall be settled in the manner provided to 6 determine residency in section 331.394 . 7 Sec. 42. Section 232.142, subsection 3, Code 2014, is 8 amended to read as follows: 9 3. A county or multicounty juvenile detention home approved 10 pursuant to this section shall receive financial aid from the 11 state in a manner approved by the director in accordance with 12 the requirements established in this section for the juvenile 13 detention home fund and in appropriations made to provide such 14 aid . Aid The amount of aid paid by the state shall not be at 15 least ten percent and not more than fifty percent of the total 16 cost costs of the establishment, improvements, operation, and 17 maintenance of the home. 18 Sec. 43. Section 234.35, subsection 1, unnumbered paragraph 19 1, Code 2014, is amended to read as follows: 20 The department of human services is responsible for paying 21 the cost of foster care for a child , according to rates 22 established pursuant to section 234.38 , and for shelter care, 23 under any of the following circumstances: 24 Sec. 44. Section 234.38, Code 2014, is amended to read as 25 follows: 26 234.38 Foster care reimbursement rates. 27 The department of human services shall make reimbursement 28 payments directly to foster parents for services provided to 29 children pursuant to section 234.6, subsection 6 , paragraph 30 “b” , or section 234.35 . In any fiscal year, unless otherwise 31 provided by law and subject to the appropriation of sufficient 32 funding, the reimbursement rate shall be based upon sixty-five 33 percent of the United States department of agriculture 34 estimate of the cost to raise a child in the calendar year 35 -76- LSB 5015XG (16) 85 pf/jp 76/ 83
S.F. _____ H.F. _____ immediately preceding the fiscal year. The department may pay 1 an additional stipend for a child with special needs. 2 Sec. 45. Section 249A.20, Code 2014, is amended to read as 3 follows: 4 249A.20 Noninstitutional health providers —— reimbursement. 5 1. Beginning November 1, 2000, the The department shall 6 use the federal Medicare resource-based relative value scale 7 methodology to reimburse all applicable noninstitutional health 8 providers, excluding anesthesia and dental services, that on 9 June 30, 2000, are reimbursed on a fee-for-service basis for 10 provision of services under the medical assistance program. 11 The department shall apply the federal Medicare resource-based 12 relative value scale methodology to such health providers in 13 the same manner as the methodology is applied under the federal 14 Medicare program and shall not utilize the resource-based 15 relative value scale methodology in a manner that discriminates 16 between such health providers. The reimbursement schedule 17 shall be adjusted annually on July 1, and shall provide for 18 reimbursement that is not less than the reimbursement provided 19 under the fee schedule established for Iowa under the federal 20 Medicare program in effect on January 1 of that calendar year 21 and adjusted as necessary to not exceed the amount appropriated 22 to the department for this purpose for the fiscal year . 23 2. A provider reimbursed under section 249A.31 is not a 24 noninstitutional health provider. 25 DIVISION VIII 26 PRIOR APPROPRIATIONS AND RELATED CHANGES 27 Sec. 46. 2013 Iowa Acts, chapter 138, section 32, is amended 28 to read as follows: 29 SEC. 32. IOWACARE ACCOUNT. Until June 30, 2015, any funds 31 remaining in the IowaCare account created in section 249J.24, 32 Code 2013, shall remain available and are appropriated to the 33 department of human services for the payment of valid claims. 34 Sec. 50. IMMEDIATE EFFECTIVE DATE. This division of this 35 -78- LSB 5015XG (16) 85 pf/jp 78/ 83
S.F. _____ H.F. _____ Act, being deemed of immediate importance, takes effect upon 1 enactment. 2 Sec. 51. RETROACTIVE APPLICABILITY. The following sections 3 of this division of this Act apply retroactively to July 1, 4 2013: 5 1. The section relating to the reversion of funds remaining 6 in the account for health care transformation to the general 7 fund of the state. 8 2. The section relating to availability and appropriation 9 of the funds remaining in the IowaCare account. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill relates to appropriations for health and human 14 services made in 2013 Iowa Acts, chapter 138 (SF 446) for 15 fiscal year 2014-2015 to the department of veterans affairs, 16 the Iowa veterans home, the department on aging, the department 17 of public health, Iowa finance authority, state board of 18 regents, department of inspections and appeals, department of 19 human rights, and enacted the department of human services 20 (DHS). With some exceptions the enacted amounts appropriated 21 for FY 2014-2015 are approximately 50 percent of the amounts 22 appropriated for the same purposes for the prior fiscal 23 year along with some other changes. The bill revises the 24 appropriation amounts. Vetoed language is omitted. 25 The bill is organized into divisions. 26 DEPARTMENT ON AGING —— FY 2014-2015. This division amends 27 appropriations from the general fund of the state for the 28 department on aging for FY 2014-2015. 29 OFFICE OF LONG-TERM CARE OMBUDSMAN —— FY 2014-2015. This 30 division amends appropriations from the general fund of 31 the state for the office of long-term care ombudsman for FY 32 2014-2015. 33 DEPARTMENT OF PUBLIC HEALTH —— FY 2014-2015. This division 34 amends appropriations from the general fund of the state for 35 -79- LSB 5015XG (16) 85 pf/jp 79/ 83
S.F. _____ H.F. _____ the department of public health for FY 2014-2015. 1 DEPARTMENT OF VETERANS AFFAIRS —— FY 2014-2015. This 2 division amends appropriations from the general fund of the 3 state for the department of veterans affairs and the Iowa 4 veterans home for FY 2014-2015. In addition to amount changes, 5 the appropriations for the department and the veterans home are 6 divided into separate line items. 7 DEPARTMENT OF HUMAN SERVICES —— FY 2014-2015. This division 8 amends appropriations from the general fund of the state and 9 the federal temporary assistance for needy families block 10 grant to DHS. The allocation for the family development 11 and self-sufficiency grant program is made directly to 12 the department of human rights. The reimbursement section 13 addresses reimbursement for providers reimbursed by the 14 department of human services. The allocations for certain 15 mental health and disability services (MH/DS) under the medical 16 assistance (Medicaid) appropriation are stricken and replaced 17 with a new, separate line item appropriation for the same 18 purposes. The appropriation for the Iowa juvenile home at 19 Toledo is amended to apply to the facilities located at the 20 home and to reduce the amount. A new appropriation is made 21 for the placement costs of female children adjudicated as 22 delinquent and male and female children adjudicated as a child 23 in need of assistance identified by the department, and for 24 the costs of compensatory education to address the reviews 25 of special education of certain children placed at the Iowa 26 juvenile home conducted by the department of education in 27 fall 2013 and reported to the department of human services on 28 October 7 and December 20, 2013. 29 HEALTH CARE ACCOUNTS AND FUND —— FY 2014-2015. This division 30 amends certain health-related appropriations for FY 2014-2015. 31 A number of the appropriations are made for purposes of the 32 medical assistance (Medicaid) program in addition to the 33 general fund appropriations made for this purpose for the same 34 fiscal year. 35 -80- LSB 5015XG (16) 85 pf/jp 80/ 83
S.F. _____ H.F. _____ The appropriation from the pharmaceutical settlement 1 account to DHS, originally limited to supplement the Medicaid 2 program medical contracts appropriations, is expanded to also 3 supplement the general Medicaid appropriations. 4 An increase is made in the amount of the appropriation made 5 to supplement the Medicaid program from the quality assurance 6 trust fund. 7 The division provides that if the total amounts appropriated 8 from all sources for the medicaid program for FY 2014-2015 9 exceed the amount needed, the excess remains available to be 10 used for the program in the succeeding fiscal year. 11 MISCELLANEOUS. This division includes miscellaneous 12 statutory amendments involving the agencies receiving 13 appropriations in the bill and the programs administered by 14 those agencies. Many of the amendments codify exceptions to 15 codified law that were enacted in appropriations made in SF 466 16 and in previous years appropriations. 17 Code section 35A.16, relating to the county commissions 18 of veteran affairs fund, is amended to reduce the standing 19 appropriation to the fund from $1 million to $990,000. Each 20 county in the state receives $10,000 from the fund annually. 21 Code section 225C.38, relating to payments under the family 22 support subsidy program, is amended to address the subsidy 23 amounts. If during the fiscal year the funding amount used 24 to establish the subsidy amount is reduced, the department is 25 required to revise the subsidy amount to conform to the funding 26 amount. The procedure for establishing the maximum amount of 27 unpaid costs that may be recovered from a child’s county of 28 legal settlement is amended to provide for a limitation on 29 juvenile shelter home payable by the public to be established 30 for a fiscal year in appropriations law enacted by the general 31 assembly. 32 Code section 232.141, relating to juvenile justice 33 expenses, is amended to codify a procedure for the state 34 court administrator and a department of human services 35 -81- LSB 5015XG (16) 85 pf/jp 81/ 83
S.F. _____ H.F. _____ division administrator to distribute to judicial districts 1 and departmental service areas the overall amount allocated 2 by appropriation for juvenile justice court-ordered services. 3 The district or juvenile court is prohibited from ordering a 4 service charged to the state when there is insufficient funding 5 in the distribution amount. The court is also prohibited from 6 ordering a county to pay for a service that is a charge upon the 7 state. 8 Code section 232.141 is also amended to provide that state 9 reimbursement for a juvenile shelter placement is limited to 10 the amount the department of human services is authorized to 11 pay in accordance with law and administrative rule. 12 Code section 232.142, relating to the costs of juvenile 13 detention homes, is amended to remove a requirement for the 14 state financial aid to be at least 10 percent of the detention 15 home costs and to reference the funding source for the 16 financial aid. 17 Code section 234.35, relating to when the state is 18 responsible to pay for the cost of foster care, is amended to 19 include a reference to shelter care and to strike a reference 20 to a foster care reimbursement rate standard in Code section 21 234.38, which is amended by the bill. 22 Code section 234.38, relating to foster care reimbursement 23 rates, is amended to modify the requirement that the rates 24 shall be based on 65 percent of the federal estimate of the 25 cost to raise a child. The bill provides that the requirement 26 can be modified by law and is subject to the appropriation of 27 sufficient funding. 28 Code section 249A.20, relating to reimbursement of 29 noninstitutional health providers under the Medicaid program, 30 is amended to require that the annual adjustment of the 31 reimbursement schedule for the providers is based on the amount 32 of the annual appropriation made for this reimbursement. 33 PRIOR APPROPRIATIONS AND RELATED CHANGES. S.F. _____ H.F. _____ changes including increases in the 2013-2014 appropriations 1 made from the pharmaceutical settlement account and the quality 2 assurance trust fund; a provision transferring any moneys 3 remaining in the account for health care transformation as 4 of December 31, 2013, to the general fund of the state; and 5 a provision authorizing that until June 30, 2015, funds in 6 the IowaCare account remain available and are appropriated to 7 the department of human services for payment of valid claims. 8 The division takes effect upon enactment and for the sections 9 relating to the health care transformation and IowaCare 10 accounts is retroactively applicable to July 1, 2013. 11 -83- LSB 5015XG (16) 85 pf/jp 83/ 83
