NEW SECTION . 622.78A Serving a subpoena on a 1 peace officer. 2 A subpoena may be served at the principal place of employment 3 of the peace officer, as defined in section 801.4, if the 4 subpoena is related to the performance of any act which is 5 within the scope of the lawful duty or authority of that peace 6 officer. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill relates to serving a subpoena on a peace officer. 11 The bill specifies that a subpoena may be served at the 12 principal place of employment of the peace officer, as defined 13 in Code section 801.4, if the subpoena is related to the 14 performance of any act which is within the scope of the lawful 15 duty or authority of that peace officer. 16 -1- LSB 5093XC (3) 85 jm/rj 1/ 1
