S.F. _____ H.F. _____ DIVISION I 1 TRAINING ON BLOOD-BORNE PATHOGENS 2 Section 1. Section 135.11, subsections 20 and 21, Code 2014, 3 are amended to read as follows: 4 20. Adopt rules which require personnel of a licensed 5 hospice, of a homemaker-home health aide provider agency which 6 receives state homemaker-home health aide funds, or of an 7 agency which provides respite care services and receives funds 8 to complete a minimum of two hours of training concerning 9 acquired immune deficiency syndrome-related conditions through 10 a program approved by the department. The rules shall require 11 that new employees complete the training within six months of 12 initial employment and existing employees complete the training 13 on or before January 1, 1989 blood-borne pathogens, including 14 human immunodeficiency virus and viral hepatitis, consistent 15 with standards from the federal occupational safety and health 16 administration . 17 21. Adopt rules which require all emergency medical 18 services personnel, firefighters, and law enforcement personnel 19 to complete a minimum of two hours of training concerning 20 acquired immune deficiency syndrome-related conditions and 21 the prevention of blood-borne pathogens, including human 22 immunodeficiency virus infection and viral hepatitis, 23 consistent with standards from the federal occupational safety 24 and health administration . 25 DIVISION II 26 HEALTH CARE WORKFORCE SUPPORT INITIATIVE 27 Sec. 2. Section 135.175, subsection 1, paragraph a, Code 28 2014, is amended to read as follows: 29 a. A health care workforce support initiative is established 30 to provide for the coordination and support of various efforts 31 to address the health care workforce shortage in this state. 32 This initiative shall include the medical residency training 33 state matching grants program created in section 135.176 , 34 the nurse residency state matching grants program created in 35 -1- LSB 5305XD (4) 85 ad/nh 1/ 5
S.F. _____ H.F. _____ section 135.178 , the health care professional and Iowa needs 1 nurses now initiative created in sections 261.128 and 261.129 , 2 the safety net provider recruitment and retention initiatives 3 program created in section 135.153A , and health care workforce 4 shortage national initiatives , and the physician assistant 5 mental health fellowship program created in section 135.177 . 6 Sec. 3. Section 135.175, subsection 5, paragraphs b, c, e, 7 f, and g, Code 2014, are amended by striking the paragraphs. 8 Sec. 4. Section 135.175, subsection 6, paragraphs a and c, 9 Code 2014, are amended to read as follows: 10 a. Moneys in the fund and the accounts in the fund shall 11 only be appropriated in a manner consistent with the principles 12 specified and the strategic plan developed pursuant to sections 13 135.163 and 135.164 to support the medical residency training 14 state matching grants program, the nurse residency state 15 matching grants program, the health care professional incentive 16 payment program, the Iowa needs nurses now initiative, the 17 safety net recruitment and retention initiatives program, for 18 national health care workforce shortage initiatives, for the 19 physician assistant mental health fellowship program, for the 20 purposes of the Iowa needs nurses now infrastructure account, 21 and to provide funding for state health care workforce shortage 22 programs as provided in this section . 23 c. State appropriations to the fund shall be allocated in 24 equal amounts to each of the accounts within the fund, unless 25 otherwise specified in the appropriation or allocation. Any 26 federal funding received for the purposes of addressing state 27 health care workforce shortages shall be deposited in the 28 health care workforce shortage national initiatives account, 29 unless otherwise specified by the source of the funds, and 30 shall be used as required by the source of the funds. If 31 use of the federal funding is not designated, twenty-five 32 percent of such funding shall be deposited in the safety net 33 provider network workforce shortage account to be used for the 34 purposes of the account and the remainder of the funds shall 35 -2- LSB 5305XD (4) 85 ad/nh 2/ 5
S.F. _____ H.F. _____ be used in accordance with the strategic plan developed by the 1 department of public health in accordance with sections 135.163 2 and 135.164 , or to address workforce shortages as otherwise 3 designated by the department of public health. Other sources 4 of funding shall be deposited in the fund or account and used 5 as specified by the source of the funding. 6 Sec. 5. Section 135.175, subsection 9, Code 2014, is amended 7 by striking the subsection. 8 Sec. 6. Section 135.176, subsection 3, Code 2014, is amended 9 by striking the subsection. 10 DIVISION III 11 SALON LICENSES AND INSPECTIONS 12 Sec. 7. Section 157.11, Code 2014, is amended to read as 13 follows: 14 157.11 Salon licenses. 15 1. A salon shall not operate unless the owner has obtained 16 a license issued by the department. The owner shall apply 17 to the department on forms prescribed by the board. The 18 department shall may perform a sanitary inspection of each 19 salon biennially and may perform a sanitary inspection of a 20 salon prior to the issuance of a license. An inspection of a 21 salon shall may also be conducted upon receipt of a complaint 22 by the department. 23 2. The application shall be accompanied by the biennial 24 license fee determined pursuant to section 147.80 . The license 25 is valid for two years and may be renewed. 26 3. A licensed school of cosmetology arts and sciences at 27 which students practice cosmetology arts and sciences is exempt 28 from licensing as a salon. 29 DIVISION IV 30 MORTUARY SCIENCE INSPECTIONS 31 Sec. 8. Section 156.10, Code 2014, is amended to read as 32 follows: 33 156.10 Inspection. 34 1. The director of public health shall may inspect all 35 -3- LSB 5305XD (4) 85 ad/nh 3/ 5
S.F. _____ H.F. _____ places where dead human bodies are prepared or held for burial, 1 entombment, or cremation, and shall may adopt and enforce 2 such rules and regulations in connection with the inspection 3 as shall may be necessary for the preservation of the public 4 health. 5 2. The Iowa department of public health shall may assess an 6 inspection fee for an inspection of a place where dead human 7 bodies are prepared for burial or cremation. The fee shall may 8 be determined by the department by rule. 9 DIVISION V 10 BARBERSHOP LICENSES AND INSPECTIONS 11 Sec. 9. Section 158.9, Code 2014, is amended to read as 12 follows: 13 158.9 Barbershop licenses. 14 1. A barbershop shall not operate unless the owner has 15 obtained a license issued by the department. The owner shall 16 apply to the department on forms prescribed by the board. The 17 department shall may perform a sanitary inspection of each 18 barbershop biennially and may perform a sanitary inspection of 19 a barbershop prior to the issuance of a license. A licensed barber school at which students practice 26 barbering is exempt from licensing as a barbershop. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill relates to programs and services of the department 31 of public health (DPH). 32 Division I, regarding training concerning blood-borne 33 pathogens, requires DPH to adopt rules to require personnel of 34 a licensed hospice, personnel of a homemaker-home health aide 35 -4- LSB 5305XD (4) 85 ad/nh 4/ 5
S.F. _____ H.F. _____ provider agency, personnel of an agency requiring respite care 1 services, emergency medical services personnel, firefighters, 2 and law enforcement personnel to complete training concerning 3 blood-borne pathogens consistent with federal occupational 4 safety and health administration (OSHA) standards rather than 5 completing the two hours of training concerning acquired-immune 6 deficiency syndrome-related conditions that is currently 7 required. 8 Division II relates to the health care workforce support 9 initiative codified in Code section 135.175. This initiative 10 includes many initiatives and programs and the health care 11 workforce shortage fund has separate accounts for each of 12 these initiatives and programs. The initiative, the workforce 13 shortage fund, and all the accounts and programs within the 14 initiative are set to repeal on June 30, 2014. 15 The bill, which eliminates the repeal of the health care 16 workforce support initiative and health care workforce 17 shortage fund, effectively allows the repeal of most of the 18 programs including the nurse residency state matching grants 19 program, the health care professional and Iowa needs nurses now 20 initiative, the safety net provider recruitment and retention 21 initiatives program, and the physician assistant mental health 22 fellowship program and the related accounts. However, the 23 bill retains the medical residency training state matching 24 grants program, the health care workforce shortage national 25 initiatives, and the related accounts. 26 Divisions III through V, concerning salon licenses and 27 inspections, mortuary science inspections, and barbershop 28 licenses and inspections, respectively, eliminate mandatory 29 inspections in these establishments and instead institute 30 permissive inspections. 31 -5- LSB 5305XD (4) 85 ad/nh 5/ 5
