Section 124.204, subsection 4, Code 2014, is 1 amended by adding the following new paragraphs: 2 NEW PARAGRAPH . aj. 3,4-Methylenedioxy-N-methylcathinone 3 (methylone). 4 NEW PARAGRAPH . ak. 5-methoxy-N,N-dimethyltryptamine. 5 Some trade or other names: 6 5-methoxy-3-[2-(dimethylamino)ethyl]indole; 5-MeO-DMT. 7 Sec. 2. Section 124.204, Code 2014, is amended by adding the 8 following new subsection: 9 NEW SUBSECTION . 9. Other substances. Any material, 10 compound, mixture, or preparation which contains any quantity 11 of the following substances or their optical, positional, and 12 geometric isomers, salts, and salts of isomers: 13 a. (1-pentyl-1H-indol-3-yl)(2,2,3,3-tetramethylcyclopropyl) 14 methanone. Other names: UR-144, 15 1-pentyl-3-(2,2,3,3-tetramethylcyclopropoyl)indole. 16 b. [1-(5-fluoro-pentyl)-1H-indol-3-yl] 17 (2,2,3,3-tetramethylcyclopropyl) 18 methanone. Other names: 5-fluoro-UR-144, 5-F-UR-144, XLR11, 19 1-(5-fluoro-pentyl)-3-(2,2,3,3-tetramethylcyclopropoyl)indole. 20 c. Section 124.210, Code 2014, is amended by adding the 4 following new subsection: 5 NEW SUBSECTION . 4A. Lorcaserin. Any material, compound, 6 mixture, or preparation which contains any quantity of 7 lorcaserin, including its salts, isomers, and salts of such 8 isomers, whenever the existence of such salts, isomers, and 9 salts of isomers is possible. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill makes changes to the controlled substance 14 schedules. 15 The bill classifies three synthetic cannabinoids, three 16 synthetic phenethylamines, one hallucinogenic synthetic 17 cathinone, and other hallucinogens, as schedule I controlled 18 substances. A schedule I controlled substance has a high 19 potential for abuse and has no accepted medical use in the 20 United States. 21 The bill classifies two anabolic steroids and one epilepsy 22 drug as schedule III controlled substances. A schedule III 23 controlled substance has a potential for abuse which is less 24 than that of the substances listed in schedules I and II and 25 currently has an accepted medical use in treatment in the 26 United States. 27 The bill also classifies a new weight loss hallucinogenic 28 drug as a schedule IV controlled substance. A schedule 29 IV controlled substance has a low potential for abuse when 30 compared with the substances listed in schedule III and 31 currently has an accepted medical use in treatment in the 32 United States. 33 It is a class “C” felony pursuant to Code section 34 124.401(1)(c)(8) for any unauthorized person to violate a 35 -2- LSB 5285DP (6) 85 jm/nh 2/ 3
S.F. _____ H.F. _____ provision of Code section 124.401, involving a classified 1 substance placed on schedule I, II, or III pursuant to the 2 bill. A class “C” felony for this particular offense is 3 punishable by confinement for no more than 10 years and a fine 4 of at least $1,000 but not more than $50,000. 5 It is an aggravated misdemeanor pursuant to Code section 6 124.401(1)(d) for any unauthorized person to violate a 7 provision of Code section 124.401, involving a classified 8 substance placed on schedule IV pursuant to the bill. An 9 aggravated misdemeanor is punishable by confinement for no more 10 than two years and a fine of at least $625 but not more than 11 $6,250. 12 If a person possesses a controlled substance in violation of 13 Code section 124.401(5) as a first offense, the person commits 14 a serious misdemeanor. A serious misdemeanor is punishable by 15 confinement for no more than one year and a fine of at least 16 $315 but not more than $1,875. 17 -3- LSB 5285DP (6) 85 jm/nh 3/ 3
