S.F. _____ Section 1. Section 321.45, subsection 4, Code 2013, is 1 amended to read as follows: 2 4. After acquiring a used mobile home or manufactured home 3 to be titled in Iowa, a manufactured or mobile home retailer, 4 as defined in section 103A.51 , shall within thirty days apply 5 for and obtain from the county treasurer of the retailer’s 6 county of residence where the mobile home or manufactured home 7 is located a new certificate of title for the mobile home 8 or manufactured home. In the event that there is a prior 9 lien or encumbrance to be released, as required by section 10 321.50, subsection 5 , the thirty-day time period in this 11 subsection does not begin to run until the lien or encumbrance 12 is released. 13 Sec. 2. Section 321.49, subsection 3, Code 2013, is amended 14 to read as follows: 15 3. A manufactured or mobile home retailer who acquires a 16 used mobile home or manufactured home, titled in Iowa, and who 17 does not apply for and obtain a certificate of title from the 18 county treasurer of the county where the manufactured or mobile 19 home retailer’s county of residence is located within thirty 20 days of the date of acquisition, as required under section 21 321.45, subsection 4 , is subject to a penalty of ten dollars. 22 A certificate of title shall not be issued to the manufactured 23 or mobile home retailer until the penalty is paid. 24 EXPLANATION 25 Under current law, a manufactured or mobile home retailer 26 who acquires a used mobile home or manufactured home 27 must obtain a certificate of title for the mobile home or 28 manufactured home within 30 days of the date of acquisition. 29 The application for title must be made to the county treasurer 30 of the retailer’s county of residence.
