S.F. _____ Section 1. NEW SECTION . 280.18 Interrogations in schools. 1 1. For purposes of this section: 2 a. “Law enforcement officer” means a state patrol officer 3 or a regularly employed member of a police force of a city or 4 county, including but not limited to a sheriff’s office, who is 5 responsible for the prevention and detection of a crime and the 6 enforcement of the criminal laws of this state. 7 b. “School” means a public or nonpublic school as defined 8 in section 280.2. 9 c. “School official” means a licensed school employee or an 10 unlicensed school employee employed for security or supervision 11 purposes including but not limited to school resource officers. 12 2. Any interrogation of a student in a school by a law 13 enforcement officer or by a school official at the invitation 14 or direction of a law enforcement officer who is not a school 15 official shall not take place without the presence of the 16 student’s parent or legal guardian. 17 EXPLANATION 18 This bill relates to interrogations of students in both 19 public and nonpublic schools. 20 The bill provides that any interrogation of a student in a 21 school by a law enforcement officer or by a school official at 22 the invitation or direction of a law enforcement officer who is 23 not a school official shall not take place without the presence 24 of the student’s parent or legal guardian. 25 Under the bill, “law enforcement officer” means a state 26 patrol officer or a regularly employed member of a police force 27 of a city or county, including but not limited to a sheriff’s 28 office, who is responsible for the prevention and detection of 29 a crime and the enforcement of the criminal laws of this state, 30 “school” means a public or nonpublic school as defined in Code 31 section 280.2, and “school official” means a licensed school 32 employee or an unlicensed school employee employed for security 33 or supervision purposes including but not limited to school 34 resource officers. 35 -1- LSB 1455XC (2) 85 rh/nh 1/ 1
