S.F. _____ Section 1. Section 53.17, subsection 2, Code 2013, is 1 amended to read as follows: 2 2. In order for the ballot to be counted, the return 3 envelope must be received in the commissioner’s office before 4 the polls close on election day or be clearly postmarked by an 5 officially authorized postal service not later than the day 6 before the election and received by the commissioner not later 7 than noon on the Monday following the election . 8 Sec. 2. Section 53.17, subsection 3, Code 2013, is amended 9 by striking the subsection. 10 Sec. 3. Section 53.22, subsection 5, paragraph b, Code 2013, 11 is amended to read as follows: 12 b. Absentee ballots voted under this subsection shall be 13 delivered to the commissioner no later than the time before the 14 polls are closed on election day. If the ballot is returned 15 by mail the return envelope must be received by the time 16 before the polls close , or clearly postmarked by an officially 17 authorized postal service not later than the day before the 18 election and received by the commissioner no later than the 19 time established for the canvass by the board of supervisors 20 for that on election day . 21 EXPLANATION 22 This bill requires that an absentee ballot must be received 23 in the commissioner’s office before the polls close on election 24 day. 25 -1- LSB 2084XC (2) 85 aw/sc 1/ 1
