S.F. _____ Section 1. Section 147.7, subsection 2, Code 2013, is 1 amended to read as follows: 2 2. This section shall not apply to a A person who is 3 licensed in another state and recognized for licensure in this 4 state pursuant to the nurse licensure compact contained in 5 section 152E.1 or pursuant to the advanced practice registered 6 nurse compact contained in section 152E.3 . A person licensed 7 in another state and recognized for licensure in this state 8 pursuant to either compact who has a primary site of practice 9 shall , however, maintain display a copy of a license and 10 evidence of current renewal issued by the person’s home state 11 available for inspection when engaged in the practice of 12 nursing in this state. 13 Sec. 2. Section 147.72, Code 2013, is amended to read as 14 follows: 15 147.72 Professional titles and abbreviations. 16 1. a. Any person licensed to practice a profession under 17 this subtitle may append to the person’s name any recognized 18 title or abbreviation, which the person is entitled to use, 19 to designate the person’s particular profession, but no other 20 person shall assume or use such title or abbreviation, and no 21 licensee shall advertise in such a manner as to lead the public 22 to believe that the licensee is engaged in the practice of any 23 other profession than the one which the licensee is licensed 24 to practice. 25 b. Any advertisement for services provided by a person 26 licensed to practice a profession under this subtitle shall 27 clearly identify the license held by the person advertising or 28 providing services, consistent with this subtitle. 29 2. A board shall require any person licensed to practice a 30 profession identified under section 147.74 to do the following 31 when directly engaging a member of the public in the practice 32 of the person’s profession: 33 a. Wear a form of identification consistent with rules 34 promulgated by the department in collaboration with each 35 -1- LSB 2137XC (2) 85 jr/sc 1/ 3
S.F. _____ applicable board, unless wearing identification creates a 1 safety or health risk. The rules shall establish uniform 2 minimum standards for identification. Minimum standards 3 shall include prominent display of the professional title and 4 abbreviation of the licensee as set forth in section 147.74. 5 b. If wearing identification creates a safety or health 6 risk, the licensee shall verbally disclose the license the 7 licensee holds. 8 3. Persons licensed pursuant to section 148.5 shall also 9 comply with the requirements of subsection 2 of this section 10 consistent with rules adopted by the board of medicine. 11 4. Failure of a licensee to comply with the requirements 12 set forth in subsection 2 and the rules adopted thereunder may 13 constitute a basis for board action against the licensee. 14 Sec. 3. Section 147.74, subsection 21, Code 2013, is amended 15 to read as follows: 16 21. An advanced registered nurse practitioner licensed 17 under chapter 152 may use the words “advanced registered nurse 18 practitioner” or the letters “A.R.N.P.” after the person’s 19 name. A registered nurse licensed under chapter 152 may use 20 the words “registered nurse” or the letters “R. N.” after the 21 person’s name. A licensed practical nurse licensed under 22 chapter 152 may use the words “licensed practical nurse” or the 23 letters “L. P. N.” after the person’s name. 24 EXPLANATION 25 This bill makes changes relating to licensure identification 26 and display and to professional title and abbreviation 27 restrictions for certain health-related professions. 28 The bill provides that a person recognized for licensure in 29 Iowa under the nursing compact in Code chapter 152E who has a 30 primary site of practice is required to display evidence of 31 current renewal of the license, in addition to the license. 32 The bill requires that any advertisement for services 33 provided by a person licensed in a health-related profession 34 clearly identify the license held by the person advertising or 35 -2- LSB 2137XC (2) 85 jr/sc 2/ 3
S.F. _____ providing services. 1 The bill requires persons licensed in health-related 2 professions whose professional title and abbreviation 3 is designated by Code section 147.74 to wear a form of 4 identification based on standards promulgated by rule by 5 the department of public health in collaboration with each 6 applicable licensing board. The bill also provides that this 7 requirement applies to resident physicians licensed under Code 8 section 148.5. 9 The bill also authorizes an advanced registered nurse 10 practitioner to use the words “advanced registered nurse 11 practitioner” or the acronym “A.R.N.P.”. Current law provides 12 that a person who fails to properly use the designations 13 specified in statute is guilty of a simple misdemeanor. A 14 simple misdemeanor is punishable by confinement for no more 15 than 30 days or a fine of at least $65 but not more than $625 16 or both. 17 -3- LSB 2137XC (2) 85 jr/sc 3/ 3
