Robbery
in
the
first
degree.

A
person
commits
robbery
in
the
first
degree
when,
while
4
perpetrating
a
robbery,
the
person
purposely
inflicts
or
5
attempts
to
inflict
serious
injury,
or
is
armed
with
a
6
dangerous
weapon
,
or
represents
oneself
to
be
in
possession
of
7
a
dangerous
weapon
.
Robbery
in
the
first
degree
is
a
class
“B”

felony.

EXPLANATION

This
bill
relates
to
robbery
in
the
first
degree.
Under
the
11
bill,
a
person
now
commits
robbery
in
the
first
degree
if
the
12
person,
while
perpetrating
a
robbery,
represents
oneself
to
13
be
in
possession
of
a
dangerous
weapon.
Robbery
in
the
first
14
degree
is
a
class
“B”
felony,
and
a
person
convicted
of
the
15
crime
must
serve
at
least
70
percent
of
the
maximum
term
of
the
16
person’s
sentence
under
Code
section
902.12.

Under
current
law,
if
a
person,
while
perpetrating
a
18
robbery,
represents
oneself
to
be
in
possession
of
a
dangerous
19
weapon,
the
person
commits
robbery
in
the
second
degree.
20
Robbery
in
the
second
degree
is
a
class
“C”
felony,
but
is
also
21
punishable
as
a
70
percent
sentence
under
Code
section
902.12.
22
A
class
“B”
felony
is
punishable
by
confinement
for
no
more
23
than
25
years.
A
class
“C”
felony
is
punishable
by
confinement
24
for
no
more
than
10
years
and
a
fine
of
at
least
$1,000
but
not
25
more
than
$10,000.
