S.F. _____ Section 1. Section 331.604, subsection 3, paragraph b, Code 1 2013, is amended to read as follows: 2 b. (1) For the period beginning July 1, 2004, and ending 3 June 30, 2009, the county recorder shall also collect a fee of 4 one dollar for each recorded transaction, regardless of the 5 number of pages, for which a fee is paid pursuant to subsection 6 1 to be used for the purpose set forth in paragraph “d” . 7 (2) For the period beginning July 1, 2009, and ending 8 June 30, 2011, the recorder shall also collect a fee of three 9 dollars for each recorded transaction, regardless of the number 10 of pages, for which a fee is paid pursuant to subsection 1 to be 11 used for the following purposes: 12 (a) Maintaining the statewide internet website and the 13 county land record information system. 14 (b) Integrating information contained in documents and 15 records maintained by the recorder and other land record 16 information from other sources with the county land record 17 information system. 18 (c) Implementing and maintaining a process for redacting 19 personally identifiable information contained in electronic 20 documents that are displayed for public access through an 21 internet website or that are transferred to another person. 22 (3) (1) Beginning July 1, 2011 2013 , the recorder shall 23 also collect a fee of one dollar two dollars for each recorded 24 transaction, regardless of the number of pages, for which a fee 25 is paid pursuant to subsection 1 to be used for the purposes in 26 subparagraph (2) and for the following purposes: 27 (a) Establishing and implementing standards for recording, 28 processing, and archiving electronic documents and records. 29 (b) Expanding access to records by encouraging electronic 30 indexing and scanning of documents and instruments recorded in 31 prior years. 32 (c) Maintaining the statewide internet site and the county 33 land record information system. 34 (d) Integrating information contained in documents and 35 -1- LSB 1437XC (1) 85 aw/sc 1/ 3
S.F. _____ records maintained by the recorder and other land record 1 information from other sources with the county land record 2 information system. 3 (e) Implementing and maintaining a process for redacting 4 personally identifiable information contained in electronic 5 documents that are displayed for public access through an 6 internet site or that are transferred to another person. 7 (f) Maintaining and improving the technical integration 8 between the county land record information system and the 9 county records management systems. 10 (g) Expanding access to other online electronic services 11 administered through the office of the county recorder. 12 (4) (2) Notwithstanding subparagraph (2), the The fee 13 collected by the recorder under this subsection for recording 14 a plat of survey is one dollar, regardless of the number of 15 pages. For purposes of this subparagraph, “plat of survey” 16 means the same as defined in section 355.1, subsection 9 . 17 (5) Fees collected in excess of the amount needed for the 18 purposes specified in this subsection shall be used by the 19 county land record information system to reduce or eliminate 20 service fees for electronic submission of documents and 21 instruments. 22 EXPLANATION 23 This bill requires that a county recorder collect an 24 extra $1 in fees beginning July 1, 2013, for each recorded 25 transaction to be used by the recorder exclusively for certain 26 specified purposes related to information systems, electronic 27 documentation, and internet site maintenance. The bill 28 also strikes language that required certain other fees to be 29 collected between 2004 and June 30, 2011, and transfers the 30 purposes for which the fees could be used to the provision 31 regarding fees collected beginning July 1, 2013. 32 Finally, the bill also adds certain additional purposes 33 for which the fee may be used, including expanding access to 34 electronic services and maintaining and improving technical 35 -2- LSB 1437XC (1) 85 aw/sc 2/ 3
