Section 231C.1, subsection 2, unnumbered 1 paragraph 1, Code 2013, is amended to read as follows: 2 The purposes of establishing an regulating assisted living 3 program programs include all of the following: 4 Sec. 2. Section 231C.2, subsection 2, Code 2013, is amended 5 to read as follows: 6 2. “Assisted living” means provision of housing 7 with services which may include but are not limited to 8 health-related care, personal care, and assistance with 9 instrumental activities of daily living to three or more 10 tenants in a physical structure which provides a homelike 11 environment. “Assisted living” also includes encouragement 12 of family involvement, tenant self-direction, and tenant 13 participation in decisions that emphasize choice, dignity, 14 privacy, individuality, shared risk, and independence. 15 “Assisted living” includes the provision of housing and 16 assistance with instrumental activities of daily living only 17 if personal care or health-related care is also included. 18 “Assisted living” includes access to on-site staff who are awake 19 twenty-four hours per day response staff to meet the tenant’s 20 scheduled and unscheduled or unpredictable needs , commensurate 21 with the tenant’s mental health, physical health, and cognitive 22 and functional status, in a manner that promotes maximum 23 dignity and independence and provides supervision, safety, and 24 security. 25 Sec. 3. Section 231C.3, subsection 1, Code 2013, is amended 26 by adding the following new paragraphs: 27 NEW PARAGRAPH . e. Requirements to ensure that the 28 nutritional needs of each tenant are met as reflected in the 29 tenant’s service plan. The rules shall require a program, at a 30 minimum, to provide one hot meal per day to all tenants and up 31 to three meals per day if required by a tenant. 32 NEW PARAGRAPH . f. Provisions relating to employment 33 qualifications for a program manager. 34 (1) The rules shall require that a program manager employed 35 -1- LSB 1647XS (2) 85 pf/nh 1/ 2
S.F. 90 after July 1, 2013, comply with all of the following: 1 (a) Have, at a minimum, a combination of three years of 2 education and experience related to older individuals. 3 (b) Within six months of employment, complete a course of 4 instruction in assisted living program management for which 5 the curriculum includes at least six hours of state-specific 6 training related to assisted living program laws and rules. 7 (2) The rules shall provide that a program manager employed 8 prior to July 1, 2013, is not subject to the requirements 9 specified in subparagraph (1), subparagraph division (b), 10 if the individual demonstrates prior completion of similar 11 training. 12 EXPLANATION 13 This bill includes provisions relating to assisted living 14 programs regulated pursuant to Code chapter 231C. 15 The bill amends the definition of “assisted living” to 16 provide that assisted living includes access to on-site, awake 17 staff 24 hours per day to meet the tenant’s needs, commensurate 18 with the tenant’s physical health, mental health, and cognitive 19 and functional status. 20 Provisions relating to rules regulating assisted living 21 programs are amended to include requirements to ensure that the 22 nutritional needs of each tenant are met as reflected in the 23 tenant’s service plan. The rules are to require a program, at 24 a minimum, to provide one hot meal per day to all tenants and up 25 to three meals per day if required by a tenant.
