Section
1.
NEW
SECTION
.
80B.11F
Public
safety
training
and
1
equipment
trust
fund.

1.
A
public
safety
training
and
equipment
trust
fund
is
3
created
in
the
state
treasury
under
the
control
of
the
council.
4
2.
The
trust
fund
shall
consist
of
moneys
deposited
in
5
the
fund
pursuant
to
section
432.1,
subsection
7,
and
any
6
other
devise,
gift,
bequest,
donation,
federal
or
other
grant,
7
reimbursement,
repayment,
judgment,
transfer,
payment,
or
8
appropriation
from
any
source
intended
to
be
used
for
the
9
purposes
of
the
trust
fund.
Of
the
moneys
deposited
in
the
10
trust
fund,
an
amount
equal
to
ten
percent
of
the
moneys
11
deposited,
or
such
lesser
amount
as
determined
by
the
council,
12
shall
be
allocated
to
a
capital
projects
account
for
the
13
purposes
of
public
safety
training
facility
needs.

3.
Moneys
credited
to
the
trust
fund
are
not
subject
to
15
section
8.33
and
shall
not
be
transferred,
used,
obligated,
16
appropriated,
or
otherwise
encumbered
except
as
provided
17
in
this
section
and
for
succeeding
fiscal
years
shall
18
remain
available
for
expenditure
for
purposes
of
the
fund.

Notwithstanding
section
12C.7,
subsection
2,
interest
or
20
earnings
on
moneys
deposited
in
the
trust
fund
shall
be
21
credited
to
the
trust
fund.
Moneys
shall
not
be
appropriated
22
or
expended
from
the
trust
fund
until
the
first
fiscal
year
23
following
the
fiscal
year
in
which
the
minimum
balance
of
the
24
trust
fund
reaches
eight
million
dollars.

4.
a.
Moneys
in
the
trust
fund
shall
be
used
for
public
26
safety
training
costs
incurred
by
the
state
or
a
political
27
subdivision
of
the
state
and
for
public
safety
personnel
28
equipment
costs,
excluding
vehicles,
incurred
by
the
state
or
a
29
political
subdivision
of
the
state,
subject
to
appropriation
by
30
the
general
assembly.
It
is
the
intent
of
the
general
assembly
31
that
all
training
costs
incurred
by
the
state
or
a
political
32
subdivision
be
reimbursed
from
moneys
in
the
trust
fund
and
33
that
such
remaining
moneys
in
the
trust
fund,
less
such
amount
34
needed
for
cash
flow
purposes
of
the
trust
fund,
be
used
to

Sec.
2.
Section
432.1,
Code
2013,
is
amended
by
adding
the
6
following
new
subsection:
7
NEW
SUBSECTION
.
7.
a.
Of
the
amount
of
premium
tax
8
receipts
collected
pursuant
to
subsection
3
for
the
2015
and
9
subsequent
calendar
years
and
deposited
in
the
general
fund
10
of
the
state,
the
department
of
revenue
shall
transfer
the
11
applicable
percent
of
such
amount
that
exceeds
the
amount
of
12
premium
tax
receipts
collected
pursuant
to
subsection
3
for
13
calendar
year
2013
to
the
public
safety
training
and
equipment
14
trust
fund
created
in
section
80B.11F.
15
b.
For
purposes
of
this
subsection,
“applicable
percent”
16
means
as
follows:
17
(1)
For
the
2015
through
2017
calendar
years,
one
hundred
18
percent.
19
(2)
For
the
2018
calendar
year,
seventy-five
percent.
20
(3)
For
the
2019
and
subsequent
calendar
years,
fifty
21
percent.

Sec.
3.
PUBLIC
SAFETY
TRAINING
AND
FACILITIES
TASK
FORCE.

1.
A
public
safety
training
and
facilities
task
force
is
24
established.
The
department
of
public
safety
shall
provide
25
administrative
support
for
the
task
force.
26
2.
The
task
force
shall
consist
of
the
following
members:
27
a.
One
member
appointed
by
the
Iowa
peace
officers
28
association.
29
b.
One
member
appointed
by
the
Iowa
state
sheriffs’
and
30
deputies’
association.
31
c.
One
member
appointed
by
the
Iowa
police
chiefs
32
association.
33
d.
One
member
who
is
a
fire
chief
appointed
by
the
Iowa
fire
34
chiefs
association.

The
members
of
the
task
force
shall
select
one
10
chairperson
and
one
vice
chairperson.
The
vice
chairperson

shall
preside
in
the
absence
of
the
chairperson.
Section
12
69.16A
shall
apply
to
the
appointed
members
of
the
task
force.

4.
The
task
force
shall
consider
and
develop
strategies
14
relating
to
public
safety
training
facility
governance
with
15
the
goal
of
all
public
safety
disciplines
being
represented.
16
Each
public
safety
discipline
shall
advise
the
task
force
by
17
developing
individual
training
policies
as
determined
by
the
18
discipline’s
governing
bodies.
The
task
force
shall
also
19
develop
a
proposal
for
a
joint
public
safety
training
facility,
20
a
budget
for
construction
and
future
operation
of
the
facility,
21
and
potential
locations
for
the
facility
that
are
centrally
22
located
in
this
state.

5.
a.
The
task
force
shall
provide
interim
reports
to
the
24
general
assembly
by
December
31
of
each
year
concerning
the
25
activities
of
the
task
force
and
shall
submit
its
final
report,
26
including
its
findings
and
recommendations,
to
the
general
27
assembly
by
December
31,
2016.
28
b.
The
final
report
shall
include
but
not
be
limited
to
29
recommendations
concerning
the
following:
30
(1)
Consolidation
of
public
safety
governance
within
a
31
single
board
and
the
membership
of
the
board.
32
(2)
Development
of
a
consolidated
fire
and
police
public
33
safety
training
facility,
including
possible
locations,
34
building
recommendations,
and
financing
options.

ADMINISTRATIVE
SUPPORT.
There
is
appropriated
from
the
general
6
fund
of
the
state
to
the
department
of
public
safety
for
the
7
fiscal
year
beginning
July
1,
2013,
and
ending
June
30,
2014,
8
the
following
amount,
or
so
much
thereof
as
is
necessary,
to
be
9
used
for
the
purposes
designated:

and
facilities
task
force
as
enacted
in
this
Act:

Notwithstanding
section
8.33,
moneys
appropriated
in
this
14
section
that
remain
unencumbered
or
unobligated
at
the
close
of
15
the
fiscal
year
shall
not
revert
but
shall
remain
available
for
16
expenditure
for
the
purposes
designated
until
the
close
of
the
17
fiscal
year
that
begins
July
1,
2016.

EXPLANATION
19
This
bill
concerns
public
safety
training
and
facilities.
20
The
bill
establishes
a
public
safety
training
and
equipment
21
trust
fund
under
the
control
of
the
Iowa
law
enforcement
22
academy
council.
The
trust
fund
shall
consist
of
moneys
23
deposited
in
the
fund
from
insurance
premiums
tax
receipts
as
24
provided
by
the
bill.
Of
the
moneys
deposited
in
the
fund,
10
25
percent,
or
such
lesser
amount
as
determined
by
the
council,
26
shall
be
allocated
to
a
capital
projects
account
of
the
trust
27
fund
and
shall
be
used
for
public
safety
facility
needs.
The
28
remaining
moneys
deposited
in
the
fund
shall
be
used
for
public
29
safety
training
costs
and
for
public
safety
personnel
equipment
30
costs,
excluding
vehicles,
all
incurred
by
the
state
or
a
31
political
subdivision
of
the
state,
subject
to
appropriation
32
by
the
general
assembly.
The
bill
provides
that
moneys
shall
33
not
be
appropriated
from
the
trust
fund
until
the
fiscal
year
34
following
the
year
the
balance
of
the
trust
fund
reaches
$8

million.
The
bill
provides
that
it
is
the
intent
of
the
1
general
assembly
that
training
costs
incurred
by
the
state
or
a
2
political
subdivision
be
fully
reimbursed
from
moneys
in
the
3
fund
and
that
the
remaining
moneys
in
the
fund,
less
an
amount
4
needed
for
cash
flow
purposes,
be
used
to
reimburse
public
5
safety
personnel
equipment
costs,
except
vehicles.
Moneys
in
6
the
fund
shall
not
revert
to
the
general
fund
of
the
state,
and
7
interest
and
earnings
on
moneys
in
the
fund
shall
remain
in
the
8
fund.

Code
section
432.1,
concerning
tax
on
gross
insurance
10
premiums,
is
amended
to
provide
that
the
applicable
percent
of
11
the
moneys
collected
from
premium
tax
receipts
on
insurance
12
policies,
other
than
life
insurance
policies,
in
excess
of
the
13
amount
collected
for
calendar
year
2013,
shall
be
transferred
14
to
the
public
safety
training
and
equipment
trust
fund
created
15
by
the
bill
beginning
with
premium
tax
receipts
received
during
16
calendar
year
2015.
The
bill
provides
that
the
applicable
17
percent
for
calendar
years
2015
through
2017
shall
be
100
18
percent,
for
calendar
year
2018,
75
percent,
and
for
subsequent
19
calendar
years,
50
percent.
20
The
bill
also
establishes
a
public
safety
training
and
21
facilities
task
force.
The
department
of
public
safety
shall
22
provide
administrative
support
for
the
task
force
and
the
23
bill
appropriates
moneys
to
the
department
for
providing
24
this
support.
The
bill
specifies
the
membership
of
the
task
25
force
and
provides
that
the
task
force
shall
consider
and
26
develop
strategies
relating
to
public
safety
training
facility
27
governance
with
the
goal
of
all
public
safety
disciplines
28
being
represented.
Each
public
safety
discipline
shall
advise
29
the
task
force
by
developing
individual
training
policies
as
30
determined
by
the
discipline’s
governing
bodies.
The
bill
31
requires
the
task
force
to
provide
interim
reports
to
the
32
general
assembly
by
December
31
of
each
year
and
to

final

including
its

distribution
of
moneys
from
the

and
equipment
trust
fund,
and
any

other
recommendations
relating
to
public
safety
training
and

facilities
requirements.
