There is appropriated 3 from the general fund of the state to the department of 4 education for the fiscal year beginning July 1, 2013, and 5 ending June 30, 2014, the following amount, or so much thereof 6 as is necessary, to be used for the purposes designated: 7 1. Section 256.9, Code 2013, is amended by adding the 14 following new subsection: 15 NEW SUBSECTION . 63. Administer the workforce training 16 and economic development funds created pursuant to section 17 260C.18A. 18 Sec. 3. Section 256.40, Code 2013, is amended to read as 19 follows: 20 256.40 Statewide work-based learning intermediary network —— 21 fund —— steering committee —— regional networks. 22 1. A statewide work-based learning intermediary network 23 program is established in the department and shall be 24 administered by the department. A separate, statewide 25 work-based learning intermediary network fund is created in the 26 state treasury under the control of the department. The fund 27 shall consist of all moneys deposited in the fund, including 28 any moneys appropriated by the general assembly and any other 29 moneys available to and obtained or accepted by the department 30 from federal or private sources for purposes of the program. 31 Notwithstanding section 8.33 , moneys in the fund at the end 32 of a fiscal year shall not revert to the general fund of the 33 state. Notwithstanding section 12C.7, subsection 2 , interest 34 or earnings on moneys in the fund shall be credited to the 35 -2- LSB 2138SZ (2) 85 je/rj 2/ 14
S.F. 429 fund. 1 2. The purpose of the program shall be to build a seamless 2 career, future workforce, and economic development system in 3 Iowa to accomplish all of the following prepare students for 4 the workforce by connecting business and the education system 5 and offering relevant, work-based learning activities to 6 students and teachers. The program shall : 7 a. Better prepare students to make informed postsecondary 8 education and career decisions. 9 b. Provide communication and coordination in order to build 10 and sustain relationships between employers and local youth, 11 the education system, and the community at large. 12 c. Connect students to local career opportunities, creating 13 economic capital for the region using a skilled and available 14 workforce. 15 d. Facilitate the sharing of best practices statewide by 16 business and education leaders. 17 e. d. Provide a one-stop contact point for information 18 useful to both educators and employers, including a state-level 19 clearinghouse for information on internships, job shadowing 20 experiences, and other workplace learning opportunities 21 for students that are linked to the state’s economic goals 22 students, particularly related to science, technology, 23 engineering, or mathematics occupations, occupations related 24 to critical infrastructure and commercial and residential 25 construction, or targeted industries as defined in section 26 15.102 . 27 f. Implement services for all students, staff, and districts 28 within the region and integrate workplace skills into the 29 curriculum. 30 e. Integrate services provided through the program with 31 other career exploration-related activities such as the 32 student core curriculum plan and the career information and 33 decision-making system developed and administered under section 34 279.61, where appropriate. 35 -3- LSB 2138SZ (2) 85 je/rj 3/ 14
S.F. 429 f. Facilitate the attainment of portable credentials of 1 value to employers such as the national career readiness 2 certificate, where appropriate. 3 g. Develop work-based capacity with employers. 4 h. Improve the skills of Iowa’s future workforce. 5 i. h. Provide core services, which may include student job 6 shadowing, student internships, and teacher or student tours. 7 3. The department shall establish and facilitate a steering 8 committee comprised of representatives from the department of 9 workforce development, the economic development authority, 10 the community colleges, the institutions under the control of 11 the state board of regents, accredited private institutions, 12 area education agencies, school districts, and the workplace 13 learning connection. The steering committee shall be 14 responsible for the development and implementation of the 15 statewide work-based learning intermediary network. 16 4. The steering committee shall develop a design for a 17 statewide network comprised of fifteen regional work-based 18 learning intermediary networks. The design shall include 19 network specifications, strategic functions, and desired 20 outcomes. The steering committee shall recommend program 21 parameters and reporting requirements to the department. 22 5. Each regional network shall establish an advisory 23 council to develop and implement provide advice and assistance 24 to the regional network. The advisory council shall 25 include representatives of business and industry, including 26 construction trade industry professionals, and shall meet at 27 least annually. 28 6. Each regional network or consortium of networks shall 29 annually submit a work-based learning plan to the department. 30 Each plan shall include provisions to provide core services 31 referred to in subsection 2, paragraph “h” , to all school 32 districts within the region and for the integration of job 33 shadowing and other work-based learning activities into 34 secondary career and technical education programs. 35 -4- LSB 2138SZ (2) 85 je/rj 4/ 14

Funds Moneys deposited in the statewide 1 work-based learning intermediary network fund created in 2 subsection 1 shall be distributed annually to each region 3 for the implementation of the statewide work-based learning 4 intermediary network based upon the distribution of the 5 kindergarten through grade twelve student enrollments in each 6 region. The amount shall not exceed three dollars per student 7 upon approval by the department of the region’s work-based 8 learning plan submitted pursuant to subsection 6 . 9 b. If the balance in the statewide work-based learning 10 intermediary network fund on July 1 of a fiscal year is one 11 million five hundred thousand dollars or less, the department 12 shall distribute moneys in the fund to regions or consortium 13 of regions on a competitive basis. If the balance in the 14 statewide work-based learning intermediary network fund on July 15 1 of a fiscal year is greater than one million five hundred 16 thousand dollars, the department shall distribute one hundred 17 thousand dollars to each region and distribute the remaining 18 moneys pursuant to the formula established in section 260C.18C. 19 7. 8. The department shall provide oversight of the 20 statewide work-based learning intermediary network and shall 21 annually evaluate the statewide and regional network progress 22 toward the outcomes identified by the steering committee 23 pursuant to subsection 4 . The department shall require each 24 region to submit an annual report on its ongoing implementation 25 of the statewide work-based learning intermediary network 26 program to the department. 27 8. 9. Each regional network shall match the funds moneys 28 received pursuant to subsection 6 7 with financial resources 29 equal to at least twenty-five percent of the amount of 30 the funds moneys received pursuant to subsection 6 7 . The 31 financial resources used to provide the match may include 32 private donations, in-kind contributions, or public funds 33 moneys other than the funds moneys received pursuant to 34 subsection 6 7 . 35 -5- LSB 2138SZ (2) 85 je/rj 5/ 14
S.F. 429 10. The state board of education shall adopt rules under 1 chapter 17A for the administration of this section. 2 Sec. 4. Section 260C.18A, subsection 1, paragraph b, Code 3 2013, is amended to read as follows: 4 b. Moneys in the funds shall consist of any moneys 5 appropriated by the general assembly and any other moneys 6 available to and obtained or accepted by the economic 7 development authority department from federal sources or 8 private sources for placement in the funds. Notwithstanding 9 section 8.33 , moneys in the funds at the end of each fiscal 10 year shall not revert to any other fund but shall remain in the 11 funds for expenditure in subsequent fiscal years. 12 Sec. 5. Section 260C.18A, subsection 2, paragraph c, Code 13 2013, is amended to read as follows: 14 c. For the development and implementation of career 15 academies designed to provide new career preparation 16 opportunities for high school students that are formally 17 linked with postsecondary career and technical education 18 programs. For purposes of this section , “career academy” 19 means a program of study that combines a minimum of two 20 years of secondary education with an associate degree, or the 21 equivalent, career preparatory program in a nonduplicative, 22 sequential course of study that is standards based, integrates 23 academic and technical instruction, utilizes work-based and 24 worksite learning where appropriate and available, utilizes an 25 individual career planning process with parent involvement, 26 and leads to an associate degree or postsecondary diploma or 27 certificate in a career field that prepares an individual 28 for entry and advancement in a high-skill and reward career 29 field and further education. The economic development 30 authority state board , in conjunction with the state board of 31 education and the division of community colleges and workforce 32 preparation of the department of education, shall adopt 33 administrative rules for the development and implementation of 34 such career academies pursuant to section 256.11, subsection 35 -6- LSB 2138SZ (2) 85 je/rj 6/ 14
S.F. 429 5 , paragraph “h” , section 260C.1 , and Tit. II of Pub. L. No. 1 105-332, Carl D. Perkins Vocational and Technical Education Act 2 of 1998. 3 Sec. 6. Section 260C.18A, subsection 2, paragraph e, Code 4 2013, is amended by striking the paragraph. 5 Sec. 7. Section 260C.18A, subsection 3, Code 2013, is 6 amended to read as follows: 7 3. The economic development authority department shall 8 allocate the moneys appropriated pursuant to this section 9 to the community college workforce training and economic 10 development funds utilizing the same distribution formula 11 used for the allocation of state general aid to the community 12 colleges. 13 Sec. 8. Section 260C.18A, subsection 4, paragraph d, Code 14 2013, is amended to read as follows: 15 d. Annually submit the two-year plan and progress report 16 to the economic development authority department in a manner 17 prescribed by rules adopted by the department pursuant to 18 chapter 17A . 19 Sec. 9. NEW SECTION . 260C.50 Adult education and literacy 20 programs. 21 1. For purposes of this section, “adult education and 22 literacy programs” means adult basic education, adult education 23 leading to a high school equivalency diploma under chapter 24 259A, English as a second language instruction, workplace and 25 family literacy instruction, or integrated basic education and 26 technical skills instruction. 27 2. The department and the community colleges shall jointly 28 implement adult education and literacy programs to assist 29 adults and youths sixteen years of age and older who are not 30 in school in obtaining the knowledge and skills necessary for 31 further education, work, and community involvement. 32 3. The state board, in consultation with the community 33 colleges, shall prescribe standards for adult education and 34 literacy programs including but not limited to contextualized 35 -7- LSB 2138SZ (2) 85 je/rj 7/ 14
S.F. 429 and integrated instruction, assessments, instructor 1 qualification and professional development, data collection and 2 reporting, and performance benchmarks. 3 4. The state board, in consultation with the community 4 colleges, shall adopt rules pursuant to chapter 17A to 5 administer this section. 6 Sec. 10. Section 260H.2, Code 2013, is amended to read as 7 follows: 8 260H.2 Pathways for academic career and employment program 9 —— fund . 10 1. A pathways for academic career and employment program 11 is established to provide funding to community colleges for 12 the development of projects in coordination with the economic 13 development authority, the department of education, the 14 department of workforce development, regional advisory boards 15 established pursuant to section 84A.4 , and community partners 16 to implement a simplified, streamlined, and comprehensive 17 process, along with customized support services, to enable 18 eligible participants to acquire effective academic and 19 employment training to secure gainful, quality, in-state 20 employment. 21 2. a. A pathways for academic career and employment fund 22 is created for the community colleges in the state treasury to 23 be administered by the department of education. The moneys 24 in the pathways for academic career and employment fund are 25 appropriated to the department of education for the pathways 26 for academic career and employment program. 27 b. The aggregate total of grants awarded from the pathways 28 for academic career and employment fund during a fiscal year 29 shall not be more than five million dollars. 30 c. Moneys in the fund shall be allocated pursuant to the 31 formula established in section 260C.18C. Notwithstanding 32 section 8.33, moneys in the fund at the close of the fiscal 33 year shall not revert to the general fund of the state but 34 shall remain available for expenditure for the purpose 35 -8- LSB 2138SZ (2) 85 je/rj 8/ 14
S.F. 429 designated for subsequent fiscal years. Notwithstanding 1 section 12C.7, subsection 2, interest or earnings on moneys in 2 the fund shall be credited to the fund. 3 Sec. 11. Section 260H.3, subsection 1, paragraph b, Code 4 2013, is amended to read as follows: 5 b. Persons earning incomes at or below two hundred fifty 6 percent of the federal poverty level as defined by the most 7 recently revised poverty income guidelines published by the 8 United States department of health and human services. 9 Sec. 12. Section 260H.4, subsection 2, paragraph b, Code 10 2013, is amended by adding the following new subparagraph: 11 NEW SUBPARAGRAPH . (5) Any other industry designated as 12 in-demand by a regional advisory board established pursuant to 13 section 84A.4. 14 Sec. 13. Section 260H.4, subsection 2, paragraph c, Code 15 2013, is amended by striking the paragraph. 16 Sec. 14. NEW SECTION . 260H.7A Pathway navigators. 17 1. A community college may use moneys for the pathways 18 for academic career and employment program to employ pathway 19 navigators to assist students applying for or enrolled in 20 eligible pathways for academic career and employment projects. 21 2. Pathway navigators shall provide services and support 22 to aid students in selecting pathways for academic career and 23 employment projects that will result in gainful, quality, 24 in-state employment and to ensuring students are successful 25 once enrolled in pathways for academic career and employment 26 projects. Services the pathway navigators may provide include 27 but are not limited to the following: 28 a. Interviewing and selecting students for enrollment in 29 pathways for academic career and employment projects. 30 b. Assessing students’ skills, interests, and previous 31 academic and work experience for purposes of placement in 32 pathways for academic career and employment projects. 33 c. Working with students to develop academic and career 34 plans and to adjust such plans as needed. 35 -9- LSB 2138SZ (2) 85 je/rj 9/ 14
S.F. 429 d. Assisting students in applying for and receiving 1 resources for financial aid and other forms of tuition 2 assistance. 3 e. Assisting students with the admissions process, remedial 4 education, academic credit transfer, meeting assessment 5 requirements, course registration, and other procedures 6 necessary for successful completion of pathways for academic 7 career and employment projects. 8 f. Assisting in identifying and resolving obstacles to 9 students’ successful completion of pathways for academic career 10 and employment projects. 11 g. Connecting students with useful college resources 12 or outside support services such as access to child care, 13 transportation, and tutorial assistance, as needed. 14 h. Maintaining ongoing contact with students enrolled 15 in pathways for academic career and employment projects and 16 ensuring students are making satisfactory progress toward the 17 successful completion of projects. 18 i. Providing support to students transitioning from remedial 19 education, short-term training, and classroom experience to 20 employment. 21 j. Coordinating activities with community-based 22 organizations that serve as key recruiters for pathways for 23 academic career and employment projects and assisting students 24 throughout the recruitment process. 25 k. Coordinating adult basic education services. 26 Sec. 15. NEW SECTION . 260H.7B Regional industry sector 27 partnerships. 28 1. A community college may use moneys for the pathways for 29 academic career and employment program to provide staff and 30 support for the development and implementation of regional 31 industry sector partnerships within the region served by the 32 community college. 33 2. Regional, industry sector partnerships may include but 34 are not limited to the following activities: 35 -10- LSB 2138SZ (2) 85 je/rj 10/ 14

Bringing together representatives from industry sectors, 1 government, education, local workforce boards, community-based 2 organizations, labor, economic development organizations, 3 and other stakeholders within the regional labor market to 4 determine how pathways for academic career and employment 5 projects should address workforce skills gaps, occupational 6 shortages, and wage gaps. 7 b. Integrating pathways for academic career and employment 8 projects and other existing supply-side strategies with 9 workforce needs within the region served by the community 10 college. 11 c. Developing pathways for academic career and employment 12 projects that focus on the workforce skills, from entry level 13 to advanced, required by industry sectors within the region 14 served by the community college. 15 Sec. 16. Section 260I.4, subsection 6, Code 2013, is amended 16 to read as follows: 17 6. Eligibility for tuition assistance under this chapter 18 shall be limited to persons earning incomes at or below 19 two hundred fifty percent of the federal poverty level as 20 defined by the most recently revised poverty income guidelines 21 published by the United States department of health and human 22 services. 23 Sec. 17. Section 260I.5, Code 2013, is amended by adding the 24 following new subsection: 25 NEW SUBSECTION . 5. Costs of providing direct staff 26 support services including but not limited to marketing, 27 outreach, application, interview, and assessment processes. 28 Eligible costs for this purpose shall be limited to twenty 29 percent of any allocation of moneys to the two smallest 30 community colleges, ten percent of any allocation of moneys 31 to the two largest community colleges, and fifteen percent of 32 any allocation of moneys to the remaining eleven community 33 colleges. Community college size shall be determined based on 34 the most recent three-year rolling average full-time equivalent 35 -11- LSB 2138SZ (2) 85 je/rj 11/ 14
S.F. 429 enrollment. 1 EXPLANATION 2 This bill relates to workforce training programs, including 3 making appropriations for workforce training programs for 4 fiscal year 2013-2014. The bill is organized into divisions. 5 FY 2013-2014 WORKFORCE TRAINING APPROPRIATIONS. The bill 6 appropriates moneys from the general fund of the state to the 7 department of education for deposit in the statewide work-based 8 learning intermediary network fund established pursuant to Code 9 section 256.40. 10 The bill appropriates moneys from the general fund of 11 the state to the department of education for deposit in the 12 workforce training and economic development funds created 13 pursuant to Code section 260C.18A. 14 The bill appropriates moneys from the general fund of 15 the state to the department of education for deposit in the 16 pathways for academic career and employment fund established 17 pursuant to Code section 260H.2. 18 The bill appropriates moneys from the general fund of 19 the state to the department of education for distribution to 20 community colleges for implementation of adult education and 21 literacy programs provided for in the bill. 22 The bill appropriates moneys from the general fund of the 23 state to the department of education for distribution of grants 24 to be awarded to community colleges for the purpose of adult 25 basic education programs for students requiring instruction in 26 English as a second language. The bill requires the department 27 to establish an application process and criteria for the 28 awarding of grants and provides for certain required criteria. 29 The bill appropriates moneys from the general fund of the 30 state to the department of education for implementation of 31 adult education and literacy programs provided for in the bill. 32 The bill appropriates moneys from the general fund of the 33 state to the department of education for administration of 34 the workforce training and economic development funds created 35 -12- LSB 2138SZ (2) 85 je/rj 12/ 14
S.F. 429 pursuant to Code section 260C.18A. 1 WORKFORCE TRAINING PROGRAMS. The bill provides that the 2 department of education will administer the workforce training 3 and economic development funds created pursuant to Code section 4 260C.18A. Under current law, the funds are administered by the 5 economic development authority. 6 The bill makes various changes to the statewide work-based 7 learning intermediary network program under Code section 8 256.40, including modifying the purposes of the program and 9 the duties of the steering committee, regional networks, and 10 regional advisory councils for the program; establishing 11 requirements for the distribution of funds in the statewide 12 work-based learning intermediary network fund; establishing 13 annual planning and reporting requirements; and establishing 14 rulemaking authority for the program. 15 The bill directs the department of education and the 16 community colleges to jointly implement adult education 17 and literacy programs to assist adults and youths 16 years 18 of age and older who are not in school in obtaining the 19 knowledge and skills necessary for further education, work, 20 and community involvement. The bill provides for standards 21 for such programs. The bill defines “adult education and 22 literacy programs” as adult basic education, adult education 23 leading to a high school equivalency diploma under Code chapter 24 259A, English as a second language instruction, workplace and 25 family literacy instruction, or integrated basic education and 26 technical skills instruction. 27 The bill makes various changes to the pathways for academic 28 career and employment program under Code chapter 260H. The 29 bill establishes a pathways for academic career and employment 30 fund in the state treasury for the community colleges to be 31 administered by the department of education. Moneys in the 32 fund shall be allocated pursuant to the formula established 33 in Code section 260C.18C. The bill makes changes relating 34 to eligibility criteria for the program. S.F. 429 that funds for the program can be used by community colleges 1 to employ pathway navigators to provide various services to 2 aid students in selecting pathways for academic career and 3 employment projects that will result in gainful, quality, 4 in-state employment and to ensure students are successful once 5 enrolled in such projects. The bill provides that funds for 6 the program can be used by community colleges to establish 7 regional industry sector partnerships. Partnerships may 8 include various activities to further the ability of pathways 9 for academic career and employment projects to meet the 10 workforce needs of industry sectors within the region served 11 by a community college. 12 The bill makes changes to the gap tuition assistance program 13 under Code chapter 260I.
