1.
Section
147.72,
Code
2013,
is
amended
to
read
as
1
follows:

147.72
Professional
titles
and
abbreviations.
3
1.
a.
Any
person
licensed
to
practice
a
profession
under
4
this
subtitle
may
append
to
the
person’s
name
any
recognized
5
title
or
abbreviation,
which
the
person
is
entitled
to
use,
6
to
designate
the
person’s
particular
profession,
but
no
other
7
person
shall
assume
or
use
such
title
or
abbreviation,
and
no
8
licensee
shall
advertise
in
such
a
manner
as
to
lead
the
public
9
to
believe
that
the
licensee
is
engaged
in
the
practice
of
any
10
other
profession
than
the
one
which
the
licensee
is
licensed
11
to
practice.

b.
Any
advertisement
for
services
provided
by
a
person
13
licensed
to
practice
a
profession
under
this
subtitle
shall
14
clearly
identify
the
license
held
by
the
person
advertising
or
15
providing
services,
consistent
with
this
subtitle.

2.
A
board
shall
require
any
person
licensed
to
practice
a
17
profession
identified
under
section
147.74
to
do
the
following
18
when
directly
engaging
a
member
of
the
public
in
a
clinical
19
setting
in
the
practice
of
the
person’s
profession:
20
a.
Wear
a
form
of
identification
consistent
with
rules
21
promulgated
by
each
applicable
board,
except
if
wearing
22
identification
creates
a
safety
or
health
risk,
or
in
23
situations
when
voluntarily
and
gratuitously
responding
to
a
24
need
for
health
care
created
by
an
emergency
or
a
state
or
25
local
disaster.
The
rules
shall
establish
uniform
minimum
26
standards
for
identification.
Minimum
standards
shall
include
27
prominent
display
of
the
professional
title
and
abbreviation
of
28
the
licensee
as
set
forth
in
section
147.74.
29
b.
If
wearing
identification
creates
a
safety
or
health
30
risk,
or
in
situations
when
voluntarily
and
gratuitously
31
responding
to
a
need
for
health
care
created
by
an
emergency
or
32
a
state
or
local
disaster,
the
licensee
shall
verbally
disclose
33
the
license
the
licensee
holds.
34
3.
Persons
licensed
pursuant
to
section
148.5
shall
also

comply
with
the
requirements
of
subsection
2
of
this
section
1
consistent
with
rules
adopted
by
the
board
of
medicine.

4.
Failure
of
a
licensee
to
comply
with
the
requirements
3
set
forth
in
subsection
2
and
the
rules
adopted
thereunder
may
4
constitute
a
basis
for
board
action
against
the
licensee.

subsection
21,
Code
2013,
is
amended

to
read
as
follows:

An
advanced
registered
nurse
practitioner
practicing
8
pursuant
to
rules
adopted
by
the
board
and
licensed
as
a

registered
nurse
under
chapter
152
may
use
the
words
“advanced
10
registered
nurse
practitioner”
or
the
letters
“A.R.N.P.”
after
11
the
person’s
name.
A
registered
nurse
licensed
under
chapter
12
152
may
use
the
words
“registered
nurse”
or
the
letters
“R.
N.”
13
after
the
person’s
name.
A
licensed
practical
nurse
licensed
14
under
chapter
152
may
use
the
words
“licensed
practical
nurse”

after
the
person’s
name.

EXPLANATION
17
This
bill
makes
changes
relating
to
licensure
identification
18
and
display
and
to
professional
title
and
abbreviation
19
restrictions
for
certain
health-related
professions.

The
bill
requires
that
any
advertisement
for
services
21
provided
by
a
person
licensed
in
a
health-related
profession
22
clearly
identify
the
license
held
by
the
person
advertising
or
23
providing
services.
24
The
bill
requires
persons
licensed
in
health-related
25
professions
whose
professional
title
and
abbreviation
26
is
designated
by
Code
section
147.74
to
wear
a
form
of
27
identification
based
on
standards
promulgated
by
rule
by
each
28
applicable
licensing
board
unless
wearing
the
identification
29
creates
a
safety
or
health
risk
or
if
the
person
is
responding
30
gratuitously
to
an
emergency
or
disaster.
The
bill
also
31
provides
that
this
requirement
applies
to
resident
physicians
32
licensed
under
Code
section
148.5.
33
The
bill
also
authorizes
an
advanced
registered
nurse
34
practitioner
to
use
the
words
“advanced
registered
nurse
35

practitioner”
or
the
acronym
“A.R.N.P.”.
Current
law
provides
1
that
a
person
who
fails
to
properly
use
the
designations
2
specified
in
statute
is
guilty
of
a
simple
misdemeanor.
A
3
simple
misdemeanor
is
punishable
by
confinement
for
no
more
4
than
30
days
or
a
fine
of
at
least
$65
but
not
more
than
$625
5
or
both.
