Section
1.
Section
135.11,
subsection
24,
Code
2013,
is
1
amended
by
striking
the
subsection
and
inserting
in
lieu
2
thereof
the
following:
3
24.
a.
Establish
requirements
for
the
curricula
and
4
perform
the
review
and
approval
for
mandatory
reporter
5
training
curricula
for
those
persons
who
work
in
a
position
6
classification
that
under
law
makes
the
persons
mandatory
7
reporters
of
child
or
dependent
adult
abuse
and
the
position
8
classification
does
not
have
a
mandatory
reporter
training
9
curriculum
approved
by
a
licensing
or
examining
board.
The
10
department
may
convene
a
stakeholder
group
which
includes
11
representatives
from
the
departments
of
education,
human
12
services,
and
public
safety,
as
necessary
to
make
revisions
to
13
the
curricula.

Establish
requirements
for
trainers
for
the
interactive
15
training
requirement
for
mandatory
reporters
and
perform
16
the
review
and
approval
of
the
trainers
for
the
interactive
17
training
requirement
for
mandatory
reporters
provided
in

Sec.
2.
Section
232.69,
subsection
3,
paragraph
b,
Code

2013,
is
amended
to
read
as
follows:

b.
(1)
A
person
required
to
make
a
report
under
subsection
22
1
,
other
than
a
physician
whose
professional
practice
does
23
not
regularly
involve
providing
primary
health
care
to
24
children,
shall
complete
two
hours
of
training
relating
to
25
the
identification
and
reporting
of
child
abuse
within
six
26
months
of
initial
employment
or
self-employment
involving
the
27
examination,
attending,
counseling,
or
treatment
of
children
28
on
a
regular
basis.
29
(2)
Within
one
month
of
initial
employment
or
30
self-employment,
the
person
shall
obtain
a
statement
of
the
31
abuse
reporting
requirements
from
the
person’s
employer
or,
if
32
self-employed,
from
the
department.
33
(3)
Between
twenty-four
and
thirty-six
months
after
initial
34
employment
or
self-employment,
the
person
shall
complete
ninety

minutes
of
interactive
training
for
mandatory
reporters.

However,
if
the
person
obtains
subsequent
employment
prior
2
to
completing
the
interactive
training,
and
the
person’s
3
subsequent
employment
is
substantially
similar
or
the
4
person
has
the
same
job
responsibilities
and
the
subsequent
5
employer
requires
the
person
to
complete
two
hours
of
training
6
within
six
months
of
the
subsequent
employment
pursuant
to
7
subparagraph
(1),
the
person
shall
complete
the
interactive
8
training
between
twenty-four
to
thirty-six
months
after
initial
9
employment
at
the
subsequent
employment.
The
person
shall
10
also
complete
the
interactive
training
between
twenty-four
to
11
thirty-six
months
after
initial
employment
at
the
subsequent
12
employment
when
the
person
obtains
subsequent
employment
prior
13
to
completing
the
interactive
training,
and
the
person’s
14
subsequent
employment
is
not
substantially
similar.
The
15
trainers
for
the
interactive
training
for
mandatory
reporters
16
shall
be
approved
by
the
department
of
public
health
pursuant
17
to
section
135.11,
subsection
24.
18
(4)
The
person
shall
complete
at
least
two
hours
19
of
additional
child
abuse
identification
and
reporting
20
training
,
not
including
the
interactive
training
described
in
21
subparagraph
(3),
every
five
years
after
the
date
of
initial
22
employment
or
self-employment
and
every
five
years
thereafter
.

subsection

paragraph

person
may
complete
the
initial

interactive,

training

read
as

person

complete
both
child
abuse
and

dependent
adult
abuse
mandatory
reporter
training
may
complete

the
training
through
a
program
which
combines
child
abuse
9
and
dependent
adult
abuse
curricula
and
thereby
meet
the
10
training
requirements
of
both
this
subsection
and
section
11
232.69
simultaneously.
A
person
who
is
a
mandatory
reporter
12
for
both
child
abuse
and
dependent
adult
abuse
may
satisfy
the
13
combined
training
requirements
of
this
subsection
and
section
14
232.69
through
completion
of
a
two-hour
training
program,
if
15
the
training
program
curriculum
is
approved
by
the
appropriate
16
licensing
board
or
the
abuse
education
review
panel
established
17
by
the
director
department
of
public
health
pursuant
to
section
18
135.11
.

Sec.
7.
RULES.
The
department
of
public
health
shall
adopt
20
rules
to
implement
the
provisions
of
this
Act.
21
Sec.
8.
APPLICABILITY.
The
section
of
this
Act
amending
22
section
232.69,
subsection
3,
paragraph
“b”,
applies
to
a
23
person
required
to
make
a
child
abuse
report
who
begins
initial
24
employment
or
self-employment
on
or
after
July
1,
2013.
25
EXPLANATION
26
This
bill
relates
to
mandatory
child
abuse
and
dependent
27
adult
abuse
reporter
training.
The
bill
eliminates
the
abuse
28
education
review
panel,
a
panel
established
by
the
department
29
of
public
health.
The
abuse
education
review
panel
was
30
established
to
review
and
approve
mandatory
reporter
training
31
curricula.
The
bill
instead
transfers
this
responsibility
32
to
the
department
of
public
health
and
also
requires
the
33
department
to
review
and
approve
trainers
for
the
new
34
interactive
training
requirement
for
mandatory
reporters
of
35

child
abuse.
The
bill
also
provides
that
the
department
of
1
public
health
may
convene
a
group
of
stakeholders
to

The
bill
adds
an
additional
one-time
training
requirement

for
mandatory
reporters
of
child
abuse.
Between
24
and
36
5
months
after
initial
employment
or
self-employment,
a
mandatory

reporter
must
complete
a
90-minute
interactive
training.
The
7
bill
requires
the
department
of
public
health
to
approve
the
8
trainers
for
this
interactive
training.
The
other
training
9
requirements
for
mandatory
reporters
of
child
abuse
remain
the
10
same
under
the
bill.

The
bill
states
that
the
interactive
training
requirement
12
applies
to
mandatory
reporters
of
child
abuse
who
begin
initial
13
employment
or
self-employment
on
or
after
July
1,
2013.
