Section 232.2, Code 2013, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 46A. “Relative” for purposes of divisions 3 III and IV of this chapter includes the parent of a sibling. 4 Sec. 2. Section 232.84, subsection 2, Code 2013, is amended 5 to read as follows: 6 2. Within thirty days after the entry of an order under 7 this chapter transferring custody of a child to an agency 8 for placement, the agency shall exercise due diligence in 9 identifying and providing notice to the child’s grandparents, 10 aunts, uncles, adult siblings, parents of the child’s siblings, 11 and adult relatives suggested by the child’s parents, subject 12 to exceptions due to the presence of family or domestic 13 violence. 14 EXPLANATION 15 This bill relates to the use of the term “relative” in 16 child in need of assistance and termination of parental rights 17 proceedings. The bill states that “relative” for purposes 18 of child in need of assistance and termination of parental 19 rights proceedings includes the parent of a child’s sibling. 20 The bill also requires the department of human services to 21 provide notice to parents of a child’s siblings within 30 days 22 of an order in a child in need of assistance proceeding that 23 transfers custody of the child to the department of human 24 services, juvenile court services, or a private agency for 25 placement. 26 -1- LSB 2363XS (2) 85 ad/nh 1/ 1
