S.F. 2275 Section 1. NEW SECTION . 136D.3A Minors’ use of tanning 1 devices prohibited. 2 A tanning facility shall not allow a person under eighteen 3 years of age to use a tanning device. 4 Sec. 2. Section 136D.4, subsection 1, paragraphs a and b, 5 Code 2014, are amended to read as follows: 6 a. A warning sign in a conspicuous location without 7 obstruction and readily visible to persons entering the 8 establishment. The signs shall comply with rules adopted by 9 the department. 10 b. A warning sign for each tanning device, in a conspicuous 11 location without obstruction and readily visible to a person 12 preparing to use the device. The sign shall comply with rules 13 adopted by the department. 14 Sec. 3. Section 136D.4, subsection 2, Code 2014, is amended 15 to read as follows: 16 2. A tanning facility shall provide each customer prior to 17 use of a tanning device with a written warning statement that 18 complies with rules adopted by the department. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill relates to tanning facilities and creates new Code 23 section 136D.3A prohibiting a tanning facility from allowing 24 individuals under 18 years of age to use a tanning device. The 25 bill also provides that warning signs be free from obstruction 26 and that a written warning statement be provided to each 27 customer prior to use of a tanning device. 28 A tanning facility that violates a provision of Code chapter 29 136D is subject to a civil penalty and injunctive relief. 30 -1- LSB 5346SV (1) 85 jb/rj 1/ 1
