S.F. 2269 Section 1. Section 257.11, subsection 7, paragraph a, 1 subparagraph (1), Code 2014, is amended to read as follows: 2 (1) In order to provide additional funding to increase 3 student opportunities and redirect more resources to student 4 programming for school districts that share operational 5 functions, a supplementary weighting of two hundredths per 6 pupil shall be assigned to pupils enrolled in a district that 7 shares with a political subdivision one or more operational 8 functions of a curriculum director, school administration 9 manager, or social worker, school nurse, school counselor, or 10 school librarian, or one or more operational functions in the 11 areas of superintendent management, business management, human 12 resources, transportation, or operation and maintenance for at 13 least twenty percent of the school year shall be assigned a 14 supplementary weighting for each shared operational function . 15 A school district that shares an operational function in 16 the area of superintendent management shall be assigned a 17 supplementary weighting of eight pupils for the function. A 18 school district that shares an operational function in the area 19 of business management, human resources, transportation, or 20 operation and maintenance shall be assigned a supplementary 21 weighting of five pupils for the function. A school district 22 that shares the operational functions of a curriculum director, 23 school administration manager, or social worker shall be 24 assigned a supplementary weighting of three pupils for the 25 function. The additional weighting shall be assigned for 26 each discrete operational function shared. However, a school 27 district may receive the additional weighting under this 28 subsection for sharing the services of an individual with a 29 political subdivision even if the type of operational function 30 performed by the individual for the school district and the 31 type of operational function performed by the individual 32 for the political subdivision are not the same operational 33 function, so long as both operational functions are eligible 34 for weighting under this subsection. S.F. 2269 school district shall be assigned the additional weighting 1 for the type of operational function that the individual 2 performs for the school district, and the school district 3 shall not receive additional weighting for any other function 4 performed by the individual. The operational function sharing 5 arrangement does not need to be a newly implemented sharing 6 arrangement to receive supplementary weighting under this 7 subsection . However, to receive supplementary weighting under 8 this subsection for an ongoing operational function sharing 9 arrangement that began before July 1, 2014, the district 10 shall submit information to the department documenting the 11 cost savings directly attributable to the shared operational 12 functions and describe the district’s consideration of 13 additional shared operational functions. 14 Sec. 2. Section 257.11, subsection 7, paragraphs c and d, 15 Code 2014, are amended to read as follows: 16 c. Supplementary weighting pursuant to this subsection 17 shall be available to a school district for a maximum of 18 five years during the period commencing with the budget year 19 beginning July 1, 2014, through the budget year beginning 20 July 1, 2019. The minimum amount of additional weighting 21 for which a school district shall be eligible is an amount 22 equivalent to ten additional pupils, and the maximum amount 23 of additional weighting for which a school district shall be 24 eligible in a budget year is an amount equivalent to forty 25 eighteen additional pupils. Receipt of supplementary weighting 26 by a school district pursuant to this subsection for more 27 than one year shall be contingent upon the annual submission 28 of information by the district to the department documenting 29 cost savings directly attributable to the shared operational 30 functions. Criteria for determining the number of years for 31 which supplementary weighting shall be received pursuant 32 to this subsection , subject to the five-year maximum, and 33 for determining qualification of operational functions for 34 supplementary weighting shall be determined by the department 35 -2- LSB 5731SV (2) 85 md/sc 2/ 5
S.F. 2269 by rule, through consideration of long-term savings by the 1 school district or increased student opportunities. 2 d. Supplementary weighting pursuant to this subsection 3 shall be available to an area education agency for a maximum of 4 five years during the period commencing with the budget year 5 beginning July 1, 2014, through the budget year beginning July 6 1, 2019. The minimum amount of additional funding for which 7 an area education agency shall be eligible in a budget year 8 is fifty thirty thousand dollars, and the maximum amount of 9 additional funding for which an area education agency shall 10 be eligible is two hundred thousand dollars. The department 11 of management shall annually set a weighting for each area 12 education agency to generate the approved operational sharing 13 expense using the area education agency’s special education 14 cost per pupil amount and foundation level. Receipt of 15 supplementary weighting by an area education agency for more 16 than one year shall be contingent upon the annual submission 17 of information by the district to the department documenting 18 cost savings directly attributable to the shared operational 19 functions. Criteria for determining the number of years for 20 which supplementary weighting shall be received pursuant 21 to this subsection , subject to the five-year maximum, and 22 the amount generated by the supplementary weighting, and 23 for determining qualification of operational functions for 24 supplementary weighting shall be determined by the department 25 by rule, through consideration of long-term savings by the area 26 education agency or increased student opportunities. 27 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 28 immediate importance, takes effect upon enactment. 29 EXPLANATION 30 The inclusion of this explanation does not constitute agreement with 31 the explanation’s substance by the members of the general assembly. 32 Code section 257.11(7), enacted in 2013 Iowa Acts, chapter 33 65 (HF 472), established supplementary weighting of 0.02 per 34 pupil for school districts and area education agencies that 35 -3- LSB 5731SV (2) 85 md/sc 3/ 5
S.F. 2269 share with a political subdivision one or more operational 1 functions of a curriculum director, school administration 2 manager, social worker, school nurse, school counselor, or 3 school librarian, or one or more operational functions in the 4 areas of superintendent management, business management, human 5 resources, transportation, or operation and maintenance for at 6 least 20 percent of the school year. The additional weighting 7 is assigned for each discrete operational function shared. The 8 supplementary weighting is available to a school district for 9 a maximum of five years during the period commencing with the 10 budget year beginning July 1, 2014, through the budget year 11 beginning July 1, 2019. Code section 257.11(7) establishes a 12 minimum amount and a maximum amount of additional weighting 13 for which a school district or area education agency may be 14 eligible. 15 This bill strikes school nurse, school counselor, and school 16 librarian from the list of operational functions for which 17 supplementary weighting is provided to school districts and 18 area education agencies. 19 The bill also strikes the 0.02 per pupil supplementary 20 weighting for school districts and area education agencies and 21 establishes an additional weighting for each shared operational 22 function based on the type of operational function. A school 23 district or area education agency that shares an operational 24 function in the area of superintendent management shall be 25 assigned a supplementary weighting of eight pupils. A school 26 district or area education agency that shares an operational 27 function in the area of business management, human resources, 28 transportation, or operation and maintenance shall be assigned 29 a supplementary weighting of five pupils. A school district or 30 area education agency that shares the operational functions of 31 a curriculum director, a school administration manager, or a 32 social worker shall be assigned a supplementary weighting of 33 three pupils. 34 The bill also provides that a school district may receive 35 -4- LSB 5731SV (2) 85 md/sc 4/ 5
S.F. 2269 the additional weighting for sharing the services of an 1 individual with a political subdivision even if the type of 2 operational function performed by the individual for the school 3 district and the type of operational function performed by 4 the individual for the political subdivision are not the same 5 operational function, so long as both operational functions 6 are eligible for weighting under the bill. In such case, the 7 school district shall be assigned the additional weighting for 8 the type of operational function that the individual performs 9 for the school district, and the school district shall not 10 receive additional weighting for any other function performed 11 by the individual. 12 The bill strikes the minimum amount of additional weighting 13 for which a school district may be eligible and changes 14 the minimum amount of additional funding for which an area 15 education agency is eligible from $50,000 to $30,000. 16 The bill provides that the maximum amount of additional 17 weighting for which a school district is eligible in a budget 18 year is 18 additional pupils. 19 The bill also strikes provisions that required certain 20 documentation and reporting of the cost savings directly 21 attributable to shared operational functions and language 22 relating to ongoing operational function sharing agreements 23 that began before July 1, 2014. 24 The bill takes effect upon enactment. 25 -5- LSB 5731SV (2) 85 md/sc 5/ 5
