1.
Section
455D.9,
subsection
1,
Code
2014,
is

amended
to
read
as
follows:

1.
Land
disposal
of
yard
waste
as
defined
by
the
department
3
is
prohibited.
However,
yard
waste
which
has
been
separated
at
4
its
source
from
other
solid
waste
may
be
accepted
by
a
sanitary
5
landfill
for
the
purposes
of
soil
conditioning
or
composting.
6
A
sanitary
landfill
may
accept
yard
waste
under
any
of
the
7
following
circumstances:
8
a.
When
the
yard
waste
is
separated
at
its
source
from
other
9
solid
waste
and
is
accepted
by
the
sanitary
landfill
for
the
10
purposes
of
soil
conditioning
and
composting.

b.
When
the
yard
waste
is
collected
for
disposal
as
a
result
12
of
a
severe
storm
and
the
yard
waste
originates
in
an
area
13
declared
to
be
a
disaster
area
in
a
declaration
issued
by
the
14
president
of
the
United
States
or
the
governor.

c.
When
the
yard
waste
is
collected
for
disposal
to
control,
16
eradicate,
or
prevent
the
spread
of
insect
pests,
tree
and
17
plant
diseases,
or
invasive
plant
species
problems.

EXPLANATION
19
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
20
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
land
disposal
of
yard
waste.
22
Currently,
land
disposal
of
yard
waste
is
prohibited
except
23
yard
waste
may
be
accepted
by
a
sanitary
landfill
for
the
24
purposes
of
soil
conditioning
or
composting.
25
The
bill
adds
two
additional
circumstances
under
which
yard
26
waste
may
be
accepted
for
land
disposal.
The
first
is
when
the
27
yard
waste
is
collected
for
disposal
as
a
result
of
a
severe
28
storm
and
the
yard
waste
originates
in
an
area
declared
to
be
a
29
disaster
area
in
a
declaration
issued
by
the
president
of
the
30
United
States
or
the
governor.
The
second
circumstance
is
when
31
the
yard
waste
is
collected
for
disposal
to
control,
eradicate,
32
or
prevent
the
spread
of
insect
pests,
tree
and
plant
diseases,
33
or
invasive
plant
species
problems.
