S.F. 2196 DIVISION I 1 TRAINING ON BLOOD-BORNE PATHOGENS 2 Section 1. Section 135.11, subsections 20 and 21, Code 2014, 3 are amended to read as follows: 4 20. Adopt rules which require personnel of a licensed 5 hospice, of a homemaker-home health aide provider agency which 6 receives state homemaker-home health aide funds, or of an 7 agency which provides respite care services and receives funds 8 to complete a minimum of two hours of training concerning 9 acquired immune deficiency syndrome-related conditions through 10 a program approved by the department. The rules shall require 11 that new employees complete the training within six months of 12 initial employment and existing employees complete the training 13 on or before January 1, 1989 blood-borne pathogens, including 14 human immunodeficiency virus and viral hepatitis, consistent 15 with standards from the federal occupational safety and health 16 administration . 17 21. Adopt rules which require all emergency medical 18 services personnel, firefighters, and law enforcement personnel 19 to complete a minimum of two hours of training concerning 20 acquired immune deficiency syndrome-related conditions and 21 the prevention of blood-borne pathogens, including human 22 immunodeficiency virus infection and viral hepatitis, 23 consistent with standards from the federal occupational safety 24 and health administration . 25 DIVISION II 26 HEALTH CARE WORKFORCE SUPPORT INITIATIVE 27 Sec. 2. Section 135.153A, Code 2014, is amended to read as 28 follows: 29 135.153A Safety net provider recruitment and retention 30 initiatives program —— repeal. 31 The department, in accordance with efforts pursuant to 32 sections 135.163 and 135.164 and in cooperation with the Iowa 33 collaborative safety net provider network governing group as 34 described in section 135.153 , shall establish and administer 35 -1- LSB 5305SV (4) 85 ad/nh 1/ 9
S.F. 2196 a safety net provider recruitment and retention initiatives 1 program to address the health care workforce shortage relative 2 to safety net providers. Funding for the program may be 3 provided through the health care workforce shortage fund or 4 the safety net provider network workforce shortage account 5 created in section 135.175 . The department, in cooperation 6 with the governing group, shall adopt rules pursuant to chapter 7 17A to implement and administer such program. This section is 8 repealed June 30, 2014 2016 . 9 Sec. 3. Section 135.175, subsection 1, paragraph a, Code 10 2014, is amended to read as follows: 11 a. A health care workforce support initiative is established 12 to provide for the coordination and support of various efforts 13 to address the health care workforce shortage in this state. 14 This initiative shall include the medical residency training 15 state matching grants program created in section 135.176 , 16 the nurse residency state matching grants program created 17 in section 135.178 , the fulfilling Iowa’s need for dentists 18 matching grant program created in section 135.179, the health 19 care professional and Iowa needs nurses now initiative created 20 in sections 261.128 and 261.129 , the safety net provider 21 recruitment and retention initiatives program created in 22 section 135.153A , health care workforce shortage national 23 initiatives, and the physician assistant mental health 24 fellowship program created in section 135.177 . 25 Sec. 4. Section 135.175, subsection 5, Code 2014, is amended 26 by adding the following new paragraph: 27 NEW PARAGRAPH . h. The fulfilling Iowa’s need for dentists 28 matching grant program account. The fulfilling Iowa’s need 29 for dentists matching grant program account shall be under 30 the control of the department and the moneys in the account 31 shall be used for the purposes of the fulfilling Iowa’s need 32 for dentists matching grant program as specified in section 33 135.179. Moneys in the account shall consist of moneys 34 appropriated or allocated for deposit in the account or 35 -2- LSB 5305SV (4) 85 ad/nh 2/ 9
S.F. 2196 received by the fund or the account and specifically dedicated 1 to the fulfilling Iowa’s need for dentists matching grant 2 program account for the purposes of such account. 3 Sec. 5. Section 135.175, subsection 6, paragraph a, Code 4 2014, is amended to read as follows: 5 a. Moneys in the fund and the accounts in the fund 6 shall only be appropriated in a manner consistent with the 7 principles specified and the strategic plan developed pursuant 8 to sections 135.163 and 135.164 to support the medical 9 residency training state matching grants program, the nurse 10 residency state matching grants program, the fulfilling Iowa’s 11 need for dentists matching grant program, the health care 12 professional incentive payment program, the Iowa needs nurses 13 now initiative, the safety net recruitment and retention 14 initiatives program, for national health care workforce 15 shortage initiatives, for the physician assistant mental health 16 fellowship program, for the purposes of the Iowa needs nurses 17 now infrastructure account, and to provide funding for state 18 health care workforce shortage programs as provided in this 19 section . 20 Sec. 6. Section 135.175, subsection 9, Code 2014, is amended 21 by striking the subsection. 22 Sec. 7. Section 135.176, subsection 3, Code 2014, is amended 23 by striking the subsection. 24 Sec. 8. Section 135.177, subsection 3, Code 2014, is amended 25 to read as follows: 26 3. This section is repealed June 30, 2014 2016 . 27 Sec. 9. Section 135.178, subsection 2, Code 2014, is amended 28 to read as follows: 29 2. This section is repealed June 30, 2014 2016 . 30 Sec. 10. NEW SECTION . 135.179 Fulfilling Iowa’s need for 31 dentists. 32 1. The department, in cooperation with a dental nonprofit 33 health service corporation, shall create the fulfilling Iowa’s 34 need for dentists matching grant program. 35 -3- LSB 5305SV (4) 85 ad/nh 3/ 9

Funding for the program may be provided through the 1 health care workforce shortage fund or the fulfilling Iowa’s 2 need for dentists matching grant program account created in 3 section 135.175. The purpose of the program is to establish, 4 expand, or support the placement of dentists in dental or rural 5 shortage areas across the state by providing education loan 6 repayments. 7 3. The department shall contract with a dental nonprofit 8 health service corporation to implement and administer the 9 program. The dental nonprofit health service corporation shall 10 provide loan repayments to dentists who practice in a dental or 11 rural shortage area as defined by the department. 12 Sec. 11. Section 261.128, subsection 5, Code 2014, is 13 amended to read as follows: 14 5. This section is repealed June 30, 2014 2016 . 15 Sec. 12. Section 261.129, subsection 5, Code 2014, is 16 amended to read as follows: 17 5. Repeal. This section is repealed June 30, 2014 2016 . 18 DIVISION III 19 HEALTH CARE WORKFORCE SUPPORT INITIATIVE ACCOUNTS —— FUTURE 20 PROVISIONS 21 Sec. 13. Section 135.175, subsection 1, paragraph a, Code 22 2014, is amended to read as follows: 23 a. A health care workforce support initiative is established 24 to provide for the coordination and support of various efforts 25 to address the health care workforce shortage in this state. 26 This initiative shall include the medical residency training 27 state matching grants program created in section 135.176 , 28 the nurse residency state matching grants program created in 29 section 135.178 , the health care professional and Iowa needs 30 nurses now initiative created in sections 261.128 and 261.129 , 31 the safety net provider recruitment and retention initiatives 32 program created in section 135.153A , and health care workforce 33 shortage national initiatives , and the physician assistant 34 mental health fellowship program created in section 135.177 . 35 -4- LSB 5305SV (4) 85 ad/nh 4/ 9
S.F. 2196 Sec. 14. Section 135.175, subsection 5, paragraphs b, c, e, 1 f, and g, Code 2014, are amended by striking the paragraphs. 2 Sec. 15. Section 135.175, subsection 6, paragraphs a and c, 3 Code 2014, are amended to read as follows: 4 a. Moneys in the fund and the accounts in the fund shall 5 only be appropriated in a manner consistent with the principles 6 specified and the strategic plan developed pursuant to sections 7 135.163 and 135.164 to support the medical residency training 8 state matching grants program, the nurse residency state 9 matching grants program, the health care professional incentive 10 payment program, the Iowa needs nurses now initiative, the 11 safety net recruitment and retention initiatives program, for 12 national health care workforce shortage initiatives, for the 13 physician assistant mental health fellowship program, for the 14 purposes of the Iowa needs nurses now infrastructure account, 15 and to provide funding for state health care workforce shortage 16 programs as provided in this section . 17 c. State appropriations to the fund shall be allocated in 18 equal amounts to each of the accounts within the fund, unless 19 otherwise specified in the appropriation or allocation. Any 20 federal funding received for the purposes of addressing state 21 health care workforce shortages shall be deposited in the 22 health care workforce shortage national initiatives account, 23 unless otherwise specified by the source of the funds, and 24 shall be used as required by the source of the funds. If 25 use of the federal funding is not designated, twenty-five 26 percent of such funding shall be deposited in the safety net 27 provider network workforce shortage account to be used for the 28 purposes of the account and the remainder of the funds shall 29 be used in accordance with the strategic plan developed by the 30 department of public health in accordance with sections 135.163 31 and 135.164 , or to address workforce shortages as otherwise 32 designated by the department of public health. Other sources 33 of funding shall be deposited in the fund or account and used 34 as specified by the source of the funding. 35 -5- LSB 5305SV (4) 85 ad/nh 5/ 9
S.F. 2196 Sec. 16. EFFECTIVE DATE. This division of this Act takes 1 effect July 1, 2016. 2 DIVISION IV 3 SALON LICENSES AND INSPECTIONS 4 Sec. 17. Section 157.11, Code 2014, is amended to read as 5 follows: 6 157.11 Salon licenses. 7 1. A salon shall not operate unless the owner has obtained 8 a license issued by the department. The owner shall apply 9 to the department on forms prescribed by the board. The 10 department shall may perform a sanitary inspection of each 11 salon biennially and may perform a sanitary inspection of a 12 salon prior to the issuance of a license. An inspection of a 13 salon shall may also be conducted upon receipt of a complaint 14 by the department. 15 2. The application shall be accompanied by the biennial 16 license fee determined pursuant to section 147.80 . The license 17 is valid for two years and may be renewed. 18 3. A licensed school of cosmetology arts and sciences at 19 which students practice cosmetology arts and sciences is exempt 20 from licensing as a salon. 21 DIVISION V 22 MORTUARY SCIENCE INSPECTIONS 23 Sec. 18. Section 156.10, Code 2014, is amended to read as 24 follows: 25 156.10 Inspection. 26 1. The director of public health shall may inspect all 27 places where dead human bodies are prepared or held for burial, 28 entombment, or cremation, and shall may adopt and enforce 29 such rules and regulations in connection with the inspection 30 as shall may be necessary for the preservation of the public 31 health. 32 2. The Iowa department of public health shall may assess an 33 inspection fee for an inspection of a place where dead human 34 bodies are prepared for burial or cremation. S.F. 2196 be determined by the department by rule. 1 DIVISION VI 2 BARBERSHOP LICENSES AND INSPECTIONS 3 Sec. 19. Section 158.9, Code 2014, is amended to read as 4 follows: 5 158.9 Barbershop licenses. 6 1. A barbershop shall not operate unless the owner has 7 obtained a license issued by the department. The owner shall 8 apply to the department on forms prescribed by the board. The 9 department shall may perform a sanitary inspection of each 10 barbershop biennially and may perform a sanitary inspection of 11 a barbershop prior to the issuance of a license. An inspection 12 of a barbershop shall may also be conducted upon receipt of a 13 complaint by the department. 14 2. A licensed barber school at which students practice 18 barbering is exempt from licensing as a barbershop. 19 DIVISION VII 20 PLUMBING, MECHANICAL, HVAC-REFRIGERATION, SHEET METAL, AND 21 HYDRONIC LICENSES 22 Sec. 20. Section 105.18, subsection 2, unnumbered paragraph 23 1, Code 2014, is amended to read as follows: 24 The board shall issue master licenses for plumbing, 25 mechanical, HVAC-refrigeration, sheet metal, and hydronic 26 professionals. The board shall issue journeyperson licenses 27 for plumbing, mechanical, HVAC-refrigeration, sheet metal, and 28 hydronic professionals. A plumbing license shall allow an 29 individual to perform work defined as plumbing. A mechanical 30 license shall allow an individual to perform work defined 31 as HVAC, refrigeration, sheet metal, and hydronic. An 32 HVAC-refrigeration license shall allow an individual to perform 33 work defined as HVAC and refrigeration. A hydronic license 34 shall allow an individual to perform work defined as hydronic. 35 -7- LSB 5305SV (4) 85 ad/nh 7/ 9
S.F. 2196 A sheet metal license shall allow an individual to perform work 1 defined as sheet metal. The board shall issue the separate 2 licenses as follows: 3 EXPLANATION 4 The inclusion of this explanation does not constitute agreement with 5 the explanation’s substance by the members of the general assembly. 6 This bill relates to programs and services of the department 7 of public health (DPH). 8 Division I, regarding training concerning blood-borne 9 pathogens, requires DPH to adopt rules to require personnel of 10 a licensed hospice, personnel of a homemaker-home health aide 11 provider agency, personnel of an agency requiring respite care 12 services, emergency medical services personnel, firefighters, 13 and law enforcement personnel to complete training concerning 14 blood-borne pathogens consistent with federal occupational 15 safety and health administration (OSHA) standards rather than 16 completing the two hours of training concerning acquired-immune 17 deficiency syndrome-related conditions that is currently 18 required. 19 Divisions II and III relate to the health care workforce 20 support initiative codified in Code section 135.175. This 21 initiative includes many initiatives and programs and the 22 health care workforce shortage fund has separate accounts for 23 each of these initiatives and programs. The initiative, the 24 workforce shortage fund, and all the accounts and programs 25 within the initiative are set to repeal on June 30, 2014. 26 The bill eliminates the repeal of the health care workforce 27 support initiative and health care workforce shortage fund. 28 The bill retains the medical residency training state matching 29 grants program, the health care workforce shortage national 30 initiatives, and the related accounts. The bill delays the 31 repeal for the nurse residency state matching grants program, 32 the health care professional and Iowa needs nurses now 33 initiative, the safety net provider recruitment and retention 34 initiatives program, and the physician assistant mental health 35 -8- LSB 5305SV (4) 85 ad/nh 8/ 9
S.F. 2196 fellowship program and the related accounts until June 30, 1 2016. 2 The bill establishes the fulfilling Iowa’s need for dentists 3 matching grant program within the health care workforce support 4 initiative and establishes the fulfilling Iowa’s need for 5 dentists matching grant program account within the health 6 care workforce shortage fund. The fulfilling Iowa’s need for 7 dentists matching grant program is established to establish, 8 expand, or support the placement of dentists in dental or 9 rural shortage areas across the state by providing education 10 loan repayments. The bill requires DPH to contract with a 11 dental nonprofit health service corporation to implement and 12 administer the program. 13 Divisions IV through VI, concerning salon licenses and 14 inspections, mortuary science inspections, and barbershop 15 licenses and inspections, respectively, eliminate mandatory 16 inspections in these establishments and instead institute 17 permissive inspections. 18 Division VII eliminates language allowing the plumbing and 19 mechanical systems board to issue a master license for sheet 20 metal professionals. 21 -9- LSB 5305SV (4) 85 ad/nh 9/ 9
